Golf Cart Rental Agreement


GOLF CART RENTAL AGREEMENT & LIABILITY WAIVER

(Please read carefully before signing)

This agreement is entered into between Ohoopee GA, LLC (hereinafter “Owner”) and the undersigned (hereinafter “Renter”).

In consideration for the use of a golf cart provided by Ohoopee GA, LLC, Renter agrees to the following terms and conditions:

1) RESPONSIBILITY FOR USE AND CONDITION: Renter agrees to return the golf cart immediately upon completion of the rental period in the same condition in which it was received, normal wear excepted.

Renter agrees to operate the golf cart safely and responsibly and to protect the cart from loss, theft, or damage.

Renter accepts full responsibility and financial liability for any damage, loss, or theft of the golf cart, as well as any injury or damage to persons or property arising from its use, regardless of fault.

Renter agrees to reimburse Ohoopee GA, LLC for all repair or replacement costs, including but not limited to insurance deductibles and any uninsured losses.

2) OPERATION AND INSPECTION:

Renter agrees to:

  • Inspect the golf cart prior to use and report any issues immediately
  • Follow all instructions provided by Ohoopee GA, LLC staff
  • Contact Ohoopee GA, LLC with any concerns or if damage occurs

Renter acknowledges that the golf cart is in acceptable working condition at the time of use unless otherwise reported.

3) RULES AND LEGAL COMPLIANCE: Renter agrees to follow all campground rules and all applicable state and local laws.

Renter further agrees:

  • Drivers must be at least 16 years old
  • Drivers must not be under the influence of alcohol or drugs
  • Drivers must possess a valid driver’s license
  • Golf cart must be operated responsibly and within all posted limits

4) USE RESTRICTIONS: Renter agrees to the following rules:

  • Maximum occupancy: 4 persons (including children)
  • No driving through campsites, on walking trails, or on grass
  • No driving on sandbars, through standing water or restricted areas
  • Golf cart must remain within campground property at all times
  • Speed limit is 5 MPH and must be strictly followed

5) MAINTENANCE, FUEL, AND CHARGING: 

Renter agrees:

  • Not to perform any maintenance or repairs
  • Not to add fuel to gas-powered carts
  • Not to charge electric carts independently

If service is needed, Renter must contact Ohoopee GA, LLC.

Any unauthorized maintenance or misuse will result in full financial responsibility for damages.

6) REVOCATION OF USE: Ohoopee GA, LLC reserves the right to revoke golf cart privileges at any time, without notice or refund, for any violation of this agreement.

7) BREAKDOWN POLICY: If the golf cart becomes inoperable through no fault of the Renter, Ohoopee GA, LLC will make reasonable efforts to repair or replace it.  If unable to do so, a prorated refund or replacement cart may be provided.

8) RECOGNITION AND ASSUMPTION OF RISK: Renter acknowledges that operating or riding in a golf cart involves inherent risks that may result in injury, property damage, or death.

These risks include, but are not limited to:

  • Collisions with other vehicles, objects, or persons
  • Loss of control, tipping, or rollover
  • Sudden stops or mechanical failure
  • Uneven terrain, gravel, sand, or wet surfaces
  • Passenger behavior or driver inexperience
  • Injury to passengers, pedestrians, or others

Renter understands that these risks may arise from their own actions, the actions of others, environmental conditions, or negligence of Ohoopee GA, LLC.

RENTER KNOWINGLY AND VOLUNTARILY ASSUMES ALL RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM NEGLIGENCE, AND ACCEPTS FULL RESPONSIBILITY FOR USE OF THE GOLF CART.

9) RELEASE OF LIABILITY

Renter agrees to release, hold harmless, defend, and indemnify Ohoopee GA, LLC, its owners, agents, and employees from any and all claims, damages, losses, or expenses (including attorney fees) arising out of or related to the use of the golf cart.

This includes, but is not limited to:

  • Personal injury or death
  • Property damage
  • Theft or loss
  • Claims brought by third parties

10) ACKNOWLEDGMENT

Renter certifies that:

  • They are in good health and capable of operating or riding in a golf cart
  • They are not under the influence of drugs or alcohol
  • They have read and fully understand this agreement
  • They have had the opportunity to ask questions

Renter agrees that this document is legally binding and applies to themselves, their guests, and all passengers.
