RELEASE OF LIABILITY, WAIVER AND ASSUMPTION OF RISK

As a participant or observer of Kiddie Cartwheel Club, LLC (“KCC”) you will be involved in, or exposed to, activities, both physical and non-physical, which involve significant elements of risk, which cannot be eliminated without destroying the unique and exciting character of such activities. Such activities include, but are not limited to: a) locomotor: walking, galloping, fleeing, sliding, hopping, chasing, skipping, dodging, b) manipulatives: striking, catching, dribbling, c) non-manipulatives: turning, jumping, twisting, landing, rolling, stretching, balancing, transferring weight, d) team building, obstacle courses or games, all of which may involve running, jumping, kicking, throwing or swinging, and going over or through obstacles using common gymnastics apparatus and equipment, e) lifting light objects, f) cartwheels, candlesticks, headstands, leaps, handstands, round-offs, front limbers, back limbers and g) other specialty classes.

In consideration of being allowed to participate in or observe any and all activities at KCC, I agree as follows: 

This is a legally binding Release of Liability, Waiver of Liability, and Assumption of Risk. READ CAREFULLY.

Please read each section completely. Your signature below indicates you have read, understand, and accept each of these terms and statements.

1. I am voluntarily participating in, or observing, activities at KCC and accept any risk, known or unknown, whether participating in an activity or not.

2. I understand that activities at KCC have significant risks, both known and unknown, which could result in physical injury, emotional injury, paralysis, death or damage to myself or others, and damage to personal property, either to mine or others. I understand that such risk cannot be eliminated without jeopardizing the essential qualities of the activity and I accept the possibility of such outcomes occurring while participating or observing. 

3. I understand that risks as a participant or observer at KCC may include but not be limited to: a) sprains, b) strains, c) fractures, d) dislocations, e) overuse injuries, f) back injuries, g) head injuries, h) ligament tears, i) growth plate injuries, j) overexertion, and k) psychological stress. I recognize that gymnastics involves physical exertion and potentially hazardous movements that could result in injury. I acknowledge that this is not an all-inclusive list of risks and I agree to assume all known and unknown risks while participating in activities or being an observer of KCC. 

4. I am ultimately responsible for my own risk management and taking appropriate precautions to protect myself and those in proximity to me while participating in or observing activities of KCC.

5. I represent that I have no medical condition or physical limitation which could negatively interfere with my ability, or the ability of others, to participate in or observe activities at KCC.

6. I have carefully read the “Kiddie Cartwheel Club Rules & Recommendations” for participating in all activities and agree to abide by the rules at all times while participating in a KCC class.

7. Medical Provision: Understanding that KCC does not have medical personnel or treatment available to participants, I authorize and grant permission to KCC staff to secure emergency medical treatment for myself or, if my minor child or ward is the Participant, for the minor. I have insurance sufficient to cover medical costs that may be incurred, and, in any event, I agree to be responsible for such costs.

8. Media Release: I consent to the reproduction and use by KCC of photographs, videos, and other images and sound recordings of me, without compensation and without further notice or authorization for advertising or other purposes. I release KCC and other Released Parties from any claim of violation of any personal and/or proprietary right I may have in connection with such representation or use.

9. RELEASE OF LIABILITY: I understand that I am assuming all risk of harm, injury (physical or emotional), loss or death arising from any and all, each and every, activity related to, arising out of, or in any manner connected to my involvement in any activity, whether active or passive, on or about the KCC and host location premises. I further agree that KCC, its LLC members, officers, employees and agents shall not be liable for any claim, demand, cause of action of any kind whatsoever for any injury or damage to person or property arising out of or connected with my participation in KCC classes, my use of the host facilities in any capacity or my being an observer, whether participating in an activity or not. I agree to indemnify and to hold KCC harmless from all claims by or liability to me, except for the claims arising out of KCC knowingly failing to correct a dangerous situation brought to its attention.

I have had sufficient opportunity to read this entire document, I understand it in its entirety, and I agree to be bound by its terms.

By signing this document, I acknowledge I may be found by a court of law to have waived my rights to maintain a lawsuit against KCC for any claim that I released by signing this document.

ADDITIONAL INDEMNIFICATION BY PARENT OR LEGAL GUARDIAN OF MINOR NAMED AS PARTICIPANT ON PREVIOUS PAGE (Required for participants under 18 years old.)

In consideration of the aforementioned participant (hereinafter referred to as “Minor”) being permitted to participate in or observe any activity of KCC, I make this release and these representations stated above on their behalf as well as my own, and I agree to assume responsibility for their safety. I further agree to indemnify and hold harmless KCC from any and all claims which are brought by, or on behalf of Minor or me, and which are in any way connected to the participation or observation of any activity at KCC by Minor. This Agreement applies to and binds myself, my children, my parents, my guardian, my heirs, my assigns, my executors, my legal representatives, and my estate.

I have read the “Kiddie Cartwheel Club Rules & Recommendations” with the Minor I am signing on behalf of, and it is my responsibility to ensure they understand and abide by said rules. By signing below I am representing that I am a parent of the aforementioned Minor or I am their court appointed, legal guardian.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
