OCEAN FRONTIERS LTD LIABILITY AND EXPRESS ASSUMPTION
THIS RELEASE MAY BE USED AGAINST YOU IN A COURT OF LAW IF YOU SUE ANY RELEASED PARTY OR PERSON. PLEASE READ CAREFULLY, FILL IN ALL THE BLANKS AND INITAL EACH PARAGRAPH BEFORE SIGNING I have been advised and thoroughly informed of the inherent hazards of snorkeling (skin diving) and scuba diving. Further, I understand that diving with compressed air involves certain inherent risks: decompression sickness, embolism and other hyperbaric injuries can occur that require treatment in a re-compression chamber. I further understand that the open water diving trips may be at a site that is remote, either by time or distance or both, from such a re- compression chamber in proximity to the dive or snorkel site. I understand the medical issues relating to diving or snorkeling and I confirm that I am in good health and fit to scuba dive or snorkel, of sound mind, and not under the influence of drugs or alcohol.
I understand and agree that neither my scuba diving or snorkel guides, the facility Ocean Frontiers Ltd., nor PADI International Inc., nor any of their respective employees, officers, agents or assigns, (hereinafter referred to as “Released Parties”) may be held liable or responsible in any injury, death or other damages to me or my family, heirs or assigns that may occur as a result of my participation in scuba diving or snorkeling, or as a result of the negligence of any party, including Released Parties, whether passive or active.
I further save and hold harmless said scuba diving or snorkel Guides and Released Parties from any claim or lawsuit by me, my family, estate, heirs, or assigns arising out of this scuba diving or snorkel activity.
I also understand that snorkeling (skin diving) and scuba diving are physically strenuous activities and that I will be exerting myself during this scuba dive or snorkel and that if I am injured as a result of a heart attack, panic, hyperventilation, etc., that I expressly assume the risk of said injuries and that I will not hold the above listed individuals or companies responsible for same. I further understand that the degree of risk can be affected by circumstances foreseen and unforeseen such as weather conditions, the condition of the equipment and my own physical condition and capabilities.
I further state that I am of lawful age and legally competent to sign this liability and release, or that I have acquired the written consent of my parent or guardian.
I understand that I am required to give Ocean Frontiers Ltd. 24 hours’ notice for cancellation of scheduled diving/snorkeling activities (48 hours for 3 or more) or a cancellation fee will be charged.
I understand that the terms herein are contractual and not a mere recital, and that I have signed this document of my own free will.
OCEAN FRONTIERS AIMS TO REDUCE THE RISK OF DIVE-RELATED INJURIES BY ADHERING TO THE FOLLOWING SAFETY REGULATIONS
[1] Nitrox gas is mandatory in the afternoon for divers wishing to do 4 dives a day. All divers wanting to do 4 dives in a day must be certified as Enriched Air Nitrox (EANx) divers. Nitrox is recommended for ALL dives where possible.
[2] Dive computers are required. Always keep a minimum of 5 minutes of no decompression time on your dive computers. If you have not been diving with the computer prior, make sure a crew member gives you an adequate briefing and that you are comfortable with how it works and how to read the display if you were to go past your dive computer's limits and into decompression.
[3] Do a slow ascent along with a 3 minute safety stop at 15 ft / 5 m after each dive.
[4] The following maximum depth limits are mandatory for each dive and are not targets. The maximum depth of the dive site may be shallower. If the following limits are not maintained, Ocean Frontiers retains the right to not permit you to make any further dives that day. This is a measure to increase your safety. In addition, no refunds will be issued if said limits are exceeded. Dive 1 - 100 ft / 30 m Dive 2 - 60 ft / 18 m Dive 3 - 80 ft / 24 m Dive 4 - 60 ft / 18 m
[5] Ensure that you are well hydrated. You should drink a minimum of 1 gallon / 4 liters of water throughout the day as a proactive measure to avoid decompression sickness.
[6] Avoid alcohol and tobacco. Research has proven that both of these substances significantly increase the body's susceptibility to decompression sickness and therefore should be avoided when doing multiple dives per day.
I HEREBY ASSUME THE RESPONSIBILITY FOR MY DIVE PROFILES. PERSONAL SAFETY, AND THE CONSEQUENCES THAT COULD ENSUE SHOULD I CHOOSE, WILLINGLY OR NOT, TO NOT ADHERE TO THEM.
IT IS THE INTENTION OF BY THIS INSTRUMENT TO EXEMPT AND RELEASE MY SCUBA DIVING AND SNORKEL GUIDES, THE FACILITY OCEAN FRONTIERS LTD., AND PADI INTERNATIONAL INC., AND ALL RELATED ENTITIES AS DEFINED FROM WRONGFUL DEATH HOWEVER CAUSED, INCLUDING BUT NOT LIMITED TO, THE NEGLIGENCE OF RELEASED PARTIES, WHETHER PASSIVE OR ACTIVE. I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS LIABILITY RELEASE AND EXPRESS ASSUMPTION OF RISK BY READING IT BEFORE I SIGNED IT ON BEHALF OF MYSELF AND MY HEIRS. Today's Date: August 7, 2025 |
