CRASH PAD RENTAL AGREEMENT

In consideration of the services of BETA BOULDERING GYM, LLC, its agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "Beta" or "BETA BOULDERING GYM",), I hereby agree to release and discharge Beta, on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows:

  1. I fully understand that there are certain dangers involved in the use of a crash pad that are beyond the control of BETA BOULDERING GYM and its employees, which may result in accident, injury, death, or property damage either to myself or other persons. 

  2. I understand that it is my responsibility to ensure the safe and proper loading of my crash pad in or on my vehicle. I acknowledge that improper loading and attachment of my crash pad may result in damage to vehicles around me, and the crash pad itself. 

  3. I agree to assume sole liability for any injuries or damages received while using BETA BOULDERING GYM equipment. I agree to release, indemnify and hold harmless BETA BOULDERING GYM, and its officers, agents, or employees from any and all liability or costs associated with or arising from renting BEA BOULDERING GYM equipment.

  4. I understand that a $15.00 nonrefundable deposit is required for each crash pad rented and the return of this deposit is at the sole discretion of BETA BOULDERING GYM at the time the equipment is returned.

  5. I understand that if equipment is broken or damaged due to improper use or carelessness, the deposit will be withheld and Dirty or wet gear is subject to an additional $35 charge. If the cost of repair or replacement exceeds the amount of deposit held, additional charges, will be my responsibility.

     
  6. I understand that if equipment is not returned within the specified timeframe of this waiver, I am subject to an additional fine of double the cost of each piece of equipment not returned, per day not returned until day of item returned.

     


By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Beta on the basis of any claim from which I have released them herein. This document remains active until it is cancelled or modified by written agreement.

I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I HAVE HAD THE OPPORTUNITY TO ASK QUESTIONS ABOUT THIS DOCUMENT. I HAVE READ AND UNDERSTOOD IT, AND I AGREE TO BE BOUND BY ITS TERMS.

Organic Simple Pad - $20.00 per day ($20.00 deposit)

Organic Big Pad - $25.00 per day ($25.00 deposit)

Load Flap - $5.00 per day ($5.00 deposit)

Every effort is made to provide safe and well-maintained equipment. As the renter, you are responsible for making sure the equipment is what you need and that you know how to properly use it. BETA BOULDERING GYM cannot be responsible for your knowledge of the equipment or how you will use it when you leave. If you have questions, please ask them before you leave.

PARENT'S OR GUARDIAN'S ADDITIONAL INDEMNIFICATION (Must be completed for participants under the age of 18) In consideration of "Minor" being permitted by Beta to participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless Beta from any and all Claims which are brought by, or on behalf of Minor, and which are in any way connected with such use or participation by Minor.
