HUNTING HILLS LEGACY

WAIVER AND RELEASE OF LIABILITY

In consideration of Hunting Hills Legacy (“HHL”) furnishing services, equipment, guiding, and/or the facilities, and in consideration of my participation in clay shooting, upland bird hunting, and other related activities (the “Sport”), I agree as follows:

1. Assumption of Risk

I fully understand and acknowledge that:

(a) there are risks and dangers in my use of Sport equipment and my participation in the Sport;

(b) my participation in the Sport, use of Sport equipment, and/or presence at HHL’s facilities may result in damage to or loss of personal property, personal injury, death, or other ailments that could cause serious disability;

(c) these risks and dangers may be caused by the negligence of the shareholders, officers, directors, employees, guides, or agents of HHL, the negligence of others, accidents, breaches of contract, forces of nature, wildlife, or other causes, and that risks and dangers may arise from foreseeable or unforeseeable causes; and

(d) I, on behalf of myself, my family, heirs, executors, administrators, representatives, and assigns, assume all risks and dangers and all responsibility for any losses and/or damages which result from my participation in the Sport or presence in or on HHL’s facilities.

WE RECOMMEND TAKING INSTRUCTION OR A GUIDE FOR ALL FIRST-TIME AND BEGINNER SHOOTERS/HUNTERS.

I HAVE READ AND UNDERSTAND THE COURSE RULES & POLICIES ON THE REVERSE SIDE / ATTACHED.

2. Release and Waiver

I, for myself, my spouse, family, heirs, executors, administrators, legal representatives, and assigns, hereby release, waive, and discharge HHL, and its officers, shareholders, directors, employees, guides, and agents (collectively, “Releasees”) from any and all claims, actions, or losses for injuries, property damage, death, loss of services, or other, arising out of my participation in the Sport or presence in or on HHL’s facilities, whether due to the fault or negligence of Releasees, circumstances beyond Releasees’ control, or otherwise.

3. Entire Agreement

This Release and Waiver contains the entire agreement between HHL and me. The terms of this Release and Waiver are contractual and not a mere recital.

4. Image and Likeness Release

I grant Hunting Hills Legacy, its officers, employees, and agents the irrevocable right and permission to photograph, film, video, or otherwise record my image, voice, and likeness while I am participating in activities at or through HHL, and to use, reproduce, publish, and distribute such photographs, video, and recordings, in whole or in part, in any and all media now known or later developed (including without limitation print, website, and social media), for the purposes of advertising, promotion, marketing, and any other lawful business purpose of HHL.

I understand that I will not receive any compensation for this use, and I release HHL from any claims arising out of such use, including without limitation any claims for defamation, invasion of privacy, or infringement of any right of publicity. If I do not wish to grant this permission, I must notify HHL staff in writing prior to participating, and I understand HHL will make reasonable efforts to honor that request.

5. Upland Bird Hunting — Hunting Dog Liability

I understand that trained hunting dogs are used in the course of upland bird hunting activities at HHL and that these dogs are a valuable and essential part of the hunt.

I agree that if I shoot or kill a hunting dog while participating in an upland bird hunting activity at HHL, whether intentionally or accidentally, I will be solely responsible for reimbursing HHL (or the dog’s owner/handler, as applicable) the sum of $5,000.00 per dog, payable immediately upon demand. This amount is in addition to, and not in place of, any other liability I may have under this Agreement or applicable law.

I acknowledge this obligation and agree to always positively identify my target before shooting, in accordance with HHL’s safety rules and instructions from my guide.

6. Binding Effect

I HAVE READ THIS RELEASE AND WAIVER, INCLUDING THE COURSE RULES, IMAGE AND LIKENESS RELEASE, AND HUNTING DOG LIABILITY SECTIONS ABOVE, CAREFULLY, AND BY SIGNING IT AGREE IT IS MY INTENTION TO RELIEVE HHL FROM LIABILITY FOR INJURIES, PROPERTY DAMAGE, OR DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSES. I ALSO UNDERSTAND AND WILL FOLLOW THE SPORT RULES, GUIDELINES, AND RULES THAT MAY ALSO BE POSTED AROUND THE PROPERTY AS IMPOSED BY HHL.

Hunting Hills Legacy — Course Rules & Policies

  1. Protective glasses and ear protection must be worn on the shooting course at all times.
  2. All guests must abide by all signage, rules, policies, and regulations posted around the course and property at all times.
  3. Guests may use their own shotguns, provided they are a field/sporting shotgun with a barrel length of 24” or longer for a break action, or 20” or longer for a pump action or semi-automatic shotgun. No tactical, sawed-off barrels, collapsible stocks, homemade, and/or pistol-grip shotguns are allowed, unless supporting a disabled guest.
  4. No picture-taking from in front of the shooting stations. No drones are allowed at any time on the property for everyone’s safety. Do not walk off any designated path for any reason — you may be in an active shooting or hunting area.
  5. Never enter or look into the opening of a trap house or trap machine and never attempt to fix a trap machine yourself. Notify HHL staff at once of any problems or safety issues.
  6. No alcoholic beverages or recreational drugs are allowed prior to or during shooting or hunting activities. No one will be permitted to participate if deemed to be under the influence of alcohol or drugs.
  7. All guest guns, gear, coolers, golf carts, or ATVs may be subject to safety inspections.
  8. A shotgun can only be loaded when a shooter is in the station (or, in the field, when actively hunting under guide supervision), the gun is over the front rail or pointed in a safe direction, and the target area is clear. At all other times, the gun shall be unloaded and either placed on a rack or carried vertically with the action open.
  9. On the clays course, all shots must be taken from inside a station by one person at a time. Shooting from anywhere else, including next to or in front of a station, is strictly prohibited. Only wheelchair shooters are permitted to shoot directly next to a station when deemed safe.
  10. No practice mounts or swings are allowed except while in the station (or, in the field, under guide direction) with the gun pointed in a safe direction.
  11. No more than two shells in a shotgun at any time. The largest shot size permitted is #7½ (i.e., #8, #9 allowed — no #6 shot or larger), unless otherwise directed by your guide for upland bird hunting.
  12. On the clays course, it is forbidden to shoot at any live game. During upland bird hunting activities, shoot only the permitted quarry — always positively identify your target, including hunting dogs and other hunters in the field, before shooting.
  13. HHL is not responsible for any damage to your person, gun, or equipment that falls off a pushcart, golf cart, or ATV for any reason, whether it is yours or HHL’s cart. All drivers of a golf cart or ATV, whether yours or HHL’s, must possess a valid driver’s license.
  14. Guns carried on personal golf carts or ATVs must be carried vertically. HHL is not responsible for damage to personal golf carts or ATVs caused by staff, other guests, or the owner.
  15. No golf cart or ATV speeding. Speeding is considered driving faster than a person jogging, or as judged by staff. Speeders will be asked to leave for the day with no refund — no warnings.
  16. Unless otherwise directed, drive only in the designated direction of travel. All golf cart riders must be seated. No hanging or standing on the back of a golf cart or ATV. No more than four riders per golf cart.
  17. HHL Management or Range/Field Safety Officers have the final determination on safety matters. Any infraction of these rules or regulations may result in loss of privileges and possible expulsion from the property with no refund.
