Turning Tides ME Activity Waiver

I. Acknowledgement of Risks

I acknowledge that I am voluntarily participating in outdoor water activities, including but not limited to guided tide pooling and hiking, offered by Turning Tides ME (hereinafter referred to as "the Company"). I understand and acknowledge that these activities involve inherent risks, including, but not limited to: 

  • Drowning or submersion
  • Injuries or death from slips and falls over rocky terrain
  • Exposure to weather conditions (sunburn, hypothermia, etc.)
  • Injuries from wildlife or aquatic hazards
  • Illness or injury resulting from waterborne diseases or contaminants
  • Other risks associated with water activities

II. Assumption of Risk

I, the undersigned, voluntarily assume all risks of injury, death, property damage, or loss, whether caused by the negligence of the Company, its agents, employees, or other participants, or otherwise, that may arise from my participation in the above-described activities.

III. Release of Liability

In consideration of being allowed to participate in the activities, I hereby release, waive, discharge, and covenant not to sue the Company, its officers, directors, employees, agents, and representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or any of my property while participating in the activities.

IV. Acknowledgement of terms and conditions

I am accepting the terms and conditions as laid out on the Company's website and acknowledge that the Company may suspend activities with no refund if I behave in a destructive manner to the tide pools or people around me, that I am not allowed to bring pets to the tide pools, and that any child under 18 they must be accompanied by an adult and a slot must be booked for them regardless of age.
