ADVENTURE ZONE PLAYGROUND AREA RISK WARNING, WAIVER AND CONDITIONS OF ENTRY GENERAL TERMS & CONDITIONS These terms and conditions affect your legal rights. Please read this agreement carefully before making a purchase. By signing this agreement or selecting “I agree to the Terms and Conditions,” you acknowledge that you have read, understood, and agreed to be bound by these terms. If you are making a purchase on behalf of another person, you agree that you are their agent, and they will also be bound by this agreement. Chuck E. Cheese Joondalup supplies all tickets and recreational services, including playground activities, entertainment, food & drinks. Participation in these activities is subject to the Terms and Conditions outlined here, the safety rules displayed in the venue, and if applicable, instructions provided during safety briefings. By purchasing an Adventure Zone Playground Area session and/or participating, you agree to these Terms and Conditions and confirm your acceptance of the Chuck E. Cheese Adventure Zone Playground Area Risk Warning and Waiver. PARTICIPATION STATEMENT By participating, you agree to the Terms & Conditions and Safety Rules & Restrictions. It is the responsibility of parents/guardians to ensure that children adhere to these rules. RISK WARNING & WAIVER 1. Before you participate in the Adventure Zone Playground Area, you should ensure that you are aware of, and properly understand, all of the risks involved, and that those risks will include any particular risks associated with any health condition from which you may suffer. 2. I acknowledge that by voluntarily participating in the activities associated with the Adventure Zone Playground and Climbing Zone includes but is not limited to playground structures, slides, tunnels, rope bridges, nets, ball pits, obstacle courses, interactive play equipment, and any related recreational or physical activities, I am exposing myself to certain inherent risks including the risk of personal injury and death. 3. Risk Warning: I understand and agree that my voluntary participation in the Adventure Zone Playground Area is a recreational activity that involves inherent risks. These risks include, but are not limited to, falls, trips, slips, collisions, falls from heights, collisions with others, and physical exertion that may aggravate existing medical conditions. I further acknowledge that unforeseen accidents may occur despite adherence to safety protocols. By agreeing to this waiver, I accept these risks voluntarily. 4. I understand and agree that my participation in the Adventure Zone Playground Area involves risks of injury, illness and death, including but not limited to twists, sprains, broken bones, bruising, and/or physical injury, concussion, friction burns, aggravation of existing medical conditions, mental harm, serious physical injury, head and brain injury, neck injury, spinal injury, paralysis and death. These risks may arise from prevailing conditions, user error, or accidental incidents 5. You acknowledge, agree, and understand that the risk warning above constitutes a 'risk warning' for the purposes of the relevant legislation, including for the purpose of section 5I of the Civil Liability Act 2002 (WA). 6. Section 139A of Competition and Consumer Act 2010 (Cth) and section 5J of the Civil Liability Act 2002 (WA) permit the Centre Owner to ask you to agree that the statutory guarantees under the Australian Consumer Law do not apply to you (or a person for whom or on whose behalf you are purchasing the services). Those guarantees include that the Centre Owner is required to ensure that the services: - are rendered with due care and skill; and
- are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and might reasonably be expected to achieve any result you have made known to the supplier.
7. You agree that your rights to sue the Centre Owner under the Competition and Consumer Act 2010 (Cth) if you die or are injured because the services provided were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in this agreement. 8. You acknowledge, agree and understand that, to the full extent permitted by law (including by section 5J of the Civil Liability Act 2002 (WA) and section 139A of the Competition and Consumer Act 2010 (Cth)): - Your rights (or the rights of a person for whom or on whose behalf you are acquiring the services) to sue the Centre Owner, its servant and agents, if the services were not provided to you in accordance with any express or implied warranty or guarantee that the services will be provided with reasonable care and skill, are excluded, restricted or modified as set out below; and
- You (or the person for whom or on whose behalf you are acquiring the services) release the Centre Owner, its servant and agents, from all liability for a failure to comply with any express or implied warranty or guarantee that the services will be provided with reasonable care and skill.
9. You acknowledge, agree and understand that, to the full extent permitted by law, the liability of the Centre Owner in relation to recreational services (as that term is defined in the Australian Consumer Law and any similar state laws) and recreational activities (as that term is defined in the Civil Liability Act 2002 WA) for any death; physical or mental injury (including the aggravation, acceleration or recurrence of such an injury); the contraction, aggravation or acceleration of a disease; the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs that is or may be harmful or disadvantageous to you or the community; that may result in harm or disadvantage to you or the community; that may be suffered by you (or a person for whom or on whose behalf you are acquiring the services) resulting from the supply of recreational services or recreational activities is excluded. 10. In consideration of being permitted to participate in the Adventure Zone Playground Area, I, to the greatest extent permissible by law, hereby release, waive, and hold harmless the Centre Owner from any and all Claims I may have against the Centre Owner arising from any Harm I suffer, whether directly or indirectly, from or in connection with my participation in the Adventure Zone Area. 11. I warrant that: - If I am a Guardian, I have authority to act as the Guardian of the Participant and to bind myself, the Participant, and each other person responsible for the Participant to this Waiver.
- I am physically and mentally sound to participate in the Adventure Zone Playground Area.
- I have disclosed any health conditions that may be aggravated by participation.
- I consent to the Centre Owner using disclosed health information to obtain emergency medical treatment if required.
- I will not participate under the influence of drugs, alcohol, or medications that impair my judgment.
- I will only attempt activities that I am confident I can perform safely.
12. I agree: - To abide by all Centre Rules and acknowledge that failure to do so may result in revocation of access without refund.
- To listen to and follow all instructions given during the Centre Briefing Sessions.
- To use the Adventure Zone Playground Area responsibly and safely.
- In the event of Harm, to immediately cease participation, report the incident to the Centre Owner, and authorise them to secure emergency medical treatment.
- To acknowledge that the Centre may use theatrical lighting, strobe effects, smoke, and other visual effects.
- That any legal proceedings related to this waiver will be filed exclusively in the State of Western Australia.
13. I understand and agree that: - This waiver causes me to relinquish certain legal rights.
- I am providing this waiver voluntarily and without coercion.
- My acceptance of these terms and conditions confirms my agreement to all terms.
Definitions: - Adventure Zone Playground Area: Includes the area for all recreational activities and facilities within the Centre, such as slides, soft play equipment, art and craft areas, and electronic gaming.
- Centre: Chuck E. Cheese Joondalup, Western Australia.
- Centre Owner: CEC Aus Pty Ltd ATF CEC Aus Unit Trust T/AS Chuck E. Cheese Joondalup.
- Centre Rules: All instructions, rules, and safety guidelines provided by the Centre Owner.
- Claim: Any demand, action, or proceeding for loss or damage, including negligence.
- Harm: Includes physical injury, death, psychological trauma, and illness.
- Participant: The person participating in the Adventure Zone Playground Area.

If you are making a purchase on behalf of another person, you agree that you are their agent, and they will also be bound by this agreement. Chuck E. Cheese Joondalup (also referred to as "Chuck E. Cheese Adventure Zone and Climbing Zone") supplies all tickets and recreational services, including climbing activities, entertainment, food & drinks, and use of the Adventure Zone and Climbing Zone. Participation in these activities is subject to the Terms and Conditions outlined here, the safety rules displayed in the venue, and instructions provided during safety briefings. By purchasing a Chuck.E Cheese Adventure Zone and Climbing Zone session and/or participating, you agree to these Terms and Conditions and confirm your acceptance of the Chuck E. Cheese Climbing Wall Waiver. PARTICIPATION STATEMENT By participating, you agree to the Terms & Conditions and Safety Rules & Restrictions. It is the responsibility of parents/guardians to ensure that minors adhere to these rules. Climbing is not recommended for individuals with neck, back, or heart conditions, recent surgeries, or if pregnant. If you have any concerns or pre-existing medical conditions, discuss them with a Chuck E. Cheese staff member before participating. RISK WARNING & WAIVER 14. Before you participate in the Adventure Zone Playground Area and Climbing Zone, you should ensure that you are aware of, and properly understand, all of the risks involved, and that those risks will include any particular risks associated with any health condition from which you may suffer. 15. I acknowledge that by voluntarily participating in the activities associated with the Adventure Zone Playground Area and Climbing Zone including but not limited to high climbing, use of the auto-belay system, harness fitting and use, clipping in and out, ascending, controlled descending, and any other activities directly associated with the climbing wall system, I am exposing myself to certain inherent risks including the risk of personal injury and death. 16. Risk Warning: I understand and agree that my voluntary participation in the Adventure Zone Playground Area and Climbing Zone is a recreational activity that involves inherent risks. These risks include, but are not limited to, falls from heights, collisions with others, trips, slips, and collisions. I further acknowledge that unforeseen accidents may occur despite adherence to safety protocols. By agreeing to this waiver, I accept these risks voluntarily. 17. I understand and agree that my participation in the Adventure Zone Playground Area and Climbing Zone involves risks of injury or illness, including but not limited to, twists, sprains, broken bones, bruising, and/or physical injury, concussion, friction burns, aggravation of existing medical conditions, mental harm, serious physical injury, head and brain injury, neck injury, spinal injury, paralysis and death. These risks may arise from prevailing conditions, user error, or accidental incidents. Further risks may arise due to any health condition you may have, including if you are pregnant. If you have any health condition, you should consult your medical practitioner prior to participating in the activities, Adventure Zone and Climbing Zone. 18. You acknowledge, agree, and understand that the risk warning above constitutes a 'risk warning' for the purposes of the relevant legislation, including for the purpose of section 5I of the Civil Liability Act 2002 (WA). 19. Section 139A of Competition and Consumer Act 2010 (Cth) and section 5J of the Civil Liability Act 2002 (WA) permit the Centre Owner to ask you to agree that the statutory guarantees under the Australian Consumer Law do not apply to you (or a person for whom or on whose behalf you are purchasing the services). Those guarantees include that the Centre Owner is required to ensure that the services: - are rendered with due care and skill; and
- are reasonably fit for any purpose which you, either expressly or by implication, make known to the supplier; and
- might reasonably be expected to achieve any result you have made known to the supplier.
20. I acknowledge that the Company strongly recommends that individuals weighing more than 120 kilograms do not participate in climbing activities or use the auto-belay system within the Climbing Zone. By choosing to participate despite exceeding this recommended weight, I expressly accept and assume all risks, including but not limited to equipment malfunction, personal injury, or death, and I release the Company from any liability arising from such participation. 21. You agree that your rights to sue the Centre Owner under the Competition and Consumer Act 2010 (Cth) if you die or are injured because the services provided were not in accordance with these guarantees, are excluded, restricted or modified in the way set out in this form. 22. You acknowledge, agree and understand that, to the full extent permitted by law (including by section 5J of the Civil Liability Act 2002 (WA) and section 139A of the Competition and Consumer Act 2010 (Cth)): - Your rights (or the rights of a person for whom or on whose behalf you are acquiring the services) to sue the Centre Owner, its servant and agents, if the services were not provided to you in accordance with any express or implied warranty or guarantee that the services will be provided with reasonable care and skill, are excluded, restricted or modified as set out below; and
- You (or the person for whom or on whose behalf you are acquiring the services) release the Centre Owner, its servant and agents, from all liability for a failure to comply with any express or implied warranty or guarantee that the services will be provided with reasonable care and skill.
23. You acknowledge, agree and understand that, to the full extent permitted by law, the liability of the Centre Owner in relation to recreational services (as that term is defined in the Australian Consumer Law and any similar state laws) and recreational activities (as that term is defined in the Civil Liability Act 2002 WA) for any death; physical or mental injury (including the aggravation, acceleration or recurrence of such an injury); the contraction, aggravation or acceleration of a disease; the coming into existence, the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs: that is or may be harmful or disadvantageous to you or the community; that may result in harm or disadvantage to you or the community; that may be suffered by you (or a person for whom or on whose behalf you are acquiring the services) resulting from the supply of recreational services or recreational activities is excluded. 24. In consideration of being permitted to participate in the Climbing Wall, I, to the greatest extent permissible by law, hereby release, waive, and hold harmless the Centre Owner from any and all Claims I may have against the Centre Owner arising from any Harm I suffer, whether directly or indirectly, from or in connection with my participation in the Climbing Wall Area 25. I warrant that: - If I am a Guardian, I have authority to act as the Guardian of the Participant and to bind myself, the Participant, and each other person responsible for the Participant to this Waiver.
- I am physically and mentally sound to participate in the Adventure Zone and Climbing Zone.
- I confirm that I am not aware of any medical or health condition that may be aggravated, worsened, or otherwise negatively affected by participation in the Climbing Zone. If I am aware of such a condition, I acknowledge that I have disclosed it to a staff member prior to participation and that I choose to participate voluntarily and entirely at my own risk.
- I will not participate under the influence of drugs, alcohol, or medications that impair my judgment.
- I will only attempt activities that I am confident I can perform safely.

- Centre Owner: CEC Aus Pty Ltd ATF CEC Aus Unit Trust T/AS Chuck E. Cheese Joondalup.
- Centre Rules: All instructions, rules, and safety guidelines provided by the Centre Owner.
- Claim: Any demand, action, or proceeding for loss or damage, including negligence.
- Harm: Includes physical injury, death, psychological trauma, and illness.
- Participant: The person participating in the Climbing Wall.
DISCLAIMER Climbing involves inherent risks and hazards, including personal injury or, in rare cases, death. By agreeing to these Terms and Conditions, you accept and assume all risks associated with climbing. Chuck E. Cheese Joondalup ensures a safe experience through high-quality harnesses, safety equipment, and trained staff. However, Chuck E. Cheese Joondalup is not responsible for injuries caused by negligence on the part of Participants. You accept full responsibility for your actions and those of your party during your climbing session. RELEASE Subject to applicable laws, you release, discharge, and hold harmless Chuck E. Cheese Joondalup of its employees, directors, and agents from all liabilities, claims, or damages resulting from participation in climbing activities. GENERAL GUIDELINES - Entry price includes safety equipment hire, a 10-minute introduction, and a safety briefing.
- Participants must arrive 20 minutes before the session for processing, harnessing, and the safety briefing.
- Enclosed shoes must be always worn in the climbing area. Open-toe shoes, sandals, or barefoot climbing are prohibited.
- Wristbands will be issued at the Point of Sale with the date and time for the climbing session and must be worn by climbers during participation.
- Climbing is restricted to children aged 3–15 years. Adults are prohibited from climbing.
- Parents/Guardians are responsible for supervising their children throughout the session.
- No food or drinks are permitted in the Gaming Areas, Adventure Zone and Climbing Zone.
SAFETY RULES AND RESTRICTIONS Climbers Must: - Wear a Chuck E. Cheese Climbing Wall harness and clip onto the auto-belay system before climbing.
- Attend a safety briefing before climbing.
- Tie long hair back and avoid wearing jewellery. Secured eyewear is permitted.
- Wear closed-toe, enclosed shoes and appropriate clothing.
Climbers Must Not: - Exceed the age of 15 or participate if under 3 years old.
- Consume food or drink in the climbing area.
- Run, jump, or push others in the climbing area.
- Hold or pull on safety ropes while climbing.
- Bounce off the wall during descent.
- Participate while pregnant or impaired by a medical condition or cast.
- Climb barefoot or wear inappropriate footwear.
HEALTH AND EMERGENCY TREATMENT Participants must be in good health and free from adverse medical conditions. If required, you authorize Chuck E. Cheese Joondalup to provide emergency medical treatment, including ambulance transportation, at your expense. RIGHT TO REFUSE ENTRY - Chuck E. Cheese Joondalup reserves the right to deny or cancel access if participants:
- Appear intoxicated or under the influence of illicit substances.
- Fail to follow safety rules or staff instructions.
- Act recklessly, offensively, or pose a danger to themselves or others.
CONSENT FOR VIDEO AND IMAGES By entering the Chuck E. Cheese Joondalup you consent to being photographed or videoed for security purposes. This includes children under your supervision. |
