PLEASE READ CAREFULLY — THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS

This Waiver of Claims, Assumption of Risk, Release of Liability, and Indemnification Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Signature Black Hills Tours, LLC, its owners, officers, members, managers, employees, contractors, agents, guides, drivers, volunteers, affiliated companies, insurers, successors, and assigns.

In consideration for being permitted to participate in transportation, sightseeing, hiking, scrambling, climbing, and related recreational or educational activities (collectively, the “Activities”), Participant agrees as follows:

ACKNOWLEDGMENT AND ASSUMPTION OF INHERENT RISK

I acknowledge that participation in a private guided tour involves inherent, natural, and unpredictable risks that cannot be eliminated, including risks associated with outdoor environments, terrain, wildlife, weather, transportation, physical activity, and remote locations.

Outdoor Environment & Terrain:

  • Uneven terrain, rocky surfaces, loose gravel, exposed roots, wet or slippery conditions
  • Natural or minimally maintained trails, viewpoints, pull-offs, and walkways
  • Hazards may be unmarked or not readily visible

Signature Black Hills Tours, LLC does not own, control, inspect, or maintain trails, walking areas, overlooks, or natural surfaces and makes no representations regarding their condition or safety.

Locations (Non-Exhaustive):

Tours may include walking, standing, or hiking in and around locations such as Sylvan Lake, Norbeck Overlook, Mount Rushmore National Memorial, Badlands National Park, and surrounding developed and undeveloped areas.

Physical Activity & Elevation:

  • Walking or hiking over uneven or exposed terrain
  • Physical exertion that may cause fatigue, dizziness, or injury
  • Exposure to elevations of approximately 5,000–7,000 feet

Weather & Environmental Exposure:

  • Rapidly changing weather conditions
  • Heat, cold, wind, rain, snow, lightning, or hail

Low-Light & Extended Touring Conditions:

  • Reduced visibility due to low light, shadows, glare, or artificial lighting
  • Increased risk of slips, trips, and falls
  • Fatigue during extended touring hours

Wildlife & Natural Hazards:

  • Encounters with wildlife including bison (buffalo), elk, deer, prairie dogs, burros, rattlesnakes, and other animals
  • Wildlife is unpredictable and not controlled by Signature Black Hills Tours, LLC

Insects & Environmental Pests:

  • Exposure to ticks, stinging insects, and other pests

Vehicle Transportation & Roadway Exposure:

  • Travel in a high-clearance sport utility vehicle on highways, park roads, mountain byways, gravel roads, narrow roads, tunnels, steep grades, and winding routes
  • Routes may include Needles Highway and Iron Mountain Road
  • Sudden stops or evasive maneuvers due to wildlife, traffic, road conditions, or emergencies
  • Entering or exiting the vehicle on uneven or unpaved surfaces
  • Exposure to active roadways and third-party traffic at tour stops

I understand I am voluntarily choosing to ride as a passenger in a motor vehicle operated by Signature Black Hills Tours, LLC as part of this tour.

Remote Locations & Facilities:

  • Limited or no cellular service
  • Delayed emergency response times
  • Limited restroom access

Food & Beverages:

  • Snacks and water may be provided
  • I am responsible for disclosing food allergies
  • An allergen-free environment cannot be guaranteed

Guest Conduct:

Failure to follow guide instructions or posted rules materially increases risk.

I knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable.

RELEASE OF LIABILITY

To the fullest extent permitted by South Dakota law, I release and hold harmless Signature Black Hills Tours, LLC, its owners, guides, employees, contractors, and agents from any and all claims, demands, injuries, damages, or losses arising out of or related to my participation in the tour, including those resulting from ordinary negligence. This release does not apply to gross negligence, recklessness, or willful misconduct.

INDEMNIFICATION AND HOLD HARMLESS

I agree to indemnify, defend, and hold harmless Signature Black Hills Tours, LLC, its owner, employees, contractors, agents, and representatives from and against any and all claims, demands, causes of action, damages, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of or related to my participation in this activity that result from my own negligence, failure to follow instructions, violation of laws or regulations, pre-existing medical or physical conditions, or my actions or omissions that cause injury to myself or others, or damage to property.

This indemnification obligation applies only to the extent permitted by law and does not apply to claims arising from gross negligence, recklessness, or willful misconduct by Signature Black Hills Tours, LLC or its representatives.

UNITED STATES & NATIONAL PARK SERVICE RELEASE

The undersigned further waives liability of the United States and acknowledges and agrees that the United States and its officers and employees are fully released from any liability for injuries, damages, or losses that the undersigned sustains as a result of or in connection with the undersigned’s participation in this activity.

This release of the United States applies only to the extent permitted by applicable law and does not waive claims arising from gross negligence, recklessness, or willful misconduct to the extent such claims cannot legally be waived.

STATE OF SOUTH DAKOTA & STATE PARK ACKNOWLEDGMENT

I further acknowledge that portions of the tour may occur on land owned or administered by the State of South Dakota, including Custer State Park, and I agree that the State of South Dakota and its officers, employees, and agencies are not responsible for my participation in this activity, to the fullest extent permitted by law.

PARTICIPANT RESPONSIBILITY

I understand that I may be responsible for claims arising from my own actions, as described in the Indemnification and Hold Harmless section of this agreement.

SUPERVISION & EMERGENCY ACKNOWLEDGMENT

I understand that Signature Black Hills Tours, LLC provides guiding and interpretive services but cannot continuously supervise every participant at all times. I acknowledge that I am responsible for my own footing and personal safety and that immediate assistance or rescue may not be available.

MEDICAL ACKNOWLEDGMENT

I confirm that I am physically capable of participating, have disclosed relevant medical conditions, understand emergency medical care may be delayed, consent to emergency medical treatment if necessary, and am responsible for my own medical expenses.

GUIDE AUTHORITY

I agree to follow all guide instructions and understand that the guide has authority to modify activities or end my participation without refund if my conduct is unsafe or violates rules.

GOVERNING LAW & VENUE

This agreement shall be governed by the laws of the State of South Dakota. Any legal action shall be brought exclusively within the State of South Dakota.

SEVERABILITY & ENTIRE AGREEMENT

If any provision is found unenforceable, the remaining provisions shall remain in full force and effect. This document constitutes the entire agreement between the parties.

BINDING EFFECT

This Agreement is binding on Participant and Participant’s heirs, executors, administrators, and assigns.

ACKNOWLEDGMENT & ELECTRONIC SIGNATURE

I have read, understood, and voluntarily agree to all terms of this Waiver & Release of Liability.

I acknowledge and agree that this constitutes my electronic signature and that I am legally bound by this Agreement.

IMPORTANT: By signing this document, I understand that I am giving up certain legal rights, including the right to bring claims for injuries or damages resulting from the ordinary negligence of Signature Black Hills Tours, LLC and its owners, employees, and agents.
