TO: Pristine Paddleboard Adventures and their directors, officers, employees, instructors, guides, agents, representatives, independent contractors, subcontractors, suppliers, sponsors, successors, and assigns (all of whom are hereinafter referred to as “the Releasees”)

DEFINITION

In this Release Agreement, the term “the Activities” means all activities, events or services provided, arranged, organized, conducted, sponsored or authorized by the Releasees including but not limited to: stand-up paddle boarding, canoeing,kayaking; rental of Stand Up Paddle Boards (hereinafter “SUP Boards”), canoes and kayaks and other equipment; orientation and instructional courses, seminars and sessions; and all travel, transport, meals and accommodation and other such activities, events and services in any way connected with or related to the Activities.

ASSUMPTION OF RISKS

I am aware that the Activities involve many risks, dangers, and hazards. The risks, dangers and hazards include but are not limited to: accidents which occur during transportation or travel to and from the put in; slip and falls while getting on and off, in or out of the SUP Boards, canoes or kayaks; falling off or capsizing of the SUP Boards, canoes or kayaks; overturning of the SUP Boards, canoes or kayaks; loss of balance; impact, collision with or entrapment by trees, logs, deadfall, boats or equipment; hypothermia; changing and inclement weather conditions including storms, high wind, high waves, and lightning; encounters with domestic or wild animals; negligence on the part of other participants; and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN THE ACTIVITIES. Communication in the remote terrain, which is sometimes used for the Activities, is difficult, and in the event of an accident, rescue and medical treatment may not be readily available.

I AM AWARE OF THE RISKS, DANGERS, AND HAZARDS ASSOCIATED WITH THE ACTIVITIES AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS, AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR LOSS RESULTING THEREFROM.

RELEASE OF LIABILITY, WAIVER OF CLAIMS, AND INDEMNITY AGREEMENT

In consideration of the RELEASEES agreeing to my participation in the Activities and permitting my use of their services, equipment and other facilities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows:

  1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the RELEASEES AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer, as a result of my participation in the Activities, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, ON THE PART OF THE RELEASEES, AND FURTHER INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE MANY RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN THE ACTIVITIES
  2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES for any and all liability for any property damage, loss, expense, or personal injury to any third party resulting from my participation in the Activities, including, but not limited to:
  • the use of my own equipment during the Activities; and
  • all costs of rescue, medical attention, or health care costs rendered to me, or for my benefit as a result of the Activities.
  • This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives, in the event of my death or incapacity;
  • This Release Agreement and any rights, duties, and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction; and
  • Any litigation involving the parties to this Release Agreement shall be brought solely within the Province of British Columbia and shall be within the exclusive jurisdiction of the Courts of that province.

In entering into this Release Agreement, I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of participating in the Activities, other than what is set forth in this Release Agreement.

I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT PRIOR TO SIGNING IT, AND I AM AWARE THAT BY SIGNING IT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I MAY HAVE AGAINST THE RELEASEES.

I CONFIRM THAT I AM NOT UNDER THE INFLUENCE OF DRUGS OR ALCOHOL NOR WILL I BE UNDER THE INFLUENCE OF DRUGS OR ALCOHOL WHEN I AM USING EQUIPMENT RENTED FROM PRISTINE PADDLEBOARD ADVENTURES.

At Pristine, we take pride in offering high-quality, premium equipment for all our guests to enjoy. Please be mindful and aware of your surroundings when in use. Paddles are designed for use in the water only, not for rushing off rocks, docks, or beaches. When coming into shore, kneel on your board until you are over waist-high water. Get off your board in knee-high water while being mindful of the fins underneath the board not hitting the rocks below. I agree to take the best possible care of the equipment rented to me by Pristine Paddleboard Adventures. 

 - I accept all equipment in its present condition, and I take full responsibility for the care of the equipment I am renting or when participating in a tour. I agree to pay for any damage to the equipment and to replace it at full retail value if it is lost or stolen.

LATE RETURN POLICY

If you are late bringing or returning any rented equipment, the first 5 minutes are on us! If you return your leased equipment late, it causes serious scheduling issues and may impact the enjoyment of other adventure-seeking guests. If you return the rented equipment after the 5-minute buffer, we charge $15 for every 15 minutes it is late.

- I understand that I will be charged a minimum of $25 if I return after closing. I know that if I exceed my reserved rental time and inconvenience other customers, I will be charged a rate double the regular rental rate for the time exceeded.

- I understand that if I rent a dry bag or a smartphone dry pouch (phone case), my contents may still get wet due to improper closure. Pristine Paddleboard Adventures IS NOT responsible for any damage to goods held within the bag/case. I accept the bag/case in its current condition. 

- I understand that Transport Canada regulations require me to wear a PFD (personal flotation device) at all times when using a Stand-Up Paddleboard. The rider shall wear the PFD at all times when paddling on the water. In addition, the provided safety board leash shall be worn at all times

- I agree to respect the local wildlife and environment by leaving no trace of my presence, ensuring that all trash and waste are properly disposed of.

PHOTO RELEASE

By paying the Pristine Paddleboard Adventures invoice, you would like to grant the releasee permission to use photographs in any of the following: Web-based publications, Print Advertisements, and Organization Bulletins. You hereby affirm that such release to the releasee does not constitute any form of compensation, including royalties arising from the photographs, to your benefit.

You understand and agree that photographs in the possession of the releasee shall become the property of the releasee. The use and publication of the photographs, however, will be in line with your rights as a subject of said photographs. You hereby waive my right to inspect or approve the photographs in which your likeness appears. You hereby hold harmless, release, and forever discharge the from all claims, demands, and causes of action which you, your heirs, representatives, executors, administrators, or any other persons acting on your behalf or on behalf of your estate have or may have by reason of this authorization.
