Equipment Rental Waiver - Lake Tahoe Snowmobile Rentals

Equipment Rental Agreement 

The undersigned renter agrees to rent the described item, hereinafter referred to as, "Equipment” at the rates established by Lake Tahoe Snowmobile Rentals. The renter further agrees to pay for any and all damage to the Equipment, including full replacement of the Equipment and/or rental unit when damage does occur. The renter agrees to pay for any and all lost RENTAL INCOME due to any damage to the Equipment. Damaged parts on all Equipment will be replaced and not repaired. Charges will be for the cost of needed parts plus labor to install. Renter fully acknowledges and agrees that the signed credit card authorized form will be used for the full payment of any damages, even if such damage arises out of the negligence of Lake Tahoe Snowmobile Rentals. The undersigned renter, in further consideration of renting the Equipment from Lake Tahoe Snowmobile Rentals hereby agrees to indemnify and hold them, and their assigns, successors and all entities or persons associated with Lake Tahoe Snowmobile Rentals from any and all claims for bodily injury and property damage resulting in any manner whatsoever from the operation, possession or participation of the rented Equipment, even if such damages arise out of the negligence of Lake Tahoe Snowmobile Rentals. The undersigned renter(s), in further consideration of the Equipment from Lake Tahoe Snowmobile Rentals, hereby waives any and all claims against Lake Tahoe Snowmobile Rentals for personal injury or against physical damage to himself and indemnifies Lake Tahoe Snowmobile Rentals, successors, assigns and all entities or persons associated with Lake Tahoe Snowmobile Rentals, harmless from any and all claims by his/her family, passengers, or any other person that he may allow to operate the rented Equipment, for bodily injury or property damage resulting in any manner whatsoever from the operation, possession or participation of the rented Equipment by the renter(s), even if such damages arise out of the negligence of Lake Tahoe Snowmobile Rentals. Renter(s) is responsible for all attorney fees and court costs if any legal manner should occur, including Lake Tahoe Snowmobile Rentals trying to collect a debt for damage to any and all Equipment.

PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK  

In consideration of the services of Silverfirs LLC DBA Lake Tahoe Snowmobile Rentals, their agents, owners, officers, volunteers, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "LTSMR"), I hereby agree to release, indemnify, and discharge LTSMR, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1.   I acknowledge that my participation in guided snowmobile tours, Snowmobile, and Snowbike rental activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. 

 The risks include, among other things: slips and falls; passengers can be jolted, jarred, bounced around, thrown about and otherwise shaken during rides; travel in rugged terrain; collision with fixed or movable objects; cuts, bruises, burns, abrasions, and concussions; strains, sprains, muscle soreness and fractures; musculoskeletal injuries including head, neck, and back; injuries to internal organs; loss of fingers or other appendages; exposure to temperature and weather extremes which could cause hyperthermia (heat related illnesses), heat exhaustion, sunburn, and dehydration; exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; exposure to altitude and cold including hypothermia, frostbite, acute mountain sickness, cerebral and pulmonary edema; hidden obstacles by snow including crevasses, ice and snow cornices, tree wells, tree stumps, creeks rocks and boulders, below the snow surface; loss or damage to equipment being used; equipment failure and/or operator error; the negligence of participants, or other persons who may be present; accidents or illness can occur in remote places without medical facilities and emergency treatment or other services rendered; transmissible pathogen or disease; traveling to and from activity locations raises the possibility of any manner of transportation accidents; my own physical condition, and the physical exertion associated with this activity.

2.   I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. Additionally, I agree to always wear a properly fitted and secured DOT or SNELL certified helmet while participating in this activity.

3.     I hereby voluntarily release, forever discharge, and agree to indemnify and not to sue, and hold harmless LTSMR from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of LTSMR’s equipment or facilities, including any such claims which allege negligent acts or omissions of LTSMR.

4.     Should LTSMR or anyone acting on their behalf but not limited to, incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

5.     I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

6.     In the event that I file a lawsuit against LTSMR, I agree to do so solely in the state of Nevada and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, Imay be found by a court of law to have waived my right to maintain a lawsuit against LTSMR on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at LTSMR. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms

PROPER WINTER ATTIRE REQUIRED

The weather conditions in the mountains can be extreme and unpredictable. All drivers and riders should always be prepared for sudden changes of weather conditions. 


RULES:

  • Must be 21 or older to operate Lake Tahoe Snowmobile Rentals equipment
  • Must have a valid driver’s license
  • Renter(s) agrees to all Lake Tahoe Snowmobile Terms and Conditions
  • Drinking and driving will not be tolerated: Whenever driving or riding, all drivers and riders will follow all applicable laws. Lake Tahoe Snowmobile Rentals will not rent a snowmobile or any equipment to anyone who is under the influence of drugs or alcohol.
  • Helmets are required for all operators and passengers.
  • All snowmobile speed Limits must be obeyed: Trails, Roads, Bridges, Sidewalks (if applicable)

ETHICS:

  • Always operate at a reasonable rate of speed for the conditions and within your ability.
  • Slow down when driving in the dark.
  • Always drive on the right-hand side of the trail and park to the right in single file off the edge of a groomed surface on straight areas of the trail or road.
  • Stay on designated trails and respect landowner’s property. 

RESERVATION & CANCELLATION POLICY:

  • NO SHOWS AND DAY OF CANCELLATIONS ARE CHARGED FOR THE ENTIRE RENTAL. Please plan ahead and accordingly.
  • You must contact us by phone to cancel or inquire about a cancellation or to reschedule.
  • Rental time begins at the scheduled reservation time, not the time you arrive. We recommend individuals arrive 30 minutes prior to rental time to complete all paperwork.
  • There is a $100 per 30-minute late fee when returning your rented equipment. Please plan ahead and accordingly.
