Snowmobile Rental Agreement The undersigned lessee agrees to rent the described item, hereinafter referred to as,“Equipment” at the rates established by the lessor and to furnish the required deposit $700 which will be refunded upon return of the Equipment in satisfactory condition. The lessee further agrees to pay for any and all damage to the Equipment caused by negligence, including full replacement of the Equipment and/or rental unit when damage does occur. The lessee agrees to pay for any and all lost RENTAL INCOME due to any damage to the Equipment. Damaged parts on all Equipment will be replaced and not repaired. Charges will be for cost of needed parts plus labor to install. Lessee fully acknowledges and agrees that the Sales Draft signed by the lessee for payment of the rental Equipment will be used for the full payment of the damage charges, even if such damages arise out of the negligence of lessor. The undersigned lessee(s), in further consideration of the lease of the Equipment from the lessor hereby agrees to indemnify lessor and hold them, their assigns, successors and all entities or persons associated with lessor from any and all claims for bodily injury or property damage resulting in any manner whatsoever from the operation, possession or participation of the leased Equipment by persons other than the lessee, even if such damages arise out of the negligence of lessor. The undersigned lessee(s), in further consideration of the lease of the Equipment from the lessor, hereby waives any and all claims against lessor for personal injury or against physical damage to himself and indemnifies lessor, successors, assigns and all entities or persons associated with lessor, harmless from any and all claims by his/her family, passengers, or any other person that he may allow to operate the leased Equipment, for bodily injury or property damage resulting in any manner whatsoever from the operation, possession or participation of the leased Equipment by the lessee(s), even if such damages arise out of the negligence of lessor. Lessee is responsible for all attorney fees and court cost if any legal manner should occur. Risk Waiver Agreement I acknowledge and agree that my participation in renting a snowmobile is an activity that comes with known and unknown risks that could cause myself physical or emotional damage. Furthermore, the danger could result in death, damage to me, my property or any third party. I understand that these risks cannot exist without changing the nature of snowmobiling. The risks of snowmobiling include but are not limited to riding on various snow-covered terrain, changing snow conditions and changes in altitude: loss of control of snowmobile, falls from snowmobile, collision with other persons, trees, rocks, other manmade or natural obstacles; Other dangers many include bruises, pinches, strains, abrasions, cuts and lacerations. While riding snowmobiles, an individual may experience exhaustion, steepness of slopes, deep snow, unpredictability of snow or varying and harsh weather; exposure to weather and temperature extremes could result in hypothermia, dehydration, frostbite, or sunburn; encounters with wildlife; minor or extreme burns; equipment problems or failures and mechanical failures; remote locations without medical help can result in accidents or illness; improper lifting or carrying can result in injury; my own physical condition and the physical exertion associated with snowmobiling, may result in injury. I agree and promise to accept and assume all the risks existing in this activity. My participation in this activity is totally voluntary and I chose to participate knowing the risk. I further understand that it is my responsibility to be safe and judge the terrain, weather condition, and ride to my know abilities. I willingly release and agree to cover and hold Lake Tahoe Snowmobile Rentals harmless of any and all claims or causes of action that result with my involvement in this activity or with my use of Lake Tahoe Snowmobile Rental machines, including careless acts. If Lake Tahoe Snowmobile Rentals needs to gain attorney fees and fees to enforce this agreement, I will hold Lake Tahoe Snowmobile Rentals harmless of these fees. I conform that I have insurance to cover any injury or damage that I may cause while renting from Lake Tahoe Snowmobile Rentals. If not, I take full responsibility for the cost of any injury or damage to myself and others. Snowmobiler’s responsibility 1. A snowmobiler must operate a snowmobile in an appropriate manner at all times to avoid injury to self and others while accepting the risk of snowmobiling. 2. A snowmobiler must know their ability and ride safely within the limits of their own ability. A snowmobiler must know their equipment, the trail, and planned course to safely ride without injury or damage. Terrain or trail changes caused by weather or other machines may affect the snowmobiler’s ability. 3. A snowmobiler must be in control at all times and at all speeds while riding to prevent injury to self and others. 4. A snowmobiler must obey all warning signs and not act in a way that can cause injury to anyone. 5. A snowmobiler must agree to all legal responsibility for any accident, injury or damage of any kind caused by the sport of snowmobiling. These risks include: Terrain change, including snow surface, subsurface changing due to weather changes, other machines, grooming, snowmobile use, or other man-made machines; bare spots due to little snow fall, melting, wind, or other snowmobile use; rocks, stumps, down trees, or other debris; signs, trail markers, and avalanches or unstable snow conditions. I agree and understand that I am signing a damage waiver on this rented snowmobile only. I understand that this waiver will only cover damage to Lake Tahoe Snowmobile Rentals. It will and does not cover any damage to other vehicles, snowmobiles, property or people including myself. Physical damage to Lake Tahoe Snowmobile Rentals equipment. By participating in the sport of snowmobiling I understand the risk and possibility of damaging the snowmobile. I acknowledge that I bear any and all risks of loss and damage to the snowmobile from any and every cause while the equipment is in my possession. In the event of any loss or damage to the snowmobile, I will pay for the cost to have the unit repaired to full working condition. If the snowmobile is a total loss, I agree to pay the Fair market value of the snowmobile as stated above. In the event of damage, I agree to allow Lake Tahoe Snowmobile Rentals to charge my credit card for the items I damaged. After billing the customer for damage, Lake Tahoe Snowmobile Rentals will provide a detailed invoice of the damaged parts, along with cost of each part based on manufactures website. By signing this waiver, I agree to all the statements and information above. |
