STATUTORY NOTICE: “Under Alabama law, an equine activity sponsor or equine professional is not liable for an injury to or the death of a participant in equine activities resulting from the inherent risks of equine activities, pursuant to the Equine Activities Liability Protection Act.” §6-5-337, Code of Alabama, 1975. A. REGISTRATION OF RIDER & AGREEMENT PURPOSE. In consideration of the payment of fees and the signing of this agreement, I, the rider or the parent/legal guardian of the minor(s) listed on this registration form, do hereby voluntarily request and agree to my or my child(ren)’s/legal ward(s)’s participation in riding at A Leap Of Faith Equestrian Center LLC and that this rider shall ride their own horse(s), a borrowed horse(s) or a horse(s) provided for said activities by A Leap Of Faith Equestrian Center LLC. B. AGREEMENT SCOPE AND TERRIRORY DEFINITIONS: This Agreement shall be legally binding upon the registered rider and the parents/legal guardians thereof if the minor, my heirs, estate, assigns, including all minor children and personal representatives; and it shall be interpreted according to the laws of the State of Alabama, and specifically that which is controlled by §6-5-337, Code of Alabama, 1975. Any disputes the rider shall be litigated in shall be filed in Cullman County, Alabama. If any portion of this Agreement should be deemed not in accordance with State law, then that portion shall be held null and void, but shall not nullify the entirety of this Agreement. C. ACTIVITY RISK CLASSIFICATION: I understand that horseback riding is classified as RUGGED ADVENTURE RECREATIONAL SPORT ACTIVITY, and that there are numerous obvious and non-obvious inherent risks present in such activity, despite all safety precautions. Accidents can result in, but are not limited to bodily injury, disfigurement, disability, illness or death. According to NEISS (National Electronic Injury Surveillance Systems of United States Consumers Products), horse activities rank 64th among activities resulting in injuries that require a stay at a US hospital. Injuries can be severe, requiring more hospital days and resulting in more lasting residual effects than other activities. D. NATURE OF RIDING A HORSE: I understand that the horses assigned to riders have been matched as well as possible to their skill levels by A Leap Of Faith Equestrian Center LLC. All horses maintained and owned by A Leap Of Faith Equestrian Center LLC are well-cared for and managed for their calm dispositions and sound basic training. However, no horse for riding is completely safe. If a horse is frightened or provoked it may divert from its training and act according to its natural survival instincts which may include, but is not specifically limited to: stopping short, changing direction or speed at will, bucking, rearing, kicking, biting, jumping, or any other unspecified unpredictable behavior. A fall from the horse to the ground may result in injury of the rider. E. RIDER RESPONSIBILITY: Upon mounting, the rider is primarily in control of the horse. The rider’s safety is largely dependent upon their ability to carry out simple instructions and their ability to remain balanced on a moving animal. The rider shall be responsible for their own safety. I have been given an opportunity to ask any questions I may have. I understand the safety recommendations must be followed at all times for participation in these activities. Failure to comply with these safety recommendations may result in elimination from the equestrian center’s activities. E. CONDITIONS OF NATURE AND INSPECTION OF PREMESIS I understand that A Leap Of Faith Equestrian Center LLC is NOT responsible for total or partial acts, occurrences, or elements of nature that can scare a horse, cause it to fall, or react in some other unsafe way. Some examples included, but are not specifically limited to: thunder, lightning, rain, wind, wild and domestic animals/insects (which may run/walk/fly by/sting/bite a horse or person), irregular footing on natural or man-made landscapes (as they are subject to constant change under the influence of weather or temperatures). I have inspected A Leap Of Faith Equestrian Center LLC’s facilities and I am satisfied that all premise conditions are reasonably safe for rider’s intended purpose, usage and presence upon said premises. F. SADDLE GIRTHS/NATURAL LOOSENING: I understand that saddle girths (saddle fasteners around horse’s belly) may loosen during a ride. If a rider notices this, they must alert the riding instructor as quickly as possible so action can be taken to avoid slippage of saddle and a potential fall from the animal. G. ACCIDENT/MEDICAL INSURANCE: I agree that should emergency medical treatment be required, I and/or my own accident/medical insurance company shall pay for all such incurred expenses. H. ASTM APPROVED PROTECTIVE HEADGEAR IS REQUIRED: I agree and/or for my child(ren)/legal ward(s) to wear protective headgear which meets or exceeds the quality standards of the SEI CERTIFIED ASTM STANDARD F 1163 Equestrian Helmet. It will worn while riding and I do understand that the wearing of such headgear at these times may reduce the severity of some of the wearer’s head injuries and possibly prevent the wearer’s death from happening as a result of a fall and other occurrences. Instructor will provide approved headgear in the case of the Rider not possessing their own personal headgear. Riders over the age of 18 may decline the option to wear protective headgear at their own risk and will assume full responsibility should an accident occur. In this case, the rider is fully aware that A Leap Of Faith Equestrian Center encourages the wearing of helmets regardless of age and cannot be held responsible for any accident or medical bills. I. LIABILITY RELEASE: By signing this Acknowledgment Agreement & Liability Release Form, I acknowledge, understand and agree that any injuries or loss can result from participation in A Leap Of Faith Equestrian Center LLC’s activities. Furthermore, I acknowledge, understand and agree that working with or around horses and riding horses is an inherently dangerous activity due to the unpredictable nature of the animal and have elected to take part in these contracted activities. I hereby release A Leap Of Faith Equestrian Center LLC, its faculty, staff, volunteers, instructors and registered agents from any and all liability as to any right of legal action, claim, demand or other cause of action that may accrue to my heirs or representatives for any injury to me and/or my child(ren)/legal ward(s) for any injury or loss that I/they may suffer while participating in these activities involving horse handling and riding and shall indemnify and hold harmless A Leap Of Faith Equestrian Center LLC and its agents, associates or assigns from any other cause, including but not limited to bodily injury, illness or death resulting from Corona-virus (COVID-19 and/or its variants), defective tack, appliances, machinery, pets or any other kind of property of A Leap Of Faith Equestrian Center LLC. Any aforementioned action which may arise shall be controlled by the laws of the State of Alabama. I also agree to indemnify and reimburse A Leap Of Faith Equestrian Center LLC and its associates for any fees and costs, should they be required to incur attorney fees and costs to enforce this agreement. J. PHOTO RELEASE: I agree for A Leap Of Faith Equestrian Center LLC to use any photographs taken on or during any function for physical or digital display, distribution, promotions or advertising. K. DEFAULT: Any breach of the terms of this agreement will render the Rider in default of this agreement. A Leap Of Faith Equestrian Center LLC and Maneka Rocca will have the right to recover any fees and expenses incurred as a result of such default or breach or breach including attorney fees and any legal remedies available to them under current Alabama or other applicable local laws. L. NOTICE OF TERMINATION: Notice of termination by the Rider and/or Parent/Legal Guardian shall be given to A Leap Of Faith Equestrian Center LLC and Maneka Rocca in writing of at least thirty (30) days. Refunds are not given for lessons not finished within the month that is already paid for. M. SEVERANCE: A Leap Of Faith Equestrian Center LLC and Maneka Rocca reserve the right to deny any activity at any time for any reason they deem unsafe or detrimental to the Rider, the horse the facility or instructor. N. TUITION - Private Half Hour Lesson- $150/month due at or before the first scheduled lesson of the month.
- Group Half Hour Lesson - $105/month due at or before the first scheduled lesson of the month.
- Group Hour Lesson - $215/month due at or before the first scheduled lesson of the month.
- Trail Rides not associated with lessons are $50.00 per rider.
Frequency: Tuition is due monthly. Invoices will be sent on the 1st of each month. You may pay invoice by card (online fee included) or by Venmo, PayPal (f&f), Cash, or check. The balance must be paid at or before the first scheduled lesson of the month. A $15.00 late fee will be charged if balance is not paid by the first scheduled lesson and for each additional week that payment is late.
O. TIMES: Lessons will take place on a recurring weekly schedule on the day and time as agreed upon by both parties and noted below. Scheduled Day: TBD Scheduled Time: TBD P. CANCELLATIONS:
We totally understand if you need to miss your scheduled lesson for any reason. We do ask that you call or txt to let us know you will be missing so that we do not have a horse waiting on you. Makeups will not be scheduled for your missed lesson. However, if we need to cancel your lesson for any reason, including for weather, your lesson credit will go into our “credit bank”. You may use your lesson credit for the next scheduled clinic or show practice or for a family/friend trail ride. “Bank credits” will expire and be forfeited if not applied to a clinic, show practice, or trail ride after 60 days from canceled lesson. In the event of cancellations or delays due to weather, A Leap Of Faith Equestrian Center LLC or Zack or Maneka Rocca will contact the Rider via GroupMe for lessons. Rider is NOT to assume that a lesson is cancelled due to weather without consulting with A Leap Of Faith Equestrian Center LLC either by txt or by message in the GroupMe lessons. April 18, 2025 |
