Liability Waiver

In Consideration Of the services provided herein by JUMPKINGDOM, LLC., or any of its Officers, directors, shareholders, employees, agents, subsidiary or affiliated entities, and in exchange for the right to enter, engage, utilize, participate, and/or spectate in the activities, services and facilities provided by JUMP KINGDOM 6901 SECURITY BLVD BALTIMORE MD 21244, I, on behalf as myself as Participant (or on behalf of the aforementioned Child as Participant) hereby agree to the following terms and conditions:

Assumption of Risk

It is understood that participating in the activities at JUMP KINGDOM facilities, which include slides, fast moving objects, obstacles, climbing, and other equipment, involves extreme physical exertion which creates an unavoidable and inherent risk of injury, illness, and/or damage to the orthopedic, neurologic, pulmonary, cardiologic and other systems of all parts of the body, including but not limited to nausea, lacerations, blunt traumas, abrasions, burns, bruises, fractures, strains, sprains, tears, paralysis, death or cognitive, mental, behavioral emotional or psychological illness. Risks of these injuries can result from various causes, including: 1) collisions and falls due to contact with objects, park equipment, and/ or other persons; 2) disorientation caused

by dizziness, fatigue, or over exertion, and 3) injuries or accidents caused by the unanticipated failure of equipment.

By signing this agreement, the specific risks of engaging in this activity have been expressly explained and understood, and that with full knowledge of such risks, I voluntarily choose to engage in the activities of my own free will and accord, and I choose assume such risks by participating in the

activities.

Pre-Existing Conditions and Medical Authorization

With knowledge that the activities to be

undertaken under this agreement involve physical exertion, I represent that I am in sufficiently good health to safely engage in the activities at the Park. I further

represent that Participant has no pre- existing physical, mental or emotional condition that may result in an aggravation or worsening of such condition by participating in the activities at the Park, or is likely to cause injury to any person or property while at the Park.

In the event of any sickness, accident or injury that may occur to Participant at the Park, I authorize Park Employees or its representatives to obtain, on Participant's behalf, any Emergency Medical Services or treatments at my expense.

Indemnity and Insurance

For any claim, allegation, lawsuit, demand, or obligation made against

JUMPKINGDOM, the Participant and his adult sponsor each agree to indemnify, defend and hold harmless JUMP KINGDOM for any losses, judgments, damages, injuries, or liabilities to person or property, including any expenses and costs (including reasonable attorney's fees and associated costs for defending the underlying claim or for enforcing this Agreement), which are alleged in whole or in part to have either directly or indirectly arisen out of or been related to: 1) Participant's negligence or intentional conduct, 2) Participant's violation of the Code of Conduct or any rule or instruction from Park personnel; 3) Participant's

engagement in activities at JUMPKINGDOM, or 4) Participant's presence on the property.

I certify that I am named as an insured under a Health Care Insurance Plan with adequate coverage to pay for any injuries that Participant or I may cause or suffer while at the JUMPKINGDOM, and to the extent such coverage does not afford full payment, I agree to pay for and bear the responsibility of such costs or injury or damages to myself or others.

I agree that the terms contained in this provision are material terms of this Agreement and that I will satisfy these

terms.

Waiver of Non-Injury and Bodily Claims

I hereby agree to waive, release and forever discharge JUMP KINGDOM from any and all claims, causes of action, actions, lawsuits, demands, losses, or damages (including claims that are compensatory, special, consequential, incidental, or punitive) of any nature or kind excluding bodily injury, whether known or unknown at the time I leave the JUMP KINGDOM property or which may arise or become known later which accrue or arise out of: 1) Participant's or my presence, activities or

actions in the Park, 2) the actions or activities of others at the Park, 3) Participant's or my use of Park facilities and equipment; 4) the failure of such equipment or facilities or 5) the

Park's decisions in securing medical treatment pursuant to the above Medical Authorization.

I further agree to waive, release and forever discharge JUMP KINGDOM from any and all claims, causes of action, actions, lawsuits, demands, losses, or damages (including claims that are compensatory, special, consequential, incidental, or punitive) for any and all personal injuries, to include any bodily, emotional, cognitive or mental injuries, whether known or unknown at the time I leave the JUMP KINGDOM property or which may arise or become known later, which accrue or arise out of: 1) Participant's or my presence, activities or actions in the Park, 2) the actions or activities of others at the Park, 3)

Participant's or my use of Park facilities and equipment; 4) the failure of such equipment or facilities; or 5) the Park's decisions in securing medical treatment pursuant to the above Medical Authorization.

I understand that this clause includes a

waiver of certain legal rights, and I have read these terms and fully agree to them.

Consent to Photos/Social Media/ Intellectual Property and Waiver

I understand that video and photography equipment will be utilized throughout JUMP KINGDOM property and acknowledge that all participants and

attendees at JUMP KINGDOM will be captured on still or motion images. I hereby authorize and grant consent JUMP KINGDOM to use my photo and/or likeness in paper or electronic publications, websites, social media, presentations, promotional literature, advertising, community presentations and media or other similar way.

I hereby grant my consent to use my image and likeness, and that such consent is freely given to JUMP KINGDOM without expectation of payment. I hereby release JUMP KINGDOM of all of claims any liability that may arise from the use of my photos, image and likeness.

Code of Conduct

It is the intent of JUMPKINGDOM, LLC that all persons participating or present on the park's property have a positive, safe and enjoyable experience. To create a positive, safe and enjoyable experience for the participant and others on the property, the following Code of Conduct is MANDATORY AT ALL TIMES while present on Park Property.

I agree to follow ALL rules and instructions posted and communicated by JUMP KINGDOM personnel, and acknowledge that the JUMP KINGDOM Code of Conduct,

the terms of which are set for the below,

constitute Material Terms of this

Agreement. I further agree that the failure to follow any rule or instruction, and any

violation of any portion of Code of Conduct is a Material Breach of this Agreement. It is acknowledged and contemplated by the parties that violation of any term or provision of the Code of Conduct, or disregarding any posted rule or communicated instruction by JUMP KINGDOM personnel may directly or indirectly result in damages to Park Property or cause Injury or Damage to the person and property of others, to which JUMP KINGDOM or I may be claimed responsible by such injured parties. I agree that as a result of any violation of any rule or instruction from Park personnel or a violation of the Code of Conduct may

result in the immediate dismissal from the

Park facilities without refund of the cost of

admission.

• I will strictly obey at all times all

warning signs, rules and instruction,

whether oral, written or video and will ask Park employees for clarification of such rules and warnings if necessary. I will agree to all time limits and expiration periods for activities

I will obey all park personnel at all

times.

⚫ I will treat all participants, and park

personnel with courtesy and respect and not bully or threaten any person while on the JUMP KINGDOM property.

• I will not use foul or profane language, and I will not insult, disparage, or

threaten others while on park property.

• I will not bring any firearms, knives or

other weapons onto park property or

use or threaten such use while on park property.

• I will not bring any tobacco, alcohol, or drugs into the Park or use such while on park property.

• I will not participate in any park activities if under the influence of alcohol, drugs, or any other substance that impacts my judgment, physical abilities, or my ability to either follow the Code of Conduct or safely participate in park activities

• I will not purposefully come into contact with any individual or use any violence, force, or aggression towards others while on park property, and I will not engage in any conduct that is either likely to be or is intended to be harmful to other persons or their property.

• I will not keep on my person any telephones, electronics, keys, jewelry, lanyards, or other objects which can reasonably be expected to cause harm to others while using the facilities.

• I will not consume outside prepared foods in the Park and will not chew

gum or eat or drink while in an activity. I will wear appropriate active wear clothing (including socks) and will not wear any clothing containing obscene, profane, or offensive content.

I have read (or been explained) and understood all items contained in the Code of Conduct and agree on behalf of myself and the above named Child, to abide by them in all respects and at all times while at the JUMP KINGDOM facilities. I further agree that JUMP KINGDOM is not a guarantor of safety and does not assume supervisory responsibility for my child. I agree that it is my responsibility to supervise and control my children and myself.

Waiver of Liability Relating to Coronavirus/

COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is

evolving, but the virus is believed to spread from person- to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People, including those who have received full doses of vaccines, reportedly can be infected and show no symptoms and therefore spread the disease. Evidence has shown that

COVID-19 can cause serious and

potentially life threatening illness and even death. As such, I agree to follow the most current guidance of the CDC to limit or prevent the spread of COVID-19 and to

follow all preventative measures put in place by JUMPKINGDOM, LLC.

While reasonable efforts can be taken to mitigate the risk of exposure to COVID-19, JUMPKINGDOM, LLC cannot prevent you or the above named Child from becoming exposed to, contracting, or spreading COVID-19 while utilizing JUMP KINGDOM services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize JUMP KINGDOM services and/or enter onto JUMP KINGDOM premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

ASSUMPTION OF RISK: I have read and

understood the above warning concerning COVID-19. I, on behalf of myself and the above named Child hereby choose to accept the risk of contracting COVID-19 for myself and/or the above named Child in order to utilize JUMP KINGDOM services and enter JUMP KINGDOM premises. These services are of such value to me [and/or to the above named Child] that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize JUMP KINGDOM services and

premises

WAIVER OF LAWSUIT/LIABILITY: I, on behalf of myself and the above named Child, hereby forever release and waive my right to all lawsuits, claims, demands and damages of any type or nature against JUMP KINGDOM and its owners, officers,

directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing JUMP KINGDOM services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss now or in the future, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or

unforeseen.

Severability Clause

If any provision of this Agreement is held

illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this Agreement shall remain operative and binding on the Parties.

Choice of Law/Venue

This Agreement and the rights of the Parties hereunder shall be governed by and construed in accordance with the laws of the State of Maryland including all matters of construction, validity, performance, and enforcement and without giving effect to the principles of conflict of laws. Any action brought by any party hereto shall be brought in the Circuit Court for Baltimore County, Maryland or if such jurisdiction exists, in the United

States District Court for the Northern District of Maryland, Baltimore Division.

PARENT/GUARDIAN CONSENT

I HAVE READ AND UNDERSTAND THE

TERMS OF THIS AGREEMENT, INCLUDING THE WAIVER, ASSUMPTION OF RISK, AND

INDEMNIFICATION PROVISIONS, AND I

UNCONDITIONALLY AGREE TO ALL OF ITS

TERMS. I UNDERSTAND THAT BY SIGNING

THIS DOCUMENT, I AM GIVING UP

CERTAIN LEGAL RIGHTS AGAINST JUMP

KINGDOM FOR MYSELF AND

PARTICIPANT, ON WHOSE BEHALF I AM

SIGNING. I HAVE HAD SUFFICIENT

OPPORTUNITY TO READ THIS DOCUMENT

AND VOLUNTARILY AND WITHOUT

INDUCEMENT AGREE TO SIGN IT IN

AGREEMENT WITH ITS TERMS.

I AGREE THAT AS PARENT OR GUARDIAN

FOR PARTICIPANT, I WILL SUPERVISE

PARTICIPANT AND ENSURE THAT

PARTICIPANT FOLLOWS THE CODE OF

CONDUCT AND ALL RULES AND

INSTRUCTIONS OF PARK PERSONNEL

WHILE PARTICIPANT IS ON THE JUMP

KINGDOM PROPERTY, AND I AGREE TO

INDEMNIFY PARTICIPANT AND JUMP

KINGDOM FOR ANY DAMAGES OR

INJURIES PARTICIPANT MAY CAUSE. I

AGREE THAT ALL TERMS,

REPRESENTATIONS, WARRANTIES,

PROMISES, AGREEMENTS, WAIVERS, AND

ACCEPTANCES SET FORTH HEREIN

APPLY FULLY TO ME, AS IF I WAS THE

PARTICIPANT, INCLUDING THE

ASSUMPTION OF RISK, WAIVER OF

CLAIMS, MEDIAL AUTHORIZATIONS, AND

INDEMNITY PROVISIONS, WHICH ARE

MATERIAL CLAUSES OF THIS

AGREEMENT. I HAVE HAD SUFFICIENT

OPPORTUNITY TO READ THIS DOCUMENT

AND VOLUNTARILY AND WITHOUT

INDUCEMENT AGREE TO SIGN IT IN

AGREEMENT WITH ITS TERMS.
