RELEASE FORM FOR ENTRANCE ONTO THE BALLONA WETLANDS

In consideration of your participating in a tour, volunteer activity and/or otherwise visiting all or part of the fresh water marsh, salt marsh and dunes area generally known as the Ballona Wetlands and their surrounds (the “Property”), and by signing this agreement, you confirm each of the following conditions:

1. You hereby assume all risks associated with your activities at the Property. Accordingly, you release the State of California, Friends of Ballona Wetlands, any grant providers and project funding entities, any invitees of the State of California which may be responsible for the conditions of the Property, and any and all of their respective officers, directors, employees, agents, members, shareholders, contractors, subcontractors and consultants (“Released Parties”) from any and all liability. You acknowledge that the Property may include areas that are slippery or have uneven surfaces. You agree to take all necessary precautions while on or about the Property to avoid injury to yourself or others. You acknowledge that you are physically able to undertake the activities contemplated on the Property.

2. You hereby release the Released Parties from any and all liability, claims, causes of action, damage, loss, casualty, expense, or similar items you may suffer or incur while on the Property. By signing this letter, you hereby exempt and release all Released Parties from all liability or responsibility whatsoever for personal injury, property damage, or wrongful death, however caused, including negligence of the Released Parties, whether passive or active.

3. You hereby agree to indemnify and hold the Released Parties harmless in all respects from any and all claims, causes of action, judgments, costs, expenses, attorney’s fees, and liabilities, whatsoever, arising in any way in connection with your activities at the Property.

4. You hereby grant Friends of Ballona Wetlands and its authorized representatives permission to record through still or digital photography and/or video, pictures, videos and/or other media of your participation or, (in the event that your child is the participant), your child’s participation, in the tour/volunteer activity carried out on the Property. You agree that any or all of the materials captured on video and/or photographed may be used, in any form, as part of any future publications, newsletter, website or other printed or digital materials used to promote the Property, and further that such use shall be without payment of fees, royalties, special credit or other compensation to you.

5. I am aware of the COVID-19 pandemic and the related governmental orders, directives and guidelines. I agree to comply with applicable public health COVID-19 safety guidelines while participating in Friends of Ballona Wetlands event(s). I am aware that these activities are occurring in a public location during the COVID-19 pandemic. I am voluntarily participating in these activities with the knowledge of the danger involved and agree to assume any and all risk.

The above is agreed to from this date of April 27, 2024 through December 31st, 2024.
