GRIDZONE ACTIVITY WAIVER & RELEASE

PLEASE READ CAREFULLY BEFORE SIGNING

1) PARTICIPATION & ACKNOWLEDGMENTS 

I understand that visiting and participating at GridZone (the “Facility”) may include use of sim racing equipment, racing simulators, golf simulators, gaming equipment, seating systems, motion platforms, controllers, screens, furniture, and related activities (collectively, the “Activities”). 

I agree to follow all posted rules, safety briefings, and staff instructions.


2) HEALTH & SAFETY NOTICE

I confirm I am physically able to participate. I understand I should not participate if I am pregnant or have medical conditions that may be aggravated by motion or exertion (including heart conditions, seizure disorders, vertigo, motion sensitivity), or if I am impaired by alcohol/drugs. 

I agree to stop immediately and notify staff if I feel dizzy, nauseated, in pain, or unwell. I assume responsibility for my own medical expenses.

3) ASSUMPTION OF RISK

I understand the Activities involve inherent risks, including but not limited to: physical exertion, motion, sudden movements, equipment malfunction, tripping/slipping/falls, collision with equipment, eye strain, motion sickness, dizziness, nausea, muscle strain, and other physical or emotional injury. 

I voluntarily assume all risks, known or unknown, to the fullest extent permitted by law.

4) RELEASE & WAIVER OF LIABILITY

In consideration of being allowed to participate, I release, waive, discharge, and covenant not to sue GridZone and its owners, officers, employees, contractors, agents, and affiliates (“Released Parties”) from any and all claims or liability arising out of or related to my participation in the Activities, including claims based on the ordinary negligence of the Released Parties, to the fullest extent permitted by Oregon law.

5) INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) my participation, (b) my conduct, or (c) my breach of this agreement, to the fullest extent permitted by Oregon law.

6) RESPONSIBILITY FOR DAMAGE

I agree to use the facility and equipment responsibly. If my intentional, reckless, or negligent actions cause damage beyond ordinary wear and tear, I agree to pay the reasonable cost of repair or replacement.

7) REMOVAL WITHOUT REFUND

GridZone may remove me for unsafe behavior, rule violations, or failure to follow staff instructions. In such cases, no refund or credit will be issued.

8) MINORS

If signing for a minor, I certify I am the parent/legal guardian, consent to the minor’s participation, and agree this waiver applies to the minor. I further agree to release and indemnify the Released Parties from claims brought by or on behalf of the minor, to the fullest extent permitted by Oregon law.

9) PHOTO/VIDEO (PROMOTIONAL)

Photos/video may be taken at GridZone. GridZone may use non-identifiable images/footage for promotional, marketing, or educational purposes without compensation. Any promotional use where my face is clearly identifiable requires my separate, explicit consent.

10) SECURITY CAMERA NOTICE

GridZone uses continuous video recording for safety, security, loss prevention, and operations. By entering, I consent to being recorded. These recordings are not used for marketing and are retained in accordance with company policy and applicable law.

11) PERSONAL PROPERTY

I understand GridZone is not responsible for loss, theft, or damage to personal property.

12) SEVERABILITY

If any part of this agreement is found unenforceable, the remaining provisions will continue in full force and effect.

ACKNOWLEDGMENT & SIGNATURE

By signing, I acknowledge I have read and understand this agreement and sign voluntarily.

I am at least 18 years old and signing for myself, OR I am the parent/legal guardian signing for a participant under 18.

Minimum ages: Golf simulator bay use 10+; Racing simulators/motion platforms 14+.

Participants under 18 must be accompanied by and actively supervised by a parent/legal guardian at all times.
