Participant Waiver, Release of Liability & Assumption of Risk

Please Read Carefully Before Participating

Second Shot Disc Golf is committed to providing a safe and enjoyable environment for customers, guests, and participants. However, participation in disc golf activities, including use of the HYZR disc golf simulator, indoor putting areas, practice areas, and related equipment, involves inherent and foreseeable risks.

By signing this agreement, I acknowledge those risks and voluntarily agree to the terms below.

Acknowledgment of Activities

I understand that activities at Second Shot Disc Golf may include, but are not limited to:

• Throwing, putting, or otherwise handling disc golf discs;

• Using the HYZR disc golf simulator and associated equipment;

• Participating in indoor putting, practice, games, leagues, competitions, demonstrations, or instruction;

• Walking or standing in areas where discs may be actively thrown;

• Using or being near electronic equipment, nets, screens, baskets, fixtures, furniture, flooring, and other facility equipment; and

• Observing or accompanying other participants engaged in these activities.

Acknowledgment and Assumption of Risk

I understand that participation in these activities involves inherent and other risks that cannot be completely eliminated.

These risks may include, but are not limited to:

• Being struck by a thrown or deflected disc;

• Accidentally striking another participant, employee, guest, spectator, wall, fixture, screen, basket, or other object with a disc;

• Slipping, tripping, falling, or colliding with people, furniture, equipment, flooring, or other objects;

• Muscle strains, sprains, overexertion, or other injuries associated with throwing, putting, bending, twisting, walking, or repetitive movement;

• Injury resulting from misuse, malfunction, movement, or failure of simulator or facility equipment; • Injuries caused by the actions or inattention of other participants or guests; and

• Damage to personal property.

I voluntarily choose to participate in or be present for these activities and knowingly assume the ordinary and inherent risks associated with them.

Participant Responsibilities and Safety Rules

I agree to:

• Follow all posted rules, warnings, and instructions provided by Second Shot Disc Golf personnel;

• Throw discs only when the designated throwing area and intended flight path are clear;

• Remain aware of other participants, spectators, employees, and guests;

• Use the HYZR simulator, putting areas, baskets, discs, and other equipment only for their intended purposes;

• Refrain from reckless, dangerous, or intentionally unsafe behavior;

• Immediately stop using equipment that appears damaged or unsafe and notify a Second Shot Disc Golf employee; and

• Accept responsibility for damage caused by my intentional, reckless, or improper use of Second Shot Disc Golf property or equipment.

Second Shot Disc Golf reserves the right to stop any activity or remove any participant whose conduct creates an unreasonable risk to themselves or others.

Medical Condition and Fitness to Participate

I acknowledge that I am responsible for determining whether I am physically capable of participating safely.

I understand that Second Shot Disc Golf does not provide medical advice or determine whether I am medically fit to participate.

I agree not to participate if I am aware of a medical condition, injury, impairment, or other circumstance that would make participation unsafe.

Medical Treatment Authorization

In the event of an injury or medical emergency, I authorize Second Shot Disc Golf personnel to contact emergency medical services and seek reasonable emergency assistance on my behalf if circumstances warrant.

I understand that Second Shot Disc Golf does not assume responsibility for medical expenses incurred as a result of my participation and that I remain responsible for any resulting medical costs.

Release and Waiver of Liability

To the fullest extent permitted by Mississippi law, I voluntarily release, waive, and hold harmless Second Shot Disc Golf, its owners, members, officers, managers, employees, agents, contractors, volunteers, affiliates, landlords, and equipment providers from claims for personal injury, property damage, or other loss arising from the ordinary and inherent risks associated with my voluntary participation in or presence around Second Shot Disc Golf activities.

This release is intended to include claims arising from ordinary negligence to the extent such claims may lawfully be released under Mississippi law.

This agreement does not release any party from liability that cannot legally be waived, including liability resulting from gross negligence, reckless conduct, or intentional misconduct where prohibited by law.

Personal Property

I understand that I am responsible for my personal belongings while at Second Shot Disc Golf.

Second Shot Disc Golf is not responsible for lost, stolen, misplaced, or damaged personal property except to the extent required by law.

Participant Agreement

By signing below, I acknowledge that:

• I have carefully read this Participant Waiver, Release of Liability & Assumption of Risk;

• I understand its contents;

• I understand that I am giving up certain legal rights to the extent permitted by law;

• I have had the opportunity to ask questions before signing;

• I am signing voluntarily and without coercion; and

• I agree to comply with Second Shot Disc Golf's safety rules and instructions.

Parent/Legal Guardian Consent

Required for Participants Under 18 Years of Age

I represent that I am the parent or legal guardian of the minor participant identified above and have legal authority to provide this consent.

I have read and understand this Participant Waiver, Release of Liability & Assumption of Risk. I consent to the minor's participation in activities at Second Shot Disc Golf, including use of the HYZR simulator, indoor putting areas, practice areas, and related equipment.

I acknowledge the risks described in this agreement and agree to its terms on behalf of myself and, to the extent permitted by applicable law, the minor participant.

I agree to instruct the minor to follow all Second Shot Disc Golf safety rules and employee instructions.
