JET SKI WAIVER AND RELEASE OF LIABILITY,

ASSUMPTION OF RISK AND INDEMNITY


CATAÑO WATERSPORTS RENTAL WAIVER AND RELEASE OF LIABILITY


A rental contract and release of liability, waiver of claims, assumption of risks, and indemnity agreement must be signed by the renter. A valid credit card, photo ID, and full payment of the rental total are required on the date of booking. Renters are responsible for all physical damage to equipment. Charges for damages start at $500 and may increase depending on severity.

In consideration for being allowed to participate in the recreational activity of jet ski at Cataño WaterSports, the above-named guest—and the guest’s parent or guardian if the guest is a minor—hereby: (i) acknowledges the inherent dangers and assumes all risks associated with participation in the activity; and (ii) expressly and forever waives and releases any claims, proceedings, or actions for personal injury, death, or any loss or damage whatsoever (the “damages”) that may arise out of or in connection with the guest’s participation in the activity. The guest further agrees to release and hold harmless Cataño WaterSports, along with its affiliates, parent and subsidiary entities, shareholders, officers, directors, agents, employees, predecessors, successors, heirs, and assigns, from any liability related to such participation. Guest also accepts financial responsibility for the loss of or damage to any equipment used by guest. Guest further accepts that the activities are provided by Cataño WaterSports Rentals** or its agents and that any controversy arising in connection with this Waiver and Release or the participation by the guest in the Activities shall be governed by Puerto Rico law and shall be adjudicated in the appropriate forum located in Puerto Rico.

NOTICE: By executing this WAIVER AND RELEASE, Guest agrees to abide by all the rules relating to the activities, and Guest acknowledges that Guest may be relinquishing valuable legal rights. Execution of this form shall be conclusive evidence that Guest has read and understands this form in its entirety and intends to be bound by its terms and conditions.

 

AGE AND ELIGIBILITY REQUIREMENTS

Guest is 18 years of age or older; Guest represents that Guest is in good physical condition and knows of no reason why he or she should not participate in Guest’s chosen Activities. Only guests 18 years old or over may operate jet ski with the companion of another adult. Children may not operate jet skis and may only ride as passengers if they are 12 years old or older. The renters must provide a Photo ID and confirmation email. Any other participants must be a minimum of 18 years of age and must be listed on the rental agreement.

 

RENTAL POLICY

2.     DAMAGE DEPOSIT: Every unit will undergo an inspection before and after your rental. The renter must be present at the time of inspection. Renters are responsible for all damages sustained to rental equipment, persons, or property during the rental period. A rental contract and release of liability, waiver of claims, assumption of risks, and indemnity agreement must be signed by the renter. The cardholder must be present to sign a waiver and rental agreement. The renter is responsible for any damage during the rental duration. Renters are responsible for all physical damage to equipment billed at $100 per inch.

3.     PICK UP/DROP OFF: Please arrive at least 30 minutes before your booking time. Rental pick-up time commences 15 minutes before your booking time. All rentals must be returned by the end time of your booking and the date stated on the contract. Failure to do so may result in additional charges.

4.     CANCELLATION POLICY: Renters may cancel their booking on the following conditions:

a.     If renting for 3 hours or less, cancellations can be made at least 24 hours before the start time with a full refund.

b. Full-day/weekend/holiday rental cancellations can be made a week before booking with a full refund.

c.  Date change requests are subject to availability. We reserve the right to cancel any jet ski rentals due to weather conditions that prevent safe operation of the watercraft or compromise the client’s safety.

 

WAIVER AND RELEASE OF LIABILITY

Jet skiing and activities around the water have many risks and dangers. There are risks of collisions, falls, injuries of the spine, arms, and legs, pinching, drowning, and death that can arise from the negligence of others, your negligence, weather conditions, acts of God, water conditions, and your own experience and abilities.

 

ACKNOWLEDGMENT OF RISKS

I/We acknowledge that the following lists of hazards describe some but not all the potential risks or injuries while jet skiing. Changing water depth, currents, wave height and direction, changing weather, wind, lightning, motion sickness, collision with objects in the water, other watercraft, docks & shore walls. Injuries from falls, strain on joints, neck, or spine from the pounding of waves or collisions. Injuries from capsizing, hypothermia, exposure to water and sun, or falling in or from the boat.

Risks can be reduced or influenced by the operator’s condition, experience, tiredness, coordination, balance, disability, focus, and group size. If an operator at any time feels that conditions of the environment have become a hazard to the safe operation, they will return to port immediately and call Cataño Watersports.

ASSUMPTION OF RISK AND RESPONSIBILITY

I/We agree to assume responsibility for all risks including those listed and others not identified. My participation in the activity is voluntary. All participants in my party have been made aware of the risks and I will be responsible for them. I am not impaired by alcohol or drugs and I do not have any disability or condition that may impair my safe operation on and around the water. We understand that at the total discretion of Cataño Watersports this rental agreement can be terminated when and if there is a question as to the competency or condition of the operator or when weather conditions prevent the safe operation of the watercraft. I/We understand that any film, video, photo or image of me/us while operating the rental watercraft may be used for promotional or social media purposes.

RELEASE OF LIABILITY

In consideration for the services provided by Cataño Watersports** in the rental of a jet ski, I/We for myself and any minor children for which I am parent or guardian and any guests that I may be entertaining, or any representative or heir agree that Cataño Watersports** shall have no liability for any injury, death, or damage however caused by operation of the watercraft. I/We release and discharge Cataño Watersports** and its insurer for any damages or injuries however caused.

I/We have read the warnings, acknowledgment of risks, assumption of risks, and release of liability. I understand that by signing this document I/We may be waiving our legal rights.
