Review MiniTown Café & Play LLC Privacy Policy

PARTICIPANT WAIVER AND RELEASE OF LIABILITY

In consideration of the services provided by MiniTown Café & Play ("the Café") and of the permission granted by the Café to use the Café's property, facilities and services and to participate in the activities, at the Café (the "Activities"), I, on behalf of myself and on behalf of my child(ren) and any other minors within my care as listed below ("Minors"), agree to the following terms and conditions.

I understand that this document affects my legal rights and the legal rights of the Minors, and that by signing below I acknowledge that I have read and understood the disclosure of risks, voluntarily accept those risks, and agree to be bound by all terms and conditions of this agreement. This Agreement is effective on the date signed by the releasing party.

1. Acknowledgment and Assumption of Risk

I, the undersigned, acknowledge that participation in activities at the Café involves inherent risks, including but not limited to physical injury, defects in the Café’s equipment that result in harm to the participant, illness, and/or property damage. I understand these risks and voluntarily assume full responsibility for all risks of loss, damage, or injury that may be sustained by the participant or property owned by me.

2. Release and Waiver of Liability

In consideration of being allowed to participate in activities at the Café, I hereby release, waive, discharge, and hold harmless the Café, its owners, employees, agents, or representatives (hereinafter referred to as “Releasees”) from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by the participant or property owned by me while participating in activities, or while on the premises.

3. Indemnification

I agree to indemnify and hold harmless the Releasees from all loss, liability, damage, or costs they may incur due to participation in activities at the Café, whether caused by the negligence of Releasees or otherwise.

4. Medical Authorization

I authorize the Café to obtain medical treatment for the participant in the event of an emergency. I understand that I am responsible for any medical expenses incurred.

5. Compliance with Rules and Regulations

I agree that the participant will comply with all stated and customary terms, posted safety signs, rules, and verbal instructions as conditions precedent for participation in any activity at the Café

6. Media Release

I grant permission to the Café to use photographs, videos, or other recordings of the participant for promotional purposes without compensation.

7. Supervision

I understand that the Café provides a safe environment for children, but supervision of my child(ren) is ultimately my responsibility. I agree to remain on-site and monitor my child(ren) during play.

8. COVID-19 and Other Illnesses

I acknowledge that there is an inherent risk of exposure to illnesses, including but not limited to COVID-19, in any public space. I agree that the Café is not responsible for any illness that my child(ren) may contract during their visit.

9. Behavior and Conduct

I agree that I and my child(ren) will act respectfully toward other guests and the Café property. Failure to do so may result in the termination of access without a refund and liability for all damage caused. The Café reserves the right to seek legal action to recover any damages caused due to your negligent, reckless, or willful conduct.

10. Personal Belongings

I understand that the Café is not responsible for any personal items that may be lost, stolen, or damaged while on the premises.

11. Parental or Legal Guardian Consent

I certify that I am the parent or legal guardian of the participant(s) and have the authority to consent to this waiver on their behalf.

12. Agreement to Follow Rules

I agree to follow all posted rules and instructions from the Café’s staff to ensure the safety of my child(ren) and others.

13. Certifications.

In order to assist the Café in effectively providing for the safety of me and the Minors, I certify that:

• I have no knowledge of any health problems that would cause participation in the Activities to negatively impact my health or the health of the Minors

• I and the Minors possess a sufficient level of physical fitness and skill to safely participate in the Activities, and neither I nor the Minors have any pre-existing emotional, mental, physical or medical conditions that might be impacted or worsened by use of the Café, including pregnancy, orthopedic problems, including back problems, heart problems, neurological problems or breathing problems.

• I will not use or allow the Minors to use the Café while any of us are under the influence of any drugs, alcohol or medications that may impair our physical activities or judgment

• I agree to follow (and cause the Minors to follow) all safety rules of the Café and to alert the Café’s staff to any rules violations or dangerous behavior of other participants

• I understand that my failure or refusal to abide by the safety rules of the Park or by instructions and directions of Café’s staff can lead to the immediate revocation of my right to use the Café, without any right to refund of any payments made and liability for any damage that I and/or the Minors caused.

• I will notify the Café’s staff before I or the Minors participate in Activities if any of us have been diagnosed with behavior disorders or are taking any behavior modification medications that may impair my or the Minors’ participation in Activities

• I will inform the Café’s staff immediately if I or the Minors feel any unusual discomfort while participating in the Activities and will immediately stop (or cause the Minors to stop) participation in the Activities

• I am aware that Café’s staff may need to end my or the Minors' participation in the Activities if my or the Minors' actions present a danger to myself or others

• I authorize the Café’s staff to administer emergency first aid and CPR to myself and to the Minors when deemed necessary by the Park staff

• I authorize the Café’s staff to secure emergency medical care or transportation if deemed necessary by Park staff, and I agree to assume all costs of emergency medical care or transportation.

• I acknowledge that the Café encourages each participant to obtain medical clearance prior to participating in the Activities.

• I have adequate insurance to cover any injury or damage I and the Minors may cause or suffer while participating in the Activities, or if not, I agree to bear the costs of such injury or damage to myself, the Minors and others.

14. Modification Clause

I understand that the Café reserves the right to update this waiver periodically. The latest version will apply to all subsequent visits.

15. Governing Law

This waiver shall be governed by the laws of the State of Connecticut. If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.

16. Acknowledgment of Understanding

I have read this waiver of liability and fully understand its terms. I understand that I am giving up substantial rights, including the right to sue and could be held liable if my conduct results in damage to the Café’s property. I acknowledge that I am signing the agreement freely and voluntarily and intend by my signature to provide a complete and unconditional release of all liability to the greatest extent allowed by law.

17. Age Misrepresentation Liability Clause

The undersigned affirms that all information provided on this waiver, including the age of the participating child(ren), is true and accurate to the best of their knowledge. In the event that a participant’s age has been knowingly misrepresented, and such misrepresentation results in injury to the participant, another child, or any individual within the premises, the undersigned shall assume full legal and financial responsibility for any damages or claims arising from the incident. Minitown Café & Play shall be held harmless from any liability stemming from false or misleading information provided by the parent or guardian.

18. Non-Slip Socks Policy Clause

For the safety of all children, non-slip socks are required at all times within the play area. Participants without proper non-slip footwear will not be permitted to enter the play space until such socks are worn. Non-slip socks are available for purchase on-site. This policy is strictly enforced to reduce the risk of slips, falls, and related injuries. In the event of any incident, accident, or injury caused directly or indirectly by the absence of proper non-slip socks, Minitown Café & Play shall bear no liability or responsibility. Parents and guardians assume full responsibility for ensuring compliance with this requirement.
