This agreement applies to hands-on resin classes, workshops, private parties, group events, and approved hands-on portions of custom projects conducted by Island Wide Resins. This agreement covers every Island Wide Resins activity I take part in for 12 months from the date I sign, including activities that are different from my first visit.

Location: Island Wide Resins, Kailua-Kona, Hawaii

By signing below, I agree to the following:

1. Voluntary Participation

I am voluntarily participating in Island Wide Resins activities. I represent that I am physically and mentally able to participate. Before beginning, I will notify the instructor or staff of any known allergy, sensitivity, breathing condition, skin condition, injury, medical condition, or other concern that may affect my safe participation.

2. Nature of the Activity

The activity may involve design consultation, selecting materials and colors, planning layouts, measuring with staff assistance, mixing, pouring, spreading, decorating, moving, and curing resin and related materials in a ventilated indoor studio setting. Activities may involve pigments, alcohol inks, additives, silicone molds, cups, stir sticks, protective gloves, tables, stools, extension cords, and other art or studio equipment. Custom projects may include using handheld sanders with staff approval. Participants do not operate saws, routers, CNC machines, or other cutting equipment, but staff may operate this equipment nearby.

3. Acknowledgment of Risks

I understand that resin work and presence in a working studio involve inherent risks. These may include exposure to fumes, vapors, dust, and odors; respiratory irritation; skin irritation; allergic response; eye irritation; splashes; burns; cuts; slips, trips, and falls; damage to clothing or personal items; and injury arising from heated equipment, studio surfaces, movement within the studio, or the actions of other participants; and sanding dust, flying debris, noise, and vibration from sanders, along with flying debris, dust, and noise from equipment operated by staff nearby.

4. Ventilated Studio Acknowledgment

I understand that Island Wide Resins uses a ventilated indoor workspace and may use open-air flow, fans, open doors or windows, or other ventilation measures intended to improve air circulation. I understand that ventilation reduces risk but does not eliminate all exposure or all possible health effects associated with resin materials or related products.

5. Assumption of Risk

I knowingly and voluntarily assume all known and unknown risks related to my participation and presence in the studio, including risks associated with resin materials, ventilation conditions, studio surfaces, shared tools, and the actions of other participants.

6. Agreement to Follow Safety Rules

I agree to follow all instructor directions and studio safety rules, including directions about gloves, eye protection, respirators or masks if required, no food or drink in work areas, spill response, cleanup, waste disposal, and instructions about entering, exiting, or remaining away from curing or active work areas. I agree to stop participating immediately and notify staff if I feel dizzy, lightheaded, short of breath, nauseated, unwell, or otherwise unsafe.

7. Release of Liability

In consideration of being allowed to participate, I release, waive, and discharge Island Wide Resins and its owners, members, managers, instructors, assistants, employees, contractors, volunteers, landlords, and agents (collectively, the “Released Parties”) from any and all claims, demands, damages, causes of action, losses, liabilities, costs, or expenses arising out of or related to my participation or presence in the studio, including claims for personal injury, illness, allergic response, property damage, or wrongful death, to the fullest extent allowed by law.

8. Medical Care and Costs

I understand that Island Wide Resins does not provide health or accident insurance for participants. I am responsible for my personal medical expenses arising from participation. If emergency care is considered reasonably necessary, I authorize emergency response and accept responsibility for associated costs.

9. Personal Property and Clothing

I understand that resin and pigments can permanently stain or damage clothing, shoes, jewelry, phones, bags, and other personal items. I accept responsibility for protecting personal property brought into the studio.

10. Indemnity

I agree to indemnify and hold harmless the Released Parties from claims, liabilities, damages, or expenses arising out of my own negligent, reckless, or intentional acts or omissions during the activity or while on the premises.

11. Photo and Video Consent

By participating, I agree that Island Wide Resins may photograph or record me, and any minor I sign for, during the activity and use those images or recordings on its website, social media, advertising, and other promotional materials without compensation. If I would like a specific photo or video removed, I may contact Island Wide Resins and it will be taken down on request.

12. Severability and Governing Law

If any part of this agreement is held unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. This agreement is governed by the laws of the State of Hawaii.

13. Acknowledgment

I state that I have read this agreement carefully, understand it, understand that legal rights may be affected by signing it, and sign it freely and voluntarily.

  • Wear eye protection when directed by staff, especially during mixing, heating, or splash-risk activities.
  • Wear a respirator or other face protection if directed by staff or if ventilation conditions require it.
  • Do not eat, drink, smoke, or apply lip products in the work area.
  • Keep long hair secured and avoid loose sleeves or jewelry near heat sources, wet resin, or active work areas.
  • Report spills, splashes, broken items, dizziness, headache, breathing discomfort, skin irritation, or other problems immediately.
  • Do not touch your face, eyes, or phone with contaminated gloves.
  • Wash hands thoroughly after removing gloves and before leaving the work area.
