Bouncy Castles Toronto Rental Agreement, Waiver & Release of Liability
By signing this agreement, the customer confirms that they are 18 years of age or older and accepts full responsibility for the rental equipment during the rental period. Ownership of EquipmentAll rental equipment remains the property of Bouncy Castles Toronto at all times. The customer agrees not to move, loan, sublet, transfer, alter or use the equipment at any location other than the approved setup location. Responsibility During RentalOnce the equipment has been delivered and set up, the customer is responsible for the safe use, supervision and care of the equipment until it is picked up by Bouncy Castles Toronto. The customer agrees to follow all safety rules, posted instructions, weight limits, age limits and operating guidelines for the specific inflatable or equipment rented. Release of LiabilityThe customer understands that inflatable equipment involves risk of injury. The customer voluntarily assumes all risks related to the use of the rental equipment. The customer agrees to release, waive, indemnify, defend and hold harmless Bouncy Castles Toronto, its owners, employees, contractors and representatives from any and all claims, injuries, damages, losses, costs or expenses arising from the use, misuse, supervision or possession of the rental equipment during the rental period, except where prohibited by law. Adult Supervision RequiredA responsible adult must supervise the inflatable at all times while it is in use. Children must not be left unattended. The supervising adult is responsible for controlling the number of participants, enforcing safety rules and stopping unsafe behavior immediately. The inflatable must not be used without adult supervision. Safety RulesThe customer agrees to enforce the following rules: - No shoes, glasses, jewelry, badges or sharp objects inside the inflatable.
- No food, drinks, gum or candy inside or near the inflatable.
- No silly string, face paint, party poppers, colored streamers, markers or similar products on or near the inflatable.
- No smoking, vaping, barbeques, fire, fireworks or open flames near the inflatable.
- No pets, toys, sticks, sharp objects or foreign items inside the inflatable.
- No flips, wrestling, pushing, rough play, climbing on walls, hanging from netting or sitting on inflatable walls.
- No bouncing on the entrance step or safety ramp.
- No use during inflation or deflation.
- No overcrowding.
- Users must follow the age, height and weight limits for the specific inflatable.
- Adults may not use children-only inflatables unless specifically approved by Bouncy Castles Toronto.
Health & Participant RestrictionsThe inflatable should not be used by anyone who is pregnant, under 3 years old, or has head, neck, back, muscular, skeletal, heart, balance or other medical conditions that may increase the risk of injury. The customer is responsible for ensuring that all participants are suitable to use the equipment safely. Weather & Unsafe ConditionsThe inflatable must not be used during unsafe weather conditions, including heavy rain, thunderstorms, lightning, strong winds or any condition that may make operation unsafe. If unsafe weather occurs during the rental, the customer must immediately stop use, remove all participants from the inflatable and turn off the blower if safe to do so. Bouncy Castles Toronto reserves the right to cancel, delay, reschedule or refuse setup if weather or site conditions are unsafe. Power SourceThe customer is responsible for providing a safe and functional power source. Bouncy Castles Toronto is not responsible for delays, malfunction, damage or inability to operate caused by insufficient power, faulty outlets, tripped breakers, extension cord issues or power outages. The electrical outlet must be in proper working condition and located within 100 feet of the setup area unless otherwise arranged. Setup Area & AccessThe customer is responsible for providing a safe, clean and accessible setup area. The setup area must be free of sharp objects, debris, animal waste, rocks, branches, sprinkler heads, underground hazards, overhead wires and any unsafe conditions. The customer is responsible for informing Bouncy Castles Toronto of any underground utilities, sprinkler systems, irrigation lines, water pipes, gas lines or other hidden hazards before setup. Bouncy Castles Toronto is not responsible for damage to underground systems or property when the setup location is chosen or approved by the customer. If access is limited, unsafe or different from what was described, Bouncy Castles Toronto may refuse setup, change the setup location or apply additional charges. Moving EquipmentThe customer must not move, reposition, deflate, disconnect or alter the equipment after setup unless instructed by Bouncy Castles Toronto. Damage, Cleaning & Replacement CostsThe customer agrees to return the equipment in the same condition it was received, except for normal use. The customer is responsible for any damage, excessive cleaning, loss, theft or misuse of the equipment during the rental period. A cleaning fee of $75.00 may apply if the inflatable is returned excessively dirty. If equipment is damaged beyond repair, lost or stolen, the customer agrees to pay the full replacement cost, including labor, parts and related expenses. Cancellation & Weather PolicyIf weather conditions do not allow safe setup or operation, Bouncy Castles Toronto will work with the customer to find a suitable alternative date when possible. Payments and credits are handled as follows: - Cancellation more than 7 days before the event: 100% credit for a future event, no refund.
- Cancellation within 7 days but more than 48 hours before the event: 50% credit for a future event, no refund.
- Cancellation within 48 hours of the event: no refund.
- Weather-related cancellation within 24 hours due to unsafe weather forecast: 100% credit for a future event, no refund.
Bouncy Castles Toronto monitors weather before the event and reserves the right to make the final decision regarding safe setup and operation.
