CUSTOMER RESPONSIBILITY


Customers and/or Users must be at least 18 years of age to purchase any item from TGR.  Customers and/or Users must be of legal age to own any items ordered.  Customers and/or Users must be at least 21 years of age if purchasing a handgun or ATF-defined “OTHER” firearm, (including, but not limited to, frames, pistol-grip shotguns, and stripped receivers) OR ammunition or ammunition components for use in handguns.  TGR may request a copy of your state identification, law enforcement credentials, or a firearm owner identification card (such as a FOID or FID), before shipping your order.  Customers and/or Users are responsible for checking all local laws before ordering or using any item from TGR.  Customers and/or Users are responsible for complying with all firearms laws in their area.  Customers and/or Users agree that if they purchase a firearm and do not have proper credentials to own it in their state or if the item is not state compliant, they will cover all shipping costs and return restocking fees.  Customers and/or Users are to notify us immediately should you have any concerns about the legality of any product you have ordered.  Any Customer making a purchase through us agrees to follow all manufacturing safety instructions and to only use the product(s) in a safe manner in an approved area for a legal purpose.  Customers and/or Users assume all responsibility for the legality of a specific item when you purchase it.  Customers and/or Users must provide a valid contact phone number and email address with any order placed.  TGR may contact you at the provided phone number and/or email address before processing any order.  Customers and/or Users are responsible for payment for all orders placed through this online system.  If you are not sure if you want an item, please do not order it.  When making a purchase from TGR, Customers and/or Users agree they are not prohibited by Federal or State law or local ordinance, from receiving firearms or ammunition, or ammunition components, of any kind.  Customers and/or Users agree they are the actual transferee/buyer of the firearm(s) being purchased.  Customers and/or Users agree they are not a fugitive from justice.  Customers and/or Users agree they are not an alien illegally in the United States.  Customers and/or Users agree they have never renounced United States citizenship.  Customers and/or Users agree they are not currently on Federal NICS or State agency DELAY/DENIED status regarding your most recent attempt to purchase a firearm.  Customers and/or Users agree they have not been convicted in any court of a felony, or any other crime, from which the judge could have imprisoned you for more than one year.  Customers and/or Users agree they are not under indictment for a felony, or any other crime that a judge could imprison them for.  Customers and/or Users agree they have not been convicted in any court of a misdemeanor crime of domestic violence.  Customers and/or Users agree they have not been discharged from the Armed Forces under dishonorable conditions.  Customers and/or Users agree they have never been adjudicated mentally defective or have not been committed to a mental institution.  Customers and/or Users agree they are not an unlawful user of, or addicted to, Marijuana, or any depressant, stimulant, narcotic drug, or any other controlled substance.  Customers and/or Users understand that cleaning, handling, or discharging firearms, ammunition or ammunition components may cause exposure to lead and they hold TGR harmless and assume all responsibility for any lead exposure.

WAIVER, RELEASE, ASSUMPTION OF RISK(S), AND INDEMNITY AGREEMENT


I, the undersigned, on behalf of myself, my heirs and assigns, hereby acknowledge that I have voluntarily applied to enter in to or on the premises, and to engage in  and/or observe shooting and other activities at Tap Rack Bang Indoor Shooting Range, LLC dba TGR, (TGR).  These activities include, but are not limited to, the use and discharge of firearms at TGR, the use and discharge of rental firearms provided by TGR, and the services and training by the owners, officers, directors, employees, agents, instructors, volunteers, representatives, licensees, and/or guests.

 

  1. I, the undersigned, agree that this Waiver and Release of Liability, Assumption of Risk(s), and Indemnity Agreement shall apply to each visit I make to Tap Rack Bang Indoor Shooting Range, LLC dba TGR, including any and all future visits, regardless of the date of expiration of the current period of membership stipulated by this membership agreement.  
  2.  I understand and acknowledge that there is risk involved in being in and around TGR’s facilities, including but not limited to the risks involved in shooting, coaching, observing, or training with firearms, and/or being in the vicinity of others that are engaged in such activity.  
  3.  I further acknowledge and understand that TGR is an indoor shooting facility which utilizes a series of component parts, including a bullet trap to decelerate discharged ammunition, however I understand that these component parts and bullet traps of TGR, do not, in every instance, contain bullets or bullet fragments and has been known to cause ricochets which could cause serious injury or damage to my personal belongings, myself, my family, my spouse, my guests or other visitors.  
  4.  Additionally, I acknowledge and understand that Tap Rack Bang Indoor Shooting Range, LLC or TGR makes no warranty as to the design, manufacture, condition, or fitness for any particular purpose of TGR facilities or equipment, including, but not limited to:  firearms, ammunition, eye/hearing protection, and first-aid supplies.  
  5.  In consideration of being allowed to use TGR’s facilities, I agree that I will assume the risk and full responsibility for any and all injuries, losses, loss of life, and or damages that might occur to me, my family, and/or my guests or property while on the premises of TGR, and, to the maximum extent allowed by the law, I agree to waive and release any and all claims, suits, or related causes of action against Tap Rack Bang Indoor Shooting Range, LLC; and their owners, officers, directors, employees, agents, instructors, volunteers, representatives, licensees, and/or guests, loss, death, costs, or damages to me, my heirs, or assigns, while on the premises of TGR. 
  6.  I further agree that I will indemnify, defend and hold TGR, owners, officers, directors, employees, agents, licensees, and/or guests harmless, to the maximum extent allowed by the law, from injury, loss, death, costs, or other damages to me, my heirs or assigns, or third parties for claims, suits, or related causes of action asserted against The Gun Rag arising from my conduct, my family’s conduct, and/or my guest’s conduct while on the premises of TGR, and this waiver shall bind the members of my family, my spouse or domestic partner, if I am alive, as well as my estate, family heirs, administration, personal representatives, or assigns if I am deceased, and shall be deemed as a “Release, Waiver, Discharge, and covenant” not to sue Tap Rack Bang Indoor Shooting Range, LLC or TGR. In addition, I agree to indemnify and hold harmless TGR from and against any and all claims, including any act or omission on the part of TGR,  its  owners, officers, directors, employees, agents, instructors, volunteers, representatives, licensees, and/or guests, against all costs, counsel fees, expenses, and liabilities incurred in and about such claims, investigations thereof of the defense of any action or proceeding brought thereon and from and against any orders, judgments and/or decrees which may be entered therein.  
  7.  It is understood that I am personally responsible for the safe handling and proper functioning of any firearm or munitions that I bring into/onto TGR facilities.  TGR has no responsibility to guarantee, verify, or approve the safety and functioning of these items. 
  8.  I further agree to release, indemnify, defend, and hold Tap Rack Bang Indoor Shooting Range, LLC or TGR harmless from any liability whatsoever for future claims presented by my children for any injuries, losses, or damages.  If any term of this waiver and release shall be found illegal, unenforceable, or in conflict with any applicable law, the validity of the remaining portions shall not be affected thereby.
  9.  I represent that I am experienced and skilled in the proper handling, loading, use and discharge of all firearms and ammunition I intend to use at TGR.  I understand that TGR is specifically relying on the truth of my representations concerning my experience with firearms, in permitting me to make use of TGR.  I represent that I have never been convicted of a felony in any of the 50 States, under the United States of America.  Texas law prohibits any person convicted of a felony to be present in any environment where firearms are present.  
  10.  I further state that I am of lawful age and legally competent to enter into this affirmation and release, and I understand the terms herein are contractual and not mere recital, and I have signed this document voluntarily and as my own free agent.  
  11.  In signing below, I agree to the above statements as well as assume personal risk of harm or injury that may occur as a result of participation in or observation of any and all activities taking place on TGR property. I hereby release Tap Rack Bang Indoor Shooting Range LLC dba TGR, and its  owners, officers, directors, employees, agents, instructors, volunteers, representatives, licensees, and/or guests, from any liability, cost and damages resulting from this individual’s participation. The participant agrees to reimburse TGR for any damage caused directly or indirectly to equipment and/or facility.
  12.  I further certify that I am not under the influence of alcohol or drugs and that it is legal for me to be in possession of a firearm.
  13.  I agree to abide by TGR’s Code of Conduct.
  14.  I agree to abide by TGR’s Club Rules and Policies.
  15.  I have carefully read this “Waiver, Release, Assumption of Risk(s), and Indemnity Agreement” and fully know its contents.  I acknowledge that no other inducement, assurance or guarantee has been made to me in consideration of my signing this Agreement which I sign voluntarily and of my own free will.  I further acknowledge and agree that this Agreement may be amended or modified only by a writing signed by me and by an authorized agent of TGR.
  16. There will be a $75.00 cable replacement fee for any person(s) who is found to have ignored TGR policies or has caused damage resulting in range cable(s) being broken as well as shooting a rifle caliber on the handgun range or vice versa.  Anyone who leaves without informing a staff member of TGR, of a shot cable(s), will incur an additional $25.00 fee. 

**If the participant is a minor**

 

I agree that the minor has my consent as his/her Parent, or Legal Guardian to participate in this activity or event.  I also give my consent for the business or organization to seek emergency treatment for the minor if necessary, and I agree to accept financial responsibility for the cost related to this emergency treatment.


Range Code of Conduct

  1.  Children must be at least thirteen (13) years old and be able to shoot over the bench in a safe manner, in the sole judgment of TGR personnel. 
  2. Minors under the age of eighteen (18), must be accompanied by a parent or legal guardian who will sign a waiver and remain by their side at all times in the range.
  3. Firearms will only be uncased or removed from the holster once you are in your assigned firing bay.  Load and unload all weapons within your assigned bay.
  4. It is your responsibility to know and understand how to operate your firearm safely and ensure your firearm is in good working order.
  5. Eye and Ear protection is mandatory for anyone entering the range.
  6. Always keep the firearm action open, magazines removed and only load when ready to commence firing.
  7. Always keep your finger off the trigger and outside the trigger guard until you are ready to commence fire. 
  8. Fire only when safe conditions exist:  all shooters must stand in their respective stall behind the bench.
  9. Always keep firearms pointed down range in a safe direction.
  10. Do not pass firearms directly from person to person.  Place the firearm on the bench and allow the next person to pick it up. 
  11. After you are assigned a lane, you are to remain in that lane and shoot only your target in that lane.
  12. Do not transfer uncased firearms from lane to lane.
  13. Use only TGR approved paper targets that are properly placed in front of the shooter stall.
  14. The following types of ammunition are not allowed to be shot at TGR:  Tracers, incendiary, steel cased/core or aluminum cased.  Brass/Nickel cased defensive ammunition is allowed.
  15. Any handgun caliber larger than .45 ACP or rifle chambered to 7.62 and above must be declared and approved by TGR staff prior to entering the range.
  16. Use only the correct ammunition for your firearm as recommended by the manufacturer.
  17. Any firearm not carried concealed, in accordance with all state and local laws, must be transported unloaded in a case or bag to or from the range.
  18. Shooters who desire to shoot from the holster must be “holster qualified” through one of TGR’s certified instructors.
  19. Upon the command “CEASE FIRE,” stop all shooting immediately, put down our firearm and back away from the firing line.  Shooters may not re-approach the firing line or pick up any firearm until a Range Safety Officer from TGR gives the “ALL CLEAR” signal.
  20. Never consume alcohol or take drugs before or while shooting.
  21. Food, drink, gum, or any tobacco product is not permitted inside the range.  Always remember to wash your hands after you leave the range prior to eating.
  22. If you observe any unsafe conditions, please report them to a Range Safety Officer immediately.  Act responsibly at all times.
  23. Any violation of the code of conduct may result in immediate removal from the range and forfeiture of Membership.

 

Range Policies and Rules

  1. All shooters must have a valid picture ID to enter the range.
  2. Range personnel have the right to inspect your firearms and ammunition at any time while in the facility.
  3. Firearms must be cased or holstered upon entering our facility and must stay at all times, except when in the bay at the firing line.
  4. When in the bay at the firing line, firearms must be pointed down range and fingers must be off the trigger until ready to shoot.
  5. Ear and eye protection must be worn at all times while inside the ranges.
  6. When there is a malfunction, place the firearm on the bench in the bay you are in and call for a Range Safety Officer.
  7. If a CEASE FIRE is called, STOP firing immediately, remove your finger from the trigger, keep the gun pointed down range, drop the magazine, lock your bolt and/or slide to the rear, and set the firearm on the bench in your bay.
  8. If someone is down range, call a Cease Fire and DO NOT HANDLE YOUR FIREARM.
  9. Make sure you are using the correct ammunition for your firearm.  If you aren’t sure, ask an RSO.
  10. Targets must be hung appropriately and in accordance to cardboard and/or RSO instruction, (i.e., BELOW LINES INDICATED ON THE CARDBOARD.)
  11. All ammunition used with our rental firearms must be purchased from our facility.
  12. Be sure your firearm is safe to operate and you know how to use it safely.
  13. After you are done shooting, POLICE YOUR BRASS, unload your firearm, and put it back in a case or holster before exiting the range. 
  14. Any shooter under the age of 18 must be accompanied by a parent/guardian at all times.
  15. No more than two persons are allowed in the bay at the firing line, with only one of them firing at one given time.  A third person may accompany them on the same lane; however, that third person must be behind the two on the firing line at any given time. 
  16.  NO ONE IS PERMITTED FORWARD OF THE FIRING LINE AT ANY GIVEN TIME.
  17.  When reloading, you may only pick up your brass behind the firing line.
  18.  Do not shoot anything in the range other than your target.  You will be subjected to permanent dismissal from the facility in addition to financial liability for any damages to equipment, (i.e., cable system.)
  19.  NEVER HAND A LOADED FIREARM TO ANOTHER PERSON.
  20.  Expecting mothers are not permitted inside the ranges at any given time due to potential harm to the unborn baby.
  21.  Persons under the influence of drugs and/or alcohol are not permitted on the property and will be banned. 
  22.  No drawing from the holster, quick draw shooting, shooting from the hip or rapid fire allowed, unless authorized by management.
  23.  Immediately report any unsafe activities or range violations to an RSO.
  24.  Any person who has engaged in and/or been convicted of criminal activity that would prohibit firearm possession is not permitted to use the range.  This includes felonies and misdemeanors.
  25.  Range personnel have the right to warn and expel anyone displaying unsafe and or suspicious behavior.  
  26. No steel, steel core, armor piercing, incendiary, tracer, bird shot, buck shot, rat shot, or snake shot ammunition.
  27.  No smoking is allowed at any time, anywhere inside the facility.
  28.  We suggest that you wash your hands after shooting at our facility.
  29.  No food or beverages are allowed inside the ranges.

 THERE WILL BE NO REFUNDS IF YOU ARE EJECTED FROM THE RANGE.
