Policies and Liability Waiver



412 Squash Association Policies

We look forward to welcoming you to the 412 Squash Center. To make your visit as seamless as possible, please review our policies below and acknowledge your agreement by signing at the bottom of this page. 


FACILITY POLICIES

Dress/Equipment Code:

  • Non-marking sneakers (no running shoes) must be worn at all times while on court. A fee may be charged for damage to courts due to improper footwear.
  • Protective eyewear is required while on court.
  • Players should wear athletic attire. White attire is not required.
  • Players should bring their own water bottle and towel if needed.
  • No outside exercise or practice equipment is permitted in the 412 Squash Center except that which is necessary to play squash (shoes, goggles, racket).

Guidelines for Players and Parents:

  • All players must have a reservation to enter our facilities and have filled out all required registration and waiver forms.
  • Players must vacate the 412 Squash Center after the end of their allocated time for clinics, lessons, or court rentals.
  • The 412 Squash Association has the right to revoke attendance at any clinic if a student is not in adherence with our policies.
  • Children under the age of 16 must be supervised by an adult at all times while inside the 412 Squash Center.
  • The 412 Squash Association reserves the right to invoke closed practices with no spectators if deemed necessary for specific programs, dates, and times.
  • Parents are not permitted to interrupt their child or other children’s lessons with questions for the instructors.
  • If a student is feeling under the weather and specifically experiencing a fever or contagious disease, please be considerate of others by keeping your child home from lessons for a minimum of 48 hours.
  • Outside food or beverage is not permitted in the 412 Squash Center.
  • Spectators are not permitted to use any other areas at 412 East 90th Street other than the 412 Squash Center. They are also required to enter and exit the building as directed by the Campus Safety team on premises.


MEMBERSHIP POLICIES

Membership Privileges:

  • Access to 9 squash court facility.
  • Access and ability to book private lessons with our team of qualified and experienced coaches.
  • Access and ability to book court rentals.
  • Ability to bring non-member guests to court rentals.


General Member Policies:

  • Memberships are sold on a monthly-recurring or annual-recurring basis.
  • Memberships are required for participation in clinics, lessons, and court rentals.
  • Memberships are non-transferable and take effect on the date of purchase.
  • Once purchased, members may not pause their membership.
  • Memberships are nonrefundable. Partial or prorated refunds will not be honored for canceled memberships.
  • Memberships automatically renew. If you choose to cancel your membership, you need to notify the 412 Squash Association by emailing us at INFO@412squash.org and requesting cancellation/termination in writing at least 30 days in advance of cancellation.
  • A member may upgrade their membership to a more expensive category of membership and pay the difference in price.
  • The 412 Squash Association has the right to revoke membership if a member is not adhering to our facility policies and code of conduct.


GUESTS, NON-MEMBER SESSIONS AND OUT OF TOWN VISITOR POLICIES

  • Members may bring a non-member guest for court rentals.
  • Members receive one free guest pass per month. Members will be charged $35 for each additional guest. Members may play with other members for no additional fee.
  • Guests must be accompanied by their hosting member at all times while in the 412 Squash Center. 
  • Non-members must download the 412 Squash app, create a profile, and sign the liability waiver prior to arriving at the 412 Squash Center.
  • Non-members are permitted to enroll in one introductory lesson or clinic.
  • The 412 Squash Association does not accommodate walk-ins.


CLINIC POLICIES

  • Membership to the 412 Squash Association is required to participate in clinics. All clinics must be paid for in advance.
  • All registration and waiver forms must be completed prior to participating in a clinic.
  • Clinics are offered on a seasonal basis. Fall (Sep - Dec), Winter (Jan - March), Spring (April - June), and Summer (Jul - Aug).
  • An ability assessment by a 412 Squash coach may be required for a player's placement in junior competition squad clinics.
  • Seasonal group clinics are paid for on a use it or lose it basis. Credits are not offered for missed sessions and there are no make up sessions.
  • Players are expected to attend all clinic sessions. Individual class credits or make-up sessions will not be granted in the case of missed classes.
  • Late registration for seasonal clinics is permitted. The price of the course will be prorated based on the number of remaining sessions plus an additional late registration fee of $50.
  • In the case of an injury, long-term illness, or medical procedure, a medical form signed by a physician must be emailed to the 412 Squash Association at info@412squash.org. The 412 Squash Association will issue an account balance for any remaining sessions.
  • In the event that the 412 Squash Association has to cancel a clinic, a credit will be issued for future use.


LESSON POLICIES

  • Membership is required to book lessons. All lessons must be paid for in advance.
  • The 412 Squash Association offers private lessons for one player with one coach, as well as group lessons of up to 4 players with one coach.
  • Lessons are sold on a seasonal basis and can be purchased individually or in a package.
  • Lesson requests can be made by emailing info@412squash.org or completing a lesson request form found on the 412 Squash website.
  • Non-members can book a single introductory lesson. Introductory lessons must be booked in advance and can be done by emailing info@412squash.org.
  • Priority time slots for lessons are given to players who are enrolled in clinics.
  • While the 412 Squash Association does its best to accommodate requests for specific instructors, we cannot guarantee specific requests and/or ensure that the instructor will be the same for every single lesson. Instructors for a given lesson are subject to change at any time and we do not credit for substitute instructors.
  • To respect 412 instructors’ time, a 48-hour written notice is required to cancel a private lesson or group session to receive a credit. Rescheduling is dependent on the 412 Squash Association instructor and court availability. If no notice is received, 412 Squash will not issue a credit or make up lesson.
  • In the case of an injury, long-term illness, or medical procedure, a medical form signed by a physician must be emailed to the 412 Squash Association at info@412squash.org. 412 Squash will issue an account balance for any remaining sessions.
  • In the event that The 412 Squash Association has to cancel a lesson, a credit will be issued for future use.


COURT RENTAL POLICIES

  • Court rentals are restricted to only members of the 412 Squash Association.
  • Students under the age of 16 are not permitted to rent courts without the supervision of an adult.
  • Court rental availability will be limited to hours when a court monitor is on site.
  • Court rentals reservations can be booked through the 412 Squash Association App. Players cannot arrive at the 412 Squash Center without a reservation, nor can they book a court at the 412 Squash Center.
  • A maximum of three players per court rental is permitted: one member and 1-2 guests.
  • Court rentals for solo hitting are limited to one member. No guests are permitted to join a solo hitting session.
  • Players must vacate the court at the end of their reservation time.
  • No outside coaches will be permitted to provide private lessons to members or guests on the premises of the 412 Squash Association.
  • No outside equipment or ball machines may be used during a court rental session.
  • No balls or loaner equipment are provided for court rentals. 
  • A 24-hour notice is required to cancel a court rental to receive a credit. Cancellation notices must be emailed to the 412 Squash Association at info@412squash.org. In the event of a cancellation, a credit will be issued for future use.

Liability Waiver

IN CONSIDERATION of being permitted to use The Spence School’s (the “School”) athletic facilities at 412 Squash Center (the “Squash Facilities”), I, on behalf of myself and my spouse, children, agents, personal representatives, successors, assigns, heirs, next of kin, and executors:

1.   HEREBY understand and acknowledge that my use of the Squash Facilities and equipment may involve risks including but not limited to, risks of infectious syndromes and diseases, serious illness, injury, property damage, slipping, falling, overheating, concussions, illness, tripping, bruises, scrapes, lacerations, sprains, broken bones, loss of limb, paralysis, head injuries, eye injuries, other injuries, and even death. I ASSUME FULL RESPONSIBILITY FOR ANY RISK WHATSOEVER, INCLUDING BUT NOT LIMITED TO BODILY INJURY, EXPOSURE, DEATH OR PROPERTY DAMAGE arising out of or related to my use of the Squash Facilities whether caused by the negligence of the Releasees (as defined below) or otherwise.

2.   HEREBY understand and agree that the School is not an insurer of my health and safety and does not assume responsibility for spontaneous and unforeseen events which may occur during my use of the Squash Facilities. I further agree that the School reserves the right to restrict or terminate my use of the Squash Facilities for any reason in its sole discretion.

3.   HEREBY RELEASE, WAIVE, FOREVER DISCHARGE AND COVENANT NOT TO SUE theSchool, and all of its directors, officers, agents, trustees, volunteers and employees, (the “Releasees”) FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM, DEMAND, ACTION, OR CAUSE OF ACTION PERTAINING TO OR ARISING OUT OF MY USE OF THE SQUASH FACILITIES, INCLUDING BUT NOT LIMITED TO, CLAIMS FOR NEGLIGENCE, PERSONAL INJURY, BREACH OF CONTRACT, OR BREACH OF WARRANTY, EXCEPT IN THE EVENT OF GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. I understand that as a result of executing this release, I will forever be barred from suing the School as a result of my use of the Squash Facilities.

4.   HEREBY AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releasees FROM ANY LOSS, LIABILITY, DAMAGE, OR COST they may incur arising out of or related to my use of the Squash Facilities WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES or otherwise, except in the case of gross negligence or willful misconduct.

5.   HEREBY grant to the Releasees (and grant to the Releasees the right to grant to others), as well as their successors and assigns, in perpetuity, the irrevocable right (but not the obligation), with or without my knowledge, to film, tape, photograph, record, exhibit, edit, alter, copy, reproduce, license, sell, rent, disclose, display, publish, distribute, broadcast, webcast, prepare derivative works from or otherwise preserve, use and/or exploit in any format and/or manner now known or hereafter developed, whether commercial or non- commercial in nature (collectively, the “Use and Materials”): (1) my appearance at and/or use of the Squash Facilities and (2) my name, likeness, signature, voice, singing voice, conversation, sounds, biographical data, testimonials, and/or any other information or material secured by the Releasees in connection with my appearance at and/or use of the Squash Facilities. I agree that Releasees shall have the right to the Use and Materials, for their own account, throughout the universe and in perpetuity. I acknowledge and agree that I shall not be entitled to receive any compensation whatsoever in connection with the Releasees’ exercise of its Use and Materials rights.

6.   HEREBY AGREE AND UNDERSTAND that should any part or portion of this RELEASE be determined to be legally invalid or unenforceable for any reason, only such part or portion shall be severed and removed from the Agreement. The remaining provisions and all portions of this Agreement that have not been ruled invalid or unenforceable shall independently survive and remain in full force and effect, with only the invalid or unenforceable part or portion of this Agreement to be deemed stricken, unenforceable and severed from this Agreement. I further agree and understand that this release shall be governed and interpreted in accordance with the laws of New York and that any disputes arising out of or related to this RELEASE or my use of the Squash Facilities shall be litigated in the courts of New York.

I HAVE READ THIS RELEASE, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY THE LAWS OF NEW YORK.

I understand and agree that I must comply with the School's rules for the Squash Facilities. I understand that I may be removed from the Squash Facilities at any time for any reason in the discretion of the School.  


PHOTO RELEASE AND PERMISSION TO USE LIKENESS

I give permission to the 412 Squash Association, its affiliates, and agents to photograph and record me while using their facilities. I authorize them to use these images or recordings in perpetuity in any media, format, or platform for any lawful purpose.

I also allow the 412 Squash Association to edit, publish, or distribute these materials, without requiring my approval or further consent. This applies to any images of minors under my care.

I waive any right to compensation for the use of these materials.

PARENT OR LEGAL GUARDIAN ACKNOWLEDGEMENT (IF UNDER THE AGE OF 18)


I represent and warrant that I am the parent or legal guardian of , the individual who signed the foregoing RELEASE (the “Minor”) and that I have received, read, and understood the foregoing RELEASE. I fully consent to and voluntarily authorize the Minor to execute said RELEASE (or, if applicable, have voluntarily executed said RELEASE on the Minor’s behalf). I acknowledge and agree that all representations, consents, agreements, grants, waivers, authorizations, indemnifications and releases herein shall be regarded as made by me on behalf of the Minor and shall be binding on me and the Minor.

Furthermore, in consideration of the Minor being permitted to use the Squash Facilities, I hereby agree to be bound by and to perform all of the terms and conditions of the foregoing RELEASE (including, without limitation, the provisions regarding release of all claims), as such terms and conditions may relate to the Minor’s use of the Squash Facilities.
