Joyous Jungle, LLC Liability Waiver

WAIVER OF LIABILITY/ASSUMPTION OF RISK


To promote safety, Joyous Jungle, LLC inspects the property and all equipment on a regular basis.

In order to be allowed to enter into the play arena and/or participate in any party and/or program at Joyous Jungle, LLC, the undersigned, on his or her own behalf, and/or on behalf of the participant(s) identified below, acknowledges, appreciates and agrees to the following conditions:

1. ASSUMPTION OF RISK:

The play equipment at Joyous Jungle, LLC can be dangerous. I understand that there is a possibility of serious injury to the person or child. I am aware of the hazards, danger and risks of injury that can result of participation at Joyous Jungle, LLC, including those that may arise out of the negligence or other participants. These risks include without limitation, scrapes, bruises, cuts, sprains and even more serious injuries including disability and death. Also, if I discover any hazard during our participation, I will bring it to the attention of the nearest Joyous Jungle, LLC employee immediately.

I understand the operational rules listed below and I understand that it is my responsibility to ensure that I, and my children understand the rules. Although there will be staff members to monitor children playing, it is my responsibilityto monitor all the children listed below. I will bring any observation of the rules being broken to the attention of any Joyous Jungle, LLC staff member.

2. RELEASE, DISCHARGE & AGREEMENT NOT TO SUE:

I, for myself and any minor participant child and our respective heirs, personal representatives and assigns, do hereby release, discharge and agree not to sue Joyous Jungle, LLC or its managers, members, employees and/or other agents, for any sickness, injury to or death of any participant arising, directly or indirectly, from participation in the Activities. This release, discharge and covenant not to sue shall relate to any and all claims or legal rights now existing or arising in the future, including claims and legal rights arising out of any negligence of Joyous Jungle, LLC and/or its managers, members, employees and/or other agents and any other breach of a legal duty arising out of common law, statute, contract or otherwise

The undersigned agrees to pay for all damages to the facilities of Joyous Jungle, LLC, to include any rented space, caused by them or their family's negligent, reckless, or willful actions.

The undersigned agrees to abide with rules and conditions of participation and/ or attendance, posted at or explained by an employee at Joyous Jungle, LLC If the undersigned experiences any significant hazard or injury during such participation, the undersigned will promptly inform an employee of the company facility which they are currently attending.

3. GOOD HEALTH:

I warrant that the participant child is in good health and has no physical condition that would prevent them from, or heighten the risks associated with, participating in the activities offered by Joyous Jungle, LLC.

4. SECURITY CAMERAS:

I understand that security cameras installed around and within Joyous Jungle, LLC facility are for the safety of all participants and may be referenced should any incidents or injury occur.

5. PHOTO RELEASE:

I grant Joyous Jungle, LLC permission to use any photographs, video, or sound bites obtained of me or any minor Participant child at Joyous Jungle, LLC facility for any legal use including but not limited to publicity, advertisement and web content. I understand that no royalty or other compensation shall be payable to me or the minor Participant by reason of such use.

6. VENUE:

This agreement is governed by the law of the state of Florida. Participant and Joyous Jungle, LLC agree to subject themselves to the law of this state.

In addition to any rules posted on premises, rules that also must be followed are the following:

  • We are a sock only facility and socks are required for ALL guests. Grippy Socks are required for the kids.
  • We are a parent/guardian supervised facility. Parents/Guardians must remain on the premises at all times. We do NOT provide daycare or supervision of children.
  • A signed waiver and acknowledgment of rules is required for every child and adult that enters the facility.
  • Admission will NOT be granted for sick children, for the safety and well-being of others. We have the right to refuse service.
  • Children must always be accompanied into the restrooms by an adult. No rough play, pushing or throwing.
  • Strollers are not allowed in the play areas. Outside snacks are not allowed in the play area.
  • No outside toys may be brought into the playground. Adults are not permitted on the play structures.
  • We are not responsible for lost or stolen property.
  • Patrons not abiding by the rules will be asked to leave and no refunds will be given.

I hereby release and agree to hold Joyous Jungle, LLC harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act , or that may otherwise arise in any way in connection with any services received from Joyous Jungle, LLC I understand that this release discharges Joyous Jungle, LLC from any liability or claim that my heirs, any personal representatives, or I may have against the salon with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Joyous Jungle, LLC This liability waiver and release extends to the playground together with all owners, partners, and employees.

I hereby certify that; I have carefully read the foregoing covenant not to sue and acknowledge that I understand and agree to all of the above terms and conditions. I am aware that by signing this agreement, I assume all risks and waive and release all substantial rights that I may have and possess.

By signing below, I represent that I am the parent or legal guardian of the child(ren) named below, or I have obtained permission from the parent/legal guardian of such child(ren) to execute this agreement on their behalf. I agree that the child(ren) named below and I shall comply with all stated and customary terms, posted safety signs, rules and verbal instructions as conditions for participation at Joyous Jungle, LLC understand that this is a permanent waiver to be kept on file by Joyous Jungle, LLC for today's visit/party and all future visits.
