REQUIRED NOTICE FOR MINORS UNDER FLORIDA STATUTE 744.301(3)

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF JOYOUS JUNGLE, LLC USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM JOYOUS JUNGLE, LLC IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND JOYOUS JUNGLE, LLC HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.

WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND RELEASE OF CLAIMS

To promote safety, Joyous Jungle, LLC inspects the property and all equipment on a regular basis. However, by entering into the play arena and/or participating in any activities, parties, or programs at Joyous Jungle, LLC, the undersigned acknowledges and agrees to the following conditions:

1. ASSUMPTION OF INHERENT RISKS

I understand and acknowledge that indoor play activities involve inherent risks as defined by Florida law. The play equipment and activities at Joyous Jungle, LLC, including but not limited to the Little Explorers Zone, Jungle Town, The Climber (6-foot climbing wall), Jungle Gym (2-level enclosed structure), Sensory Room, and all related play equipment, structures, and activities (collectively, the "Activities") contain inherent risks that cannot be eliminated even if Joyous Jungle, LLC acts with due care in a reasonably prudent manner.

"Inherent risks" under Florida Statute 744.301(3)(a) include those dangers or conditions, known or unknown, which are characteristic of, intrinsic to, or an integral part of the activity, including but not limited to:

  • Falls from climbing structures, slides, and play equipment
  • Collisions with other participants or equipment
  • Cuts, scrapes, bruises, sprains, fractures, and other injuries
  • More serious injuries including permanent disability or death
  • The failure by Joyous Jungle, LLC to warn of an inherent risk
  • The risk that my minor child or another participant may act in a negligent or intentional manner and contribute to injury or death of my child (Note: "participant" does not include Joyous Jungle, LLC or its owners, employees, or agents)
  • Injuries from normal wear and use of play equipment in age-appropriate zones

I am voluntarily allowing my child to participate in these Activities with full knowledge of these inherent risks.

If I discover any hazard during participation, I will immediately bring it to the attention of the nearest Joyous Jungle, LLC employee.

2. PARENTAL SUPERVISION AND RESPONSIBILITY

I understand that Joyous Jungle, LLC is a parent/guardian supervised facility. I acknowledge that:

  • I must remain on the premises at all times while my child(ren) participate
  • Joyous Jungle, LLC does NOT provide daycare or supervision of children
  • I am solely responsible for supervising all children listed below at all times
  • I am responsible for ensuring that I and my children understand and follow all posted rules and staff instructions
  • I will immediately report any rule violations to Joyous Jungle, LLC staff

3. RELEASE FOR INHERENT RISKS (MINORS) - FLORIDA STATUTE 744.301(3)

For any minor children participating, I, as natural guardian, hereby waive and release in advance any claim or cause of action against Joyous Jungle, LLC, its owners, affiliates, employees, or agents that would accrue to my minor child for personal injury, including death, and property damage resulting from an INHERENT RISK in the activity as defined by section 744.301(3)(a), Florida Statutes.

This release for minors applies ONLY to inherent risks and does NOT release Joyous Jungle, LLC from claims arising from their own negligence or the negligence of their employees or agents.

IMPORTANT LEGAL NOTICE: Under section 744.301(3)(c),Florida Statutes, because this waiver complies with the statutory requirements and waives no more than allowed under the statute, there is a rebuttable presumption that this waiver is valid and that any injury to my minor child arose from inherent risk involved in the activity.

4. GENERAL RELEASE (ALL PARTICIPANTS)

I, for myself and on behalf of any minor participant children, and our respective heirs, personal representatives, and assigns, do hereby:

  • RELEASE, DISCHARGE, AND COVENANT NOT TO SUE Joyous Jungle, LLC, its owners, managers, members, employees, agents, and representatives from any and all liability for any injury, sickness, death, loss, or damage arising directly or indirectly from participation in the Activities

 

  • WAIVE ALL CLAIMS that I or any minor participant may have against the above parties, including claims arising from their negligence or other breach of legal duty EXCEPT AS LIMITED BY FLORIDA STATUTE 744.301(3) FOR MINORS


  • AGREE TO INDEMNIFY AND HOLD HARMLESS Joyous Jungle, LLC from any claims brought by others as a result of my or my children's participation

Important: This general release covers all legal theories of liability, including but not limited to negligence, premises liability, breach of contract, and failure to warn. However, for minor children, this release is subject to the limitations of section 744.301(3), Florida Statutes.

5. PROPERTY DAMAGE AND FACILITY RULES

I agree to pay for all damages to Joyous Jungle, LLC facilities, equipment, or property caused by my or my family's negligent, reckless, or willful actions.

I agree to abide by all rules and conditions posted or explained by employees. Current facility rules include:

  • Socks required for ALL guests; grippy socks required for children
  • Parents/guardians must remain on premises at all times
  • Signed waiver required for every child and adult entering the facility
  • No admission for sick children
  • Adult supervision required for children in restrooms
  • No rough play, pushing, or throwing
  • No strollers in play areas
  • No outside food/drinks or toys in play areas
  • Adults not permitted on play structures
  • Joyous Jungle, LLC not responsible for lost or stolen property

Failure to follow rules may result in removal without refund.

6. HEALTH REPRESENTATION

I represent that each participant is in good health and has no physical or medical condition that would prevent safe participation or increase the risks associated with the Activities. I will immediately inform staff of any medical emergency or significant hazard.

7. EMERGENCY MEDICAL TREATMENT

In the event of a medical emergency, I authorize Joyous Jungle, LLC staff to seek emergency medical treatment for any participant if I cannot be immediately reached. I understand that I am responsible for all medical expenses incurred.

8. PHOTOGRAPHY AND MEDIA RELEASE

I grant Joyous Jungle, LLC permission to use any photographs, video, or audio recordings of me or any minor participant obtained at the facility for promotional, advertising, or web content purposes. No compensation will be provided for such use.

9. SECURITY CAMERAS

I understand that security cameras are installed throughout the facility for safety purposes and may be referenced in case of incidents or injuries.

10. GOVERNING LAW AND VENUE

This agreement is governed by Florida law. Any legal action must be brought in the appropriate court in the county where Joyous Jungle, LLC is located.

11. SCOPE AND ENFORCEABILITY

For Minor Children: This waiver complies with Florida Statute 744.301(3) and creates a rebuttable presumption of validity and that any injury arose from inherent risk. Claimants must prove by preponderance of evidence that the waiver doesn't comply with the statute, or by clear and convincing evidence that injury didn't arise from inherent risk.

For All Participants: If any portion of this agreement is deemed invalid, the remainder shall remain in full force and effect. This waiver applies to today's visit and all future visits to Joyous Jungle, LLC.

ACKNOWLEDGMENT AND SIGNATURE

I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS. I understand that I am giving up substantial legal rights, including the right to sue for damages, subject to the limitations of section 744.301(3), Florida Statutes, for minor children. I am signing this agreement freely and voluntarily.
