AGREEMENT TO PARTICIPATE AND RELEASE, WAIVER AND ASSUMPTION OF RISK.

I realize and acknowledge that sport parachuting is an EXTREME SPORT, which can and sometimes does result in injuries or death. I also realize and acknowledge that flying to high altitudes in an airplane carries the same risks. Nevertheless, I want to participate in sport parachuting and I ASSUME ALL OF ITS RISKS, DANGERS AND HAZARDS. 

I IRREVOCABLY RELEASE AND DISCHARGE FROM ALL LIABILITY, AND RENOUNCE TO SUE OR TO PROSECUTE ÉCOLE DE PARACHUTISME VOLTIGE 2001 INC. and each of their shareholders, directors, officers, owners, employees, volunteers, aircraft owners, pilots, instructors, riggers, ground crew, airport owners, landowners and any other persons working for or with any of them (collectively the “Released Parties”), for any damages in regard to any MATERIAL OR PERSONAL INJURY OR DEATH sustained by me as a result of my participation in any flight operations or parachuting activities. This exclusion of liability, waiver, release and discharge, is binding myself in favor of the all Released Parties. This waiver of liability is binding on my heirs, legal representatives and anyone else who may claim on my behalf. I do waive all rights to lawsuits whatever the reasons or grounds for my material or personal injuries or death are, including but not limited to aircraft malfunction, equipment malfunction from whatever cause and EVEN IF CAUSED BY NEGLIGENCE of any of the Released Parties. I also agree to INDEMNIFY AND HOLD HARMLESS the Released Parties, from all claims, judgments and costs, including but not limited to attorneys' fees, and to reimburse them for any expenses whatsoever, incurred in connection with any action or proceeding brought as a result of my participation in any aircraft operations, parachuting and skydiving activities, including, but not limited to, actions brought by myself or on behalf of myself or my estate by any person or persons. Each Released Party may exact performance of my obligations hereunder directly from me as a third person beneficiary of such obligations. 

MEDICAL STATEMENT FOR PARACHUTE JUMPING 

I hereby certify that I am not under treatment for and do not suffer from any physical infirmity or uncontrolled chronic ailment or injury of any nature, that I have normal vision or wear corrective lenses. I HEREBY CERTIFY THAT I AM PHYSICALLY AND PSYCHOLOGICALLY FULLY CAPABLE OF PRACTICING PARACHUTE JUMPING. I furthermore agree to never do any parachute jump while my abilities are impaired by alcohol or drugs. 

REASONS FOR WAIVER OF LIABILITY 

ÉCOLE DE PARACHUTISME VOLTIGE 2001 INC. is a commercial enterprise providing general services to persons, clubs and organizations interested in participating in sport parachuting. Among other things, ÉCOLE DE PARACHUTISME VOLTIGE 2001 INC. provides and offers training for first and subsequent parachute jumps, sale and rental of parachute equipment used for sport parachuting, rigging services including repair, maintenance and repacking of both main and reserve parachutes, arranging for aircraft with pilots for use in the sport parachuting, and arranging for a field or property for sport parachutists to land in. ÉCOLE DE PARACHUTISME VOLTIGE 2001 INC.

ÉCOLE DE PARACHUTISME VOLTIGE 2001 INC. and their shareholders, directors, officers, owners, employees, volunteers, instructors, riggers, ground crew, airport owners, landowners, occupiers, aircraft owners, pilots, and any other persons working for or with any of them (collectively, the “Released Parties”), DO NOT CARRY INSURANCE for any risk related to parachute jumping. SPORT PARACHUTING BEING AN EXTREME AND VERY HAZARDOUS SPORT, there is no insurance company that accepts to insure these activities. 

For these reasons, ÉCOLE DE PARACHUTISME VOLTIGE 2001 INC. will NOT agree to provide any of the services it offers, including but not limited to, training for first and any subsequent sport parachute jump UNLESS you agree not to sue it if you get hurt for any reason at all, INCLUDING NEGLIGENCE on the part of any of the Released Parties. 

You must be fully aware that sport parachuting is an EXTREME AND VERY HAZARDOUS SPORT in which light, grave or fatal injuries may and often do occur as a result of one or more of the following : 

  1. Your instructors, pilots, parachute packers and ground crew are human beings who could make mistakes.
  2. Airplanes are susceptible to malfunctions. Pilots are human beings who could make mistakes. Other parachutists who jump from the plan during flight are an additional risk as they may cause damage to the plan and make it lose control.
  3. Your equipment is made, maintained, packed and used by human beings who could make mistakes resulting in malfunction of this equipment. ÉCOLE DE PARACHUTISME VOLTIGE 2001 INC. and the other Released Parties cannot and DO NOT offer any guarantee that the equipment used in doing a sport parachute jump will work.
  4. Your training can only be an approximation of the reality of sport parachute jumping as there is no totally adequate simulation for actually doing a sport parachute jump.

SPORT PARACHUTING IS NOT PERFECTLY SAFE. WE CANNOT OFFER ANY GUARANTEES. WE DO NOT guarantee that either or both of your parachutes will open properly. We DO NOT guarantee that ÉCOLE DE PARACHUTISME VOLTIGE 2001 INC. will function without error. We DO NOT guarantee that any of our back up devises will function properly, and we DO NOT guarantee that you won’t get hurt. YOU MAY GET HURT EVEN IF YOU DO EVERYTHING CORRECTLY. 

Typical injuries for this sport consist of broken legs, broken ankles, broken wrists or fingers, back injuries, injuries of all sorts due to hitting obstacles (such as power lines, trees, buildings, roads, water and other parachutists) and even death. LIKE ANY OTHER VERY HAZARDOUS SPORTS, THERE IS A RISK YOU WILL HURT YOURSELF EVEN IF YOU DO EVERYTHING PROPERLY. 

This form is a waiver that we ask you to READ CAREFULLY and then sign. You are not obligated to sign this waiver if you don’t accept the risks mentioned herein. We strongly recommend that you DO NOT sign this waiver if you do not understand any of these risks or any of the terms or other information set out in the waiver or if you do not agree with any or all of its contents. 

STATEMENT FROM THE SKYDIVER 

I hereby certify that, I want to use the facilities made available to me by the Released Parties and I declare being sufficiently experienced to do unsupervised skydiving. Having been well informed on the risks attached to the sport of skydiving, I certify that I am ready to react to any abnormality and/or emergency whatsoever that could happen during my jumps that are likely to cause injury or other damages to skydivers with whom I will be practicing the sport of skydiving. I commit to never skydive if I am not physically or mentally ready, or if I question myself or anything else in any way whatsoever
