Rental Agreement and Release of Liability Waiver

PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.


The undersigned, being at least 18 years old or that if he/she is younger than 18 years of age is accompanied by a parent or guardian who has read and signed the following release (hereinafter referred to collectively as “I”), attest that I have read, understood and agreed to the following liability release.


I understand that a both a valid driver's license and major credit card (non-debit card) are required to rent equipment from Ski Shack. I acknowledge that I will be the only person using the equipment I receive during this rental period. I accept all equipment “AS IS” without any warranty implied and acknowledge that I am responsible for the care of this equipment during the rental period. I accept full financial responsibility for any late fees, repairs and/or the replacement, at full retail value, of any equipment that is not returned to Ski Shack by the agreed upon date and time and/or in the event the equipment is damaged beyond normal wear and tear.


All instructions on the use of the equipment have been made clear to me, including to not use any equipment in the terrain park and off resort, and I understand the function of this equipment.  I agree to inspect this equipment before each use and if at any time this equipment does not seem to be working properly, I will stop using it immediately and return it for inspection and possible repair or adjustment. In the event of damage or any accident while using the equipment, I agree to immediately cease use, return it to Ski Shack, and provide a written report describing the incident.


Alpine Ski Rentals: I understand that proper bindings settings depend upon the accuracy of my statements about weight, height, age, and skier type and agree that I have made no misrepresentation to the staff or on the rental form. I agree to verify that the settings appearing in the visual indicator windows on the bindings correspond with the settings to be recorded on the rental form. I understand that the ski/boot/binding system is designed to release the boot from the ski when certain forces on the system reach preset values, but that the binding WILL NOT RELEASE OR RETAIN AT ALL TIMES where release or retention may prevent injury, and that it CANNOT prevent all injuries to any part of the user’s body. I understand and agree that lower settings on my bindings will increase releasability but also increase the risk of injury due to inadvertent release, that higher settings on my bindings will increase retention but also increase the risk of injury due to non-release, and that injuries due to unwanted release or retention are inherent risks of skiing.


Snowboard Rentals: I am aware that this equipment utilizes a non-release binding system that IS NOT DESIGNED OR INTENDED TO RELEASE during use. As such, I AGREE TO ASSUME ALL RISKS of death or of injury to any part of the user’s body while using this equipment.


Helmet Rentals: While I acknowledge that this helmet is intended to reduce the risk of serious head injury, I acknowledge and agree that NO HELMET CAN ELIMINATE OR PREVENT THIS RISK, NOR CAN A HELMET ELIMINATE OR PREVENT INJURY TO THE NECK OR SPINAL CORD. I understand that this helmet is intended for non-motorized recreational snow sport activities only. I understand that in order to function at its full capacity, this helmet must fit correctly, and I AGREE THAT THE PROVIDER HAS SUPPLIED A HELMET THAT PROPERLY FITS ME. When I fasten the chinstrap and shake my head there is no significant movement of the helmet, and at rest it feels comfortably snug.


I understand and agree that skiing, snowboarding and other related activities are HAZARDOUS and that injuries are common and ordinary occurrences during these activities, including SERIOUS INJURY AND DEATH. I AGREE TO ASSUME ALL RISKS of death or of injury to any part of the user’s body while using this equipment. I ACKNOWLEDGE THAT BY SIGNING THIS DOCUMENT I AM RELEASING THE SKI SHACK ENTERPRISES, INC. DBA SKI SHACK AND THEIR RESPECTIVE AGENTS, EMPLOYEES, MEMBERS, SPONSORS, PROMOTERS, AND AFFILIATES (COLLECTIVELY “RELEASEES”) FROM ANY AND ALL LIABILITY, REGARDLESS OF ANY NEGLIGENCE, INCLUDING BREACH OF CONTRACT ON THE PART OF THE “RELEASEES” IN THE DESIGN, MANUFACTURE, SELECTION, INSTALLATION, MAINTENANCE OR ADJUSTMENT OF THE EQUIPMENT. If any part of this agreement is held to be invalid or unenforceable, the remainder shall be given full force and effect.


By signing this form I agree that I am at least 18 years of age, and I accept completely the terms set forth in this Rental Agreement and Release of Liability. If the renter is a minor, I agree that I am signing as a parent or legal guardian who is at least 18 years of age. I further attest that I have read this release to the minor in age, and the minor understands the implications of this Rental Agreement and Release of Liability and agrees to the terms and conditions set forth herein.
