RECURRING PAYMENT AGREEMENT Gray & Ko. Salon and Spa, LLC | 119 North Main Street, McPherson, Kansas | Customer Form
IMPORTANT: This Agreement governs recurring charges only. Before using UV tanning or redlight therapy services, the Customer must separately complete the applicable safety disclosure, acknowledgment, consent, assumption of-risk, and release agreement required by Gray & Ko. Salon and Spa, LLC (the “Salon”). 1. Automatic Monthly Renewal The Customer elects recurring monthly billing for the package selected above. The package begins on the Enrollment Date and automatically renews each month until canceled or terminated under this Agreement.
2. Recurring Payment Authorization The Customer authorizes the Salon to charge the payment method placed on file in the amount of the Monthly Charge stated above, plus applicable taxes and fees, on the Recurring Billing Date stated above and on the corresponding date of each month thereafter. If a month does not contain that date, the charge may be processed on the last day of that month. This authorization continues until cancellation or termination becomes effective. Charges for products, upgrades, add-on services, or other purchases are not included and require separate authorization.
3. Cancellation by Customer The Customer may cancel recurring billing at any time by delivering a cancellation request (a) by email to , (b) through any account-cancellation feature made available by the Salon, or (c) in person at the Salon during regular business hours. To prevent the next scheduled charge, the Salon must receive the request at least seven (7) calendar days before the next Recurring Billing Date. If received fewer than seven (7) calendar days before that date, the next scheduled charge may be processed, and cancellation will become effective at the end of that final paid billing period. No additional recurring charge will be made after cancellation becomes effective. The Salon will provide written or electronic confirmation of the effective cancellation date.
4. No Refunds or Proration Except when required by law or approved by the Salon in writing, recurring charges are nonrefundable after the applicable billing period begins. The Salon will not issue partial or prorated refunds for unused services, scheduling conflicts, lack of use, or a mid-period cancellation.
5. Payment Method; Declined or Reversed Charges The Customer must maintain a valid payment method and promptly update expired or changed payment information. The Salon may suspend access associated with the recurring package after a charge is declined, reversed, disputed, or charged back. Suspension does not authorize charges after cancellation becomes effective and does not waive any amount already due.
6. Price Changes The Salon may change the Monthly Charge by providing at least thirty (30) days’ advance written or electronic notice stating the new price and effective date. The Customer may cancel before the new price takes effect. Continued enrollment after the effective date authorizes recurring charges at the new price, provided the Salon has delivered the required notice.
7. Termination by Salon The Salon may suspend or terminate recurring billing and package access for nonpayment, misuse, attempted transfer, fraudulent activity, unsafe conduct, violation of Salon policies, or failure to comply with an applicable service agreement. If the Salon terminates without Customer default, the Salon will refund any unused prorated portion of the then-current paid period, except as otherwise permitted by law.
8. Separate Service Agreements Required This Agreement does not authorize the Customer to use tanning or UV therapy equipment and does not replace any separate safety disclosure, acknowledgment, consent, assumption-of-risk, release, screening form, or operating rule required by the Salon. The Customer must sign and comply with the agreement applicable to each service before use. If this Agreement conflicts with a safety requirement, applicable law, manufacturer instruction, trained-operator direction, or separate service agreement, the safety requirement or service agreement controls as to service eligibility and use.
9. Controlling Recurring-Billing Agreement This Agreement is the complete and controlling agreement concerning recurring charges, automatic renewal, cancellation, payment failures, refunds, and price changes for the package identified above. Any software screen, website description, advertisement, receipt, employee explanation, or other summary is provided for convenience and does not replace or modify this Agreement. If a summary conflicts with this Agreement, this Agreement controls. A modification must be in writing and accepted by the Salon and the Customer, except for a price change made under Section 6.
10. Electronic Communications; Copy of Agreement The Customer consents to receive this Agreement, cancellation confirmations, price-change notices, and other notices at the email address stated above and agrees to keep contact information current. The Salon will provide the Customer a completed paper or electronic copy of this Agreement.
11. General Terms Kansas law governs this Agreement. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect. A waiver on one occasion is not a continuing waiver. Electronic signatures and counterparts are effective as originals.
Customer Acknowledgment and Authorization By signing below, the Customer acknowledges and agrees that: (a) the selected package automatically renews each month until canceled or terminated; (b) the Salon may charge the payment method on file the Monthly Charge stated above, plus applicable taxes, on the Recurring Billing Date; (c) the Customer has reviewed the cancellation and refund terms; (d) the Customer understands that a separate service agreement is required before using tanning or UV therapy services; and (e) the Customer has received or will receive a completed copy of this Agreement.
