Release of Liability and Photo Release Waiver

**1. Release of Liability**


I, the undersigned, acknowledge and fully understand that aerial arts, including but not limited to aerial silks, Lyra, and other related activities, involve risks that can be severe and could result in permanent disability or death. These risks include but are not limited to falls, collisions, and equipment failure. I understand that these risks are inherent to the nature of the activities, and while Avatar Sports LLC will make every effort to minimize these risks, they cannot be completely eliminated.


In consideration of being allowed to participate in any way in the aerial arts activities and classes provided by Avatar Sports LLC Aerial Arts Studio, at both 677 Cochran Street, Simi Valley, and Skyzone Thousand Oaks at 193 N Moorpark rd, Thousand Oaks, CA, I hereby agree to the following:


1. I voluntarily agree to assume all risks, including injury, accident, illness, or death, which may occur during my participation in any class or activity at Avatar Sports LLC Aerial Arts Studio or Skyzone Thousand Oaks location


2. I, on behalf of myself, my heirs, personal representatives, or assigns, hereby release, waive, discharge, and covenant not to sue Avatar Sports LLC, its owners, officers, employees, agents, contractors, or volunteers (hereinafter referred to as “Releasees”) from any and all claims, demands, actions, or losses, including legal fees, resulting from any injury, disability, death, or damage to person or property, whether caused by the negligence of the Releasees or otherwise, arising from my participation in any class or activity.


3. I agree to follow all instructions and guidelines provided by the instructors and staff at both locations, and I understand that failure to do so may result in my removal from the class or activity without a refund.


### **2. Photo and Video Release**


I, the undersigned, grant permission to Avatar Sports LLC Aerial Arts Studio, its representatives, and employees to take photographs and videos of me (or my child) during any class, performance, or event associated with Avatar Sports LLC at the above locations.


1. I authorize Avatar Sports LLC to use, reproduce, and distribute any photographs or videos taken for any purpose, including advertising, promotional materials, social media, websites, and other forms of media.


2. I waive any right to inspect or approve the finished photographs or videos, and I understand that I will not receive any payment or compensation for the use of such images.


3. I understand that all photographs and videos may be taken during classes, events and performances for use by Avatar Sports LLC for promotional purposes such as social media, website content, and marketing materials.


I Agree

I give my consent to Avatar Sports LLC to use photographs or videos of my child for promotional purposes without further notification. I understand that these images will not be sold and will be used for the purposes mentioned above.


I do not give my consent for photographs or videos of my child to be used for any promotional purposes. and I request that any images taken are not shared on social media, websites, or marketing materials.


### **3. Acknowledgment and Signature**


By signing below, I acknowledge that I have read and fully understand the above release of liability and photo release waiver. I am aware that this is a release of liability and a contract between myself and Avatar Sports LLC, and I sign it of my own free will.
