ROW OR PADDLE YOUR OWN ADDENDUM TO AGREEMENT TO ASSUME ALL RISKS

The undersigned Participant executes this Addendum to the Agreement to Assume All Risks (“Agreement”) hereby incorporated within the Agreement, and further acknowledges and contractually agrees as follows:

1. Heightened Risks. The Participant is participating in a “Row or Paddle Your Own” trip1 with Yellow Jacket River Guides, which trip carries heightened and additional risks to those assumed by a Participant in a traditional guided river trip and previously acknowledged in the Agreement.  The inherent risks of the trip are heightened and enhanced by the fact that the boat in which the Participant will be traveling down the river will not be rowed or paddled by a licensed guide who is familiar with the river, the rapids on the river, and the dynamic nature of river conditions. Therefore, all risks inherent to traveling by boat down a whitewater river are heightened, and the risk of injury or death is correspondingly higher. In addition, a Row or Paddle Your Own trip carries these additional, specific risks associated with rowing or paddling your own boat or riding on or in a boat rowed or paddled by an unlicensed boatman who may be unfamiliar with the river and/or lacking the skill or experience of a licensed guide. These risks may include, but are not limited to the unlicensed boatman’sfailure to: understand and follow guide instructions; properly rig gear or equipment to the boat; understand how to properly use or maintain equipment during a trip resulting in its failure or malfunction; to properly control a boat as a result of a lack of adequate knowledge, experience, or skill; or to properly execute a rescue of an involuntary swimmer.

2. Participant’s Acknowledgements and Representations.   

A. For a Participant (“unlicensed boatman”) who will be rowing or paddling the boat: I understand that I am responsible for truthfully disclosing to Yellow Jacket River Guides my personal rowing or paddling experience and knowledge, and I represent that I am physically and mentally capable of rowing or paddling my own boat down a river with Class I – IV rapids. While Yellow Jacket River Guides has the right to assess my abilities, ultimately it is my responsibility to determine whether I am capable of rowing or paddling a boat down the river in all of the conditions I may encounter. I understand the critical importance of all instructions given to me and agree to follow all guide instructions at all times while rowing or paddling the boat. I understand the increased risk associated with changing water levels. I understand that I am responsible for truthfully disclosing and notifying Yellow Jacket River Guides of any risk to me or other participants associated with my own mental or physical conditions, particularly as they relate to rowing or paddling a boat. I represent that I am comfortable with, and capable of, taking passengers on the boat I will be rowing or paddling, and that by doing so I am assuming responsibility for their safety.

B. For Participants who will be passengers on a boat rowed or paddled by another Participant who is not a licensedguide: I represent that I am confident in the unlicensed boatman’s ability to navigate a river with Class I – IV rapids, and that I fully assume all responsibility for that assessment, and all risks associated with my decision to be a passenger in their boat, including the possibility of injury or death. I represent that I am a member of the unlicensed boatman’s immediate family.

C. For a Participant who will be bringing and rowing their own boat and associated safety gear: I represent that I will supply my own boat and all associated rigging and safety equipment, including boat, perimeter line and bowline, frame, oars, spare oar, throw bag, personal floatation devices for each Participant, patch kit, whistle, river knife, minor medical kit, and spare personal floatation devices, and that all such equipment is in good condition and working order. I represent that I am familiar with my equipment and understand how to use and maintain it while on the river.   

To the extent any language in this Addendum conflicts with the Agreement, this Addendum shall control. To the extent a minor is the Participant, I sign this Addendum on behalf of the minor participant.
