ASSUMPTION OF RISK AND RELEASE FROM LIABILITY

I, acknowledge that I have voluntarily applied to Flying Fish Air LLC to participate in a flying activity. In this agreement. the term “flight activity" shall refer to all activities, events, and services provided. arranged or organized by Flying Fish Air LLC and its employees, and agents ("Releasee") including but not limited to orientation and instruction sessions; surface or air transportation, including all helicopter travel; loading, unloading, and travel in or movement around the aircraft.

ASSUMPTION OF RISK

l AM AWARE THAT THIS IS A FLYING ACTIVITY AND MAY BE A HAZARDOUS ACTIVITY. l AM NOT RELYING ON ANY INSPECTION, INFORMATION, OR REPRESENTATIONS OF Flying Fish Air LLC OR ITS AGENTS OR EMPLOYEES RELEVANT TO THIS FLYING ACTIVITY. I AM VOLUNTARILY PARTICIPATING IN THIS FLYING ACTIVITY WITH FULL KNOWLEDGE OF THE POSSIBLE DANGER INVOLVED IN FLYING, AND HEREBY AGREE TO ACCEPTANCE AND ALL RISKS OF INJURY OR EVEN DEATH, AND VERIFY THIS STATEMENT BY INITIALING HERE.


RELEASE

In consideration of being permitted to participate in any flight activity sponsored, promoted, or directed by Flying Fish Air LLC. the undersigned ("Passengers"), for himself/herself, his/her personal representatives, heirs and next of kin HEREBY RELEASES Flying Fish Air LLC of all liability to the undersigned. Whether caused by the negligent act or omission for release or otherwise while the undersigned is for the purpose of participating in such activities. It is fully understood by each of the undersigned that there is some inherent risk associated with any flying activity. IN ADDITION, the undersigned AGREES TO INDEMNIFY AND HOLD HARMLESS the Releasee from any loss, liability, damage, or cost they incur due to such participation by the negligence or otherwise and AGREES TO ASSUME FULL RESPONSIBILITY AND RISK FOR any bodily injury, death or property damage from Releasees' negligence or otherwise while the undersigned is in participation of flight activities. This release is limited to any claim for damage or loss the undersigned might have against Flying Fish Air LLC in excess of any collectible and enforceable policy of insurance in force and covering such claim or loss. It is also operative only to the extent that it does not void any insurance coverage of the undersigned, which would otherwise be applicable to and payable for the event herein described. The undersigned hereby assumes full responsibility for all risk of bodily injury, death, or property damage due to the negligence of Flying Fish Air LLC connected with their ownership, use, or maintenance of their aircraft. The undersigned acknowledges that flying in an aircraft could involve serious risk of injury or - death. This release is limited to any claim for damage or loss the undersigned might have against in excess of any collectible and enforceable policy of insurance in force at the time this release is executed by the undersigned. Should any employee agent of Flying Fish Air LLC other than the General Manager make any expression as to his/her personal belief concerning the existence of such insurance, then it shall be considered only an expression as to his/her personal belief, without warranty, and the undersigned does not in any way rely on such expression in deciding whether or not to participate in this flying activity. Should any minor child or incompetent person under the care of the undersigned also ride as a passenger in any aircraft participating in this flying activity, then the undersigned executes this release on his/her behalf, and said minor child or incompetent person releases and discharges Flying Fish Air LLC as if they had executed this document and were competent to do so.

INSURANCE

I further acknowledge that I have been informed of the following aircraft insurance policy declaration that Flying Fish Air LLC has as the maximum available liability coverage. Description of coverage and the limits of liability Passenger liability is limited to;

Single limit injury and property damage..........$1,000,000
Each Passenger (sub-limit)...............................$100,000
Medical Expense (each person)............................$5,000

l ACKNOWLEDGE THAT I HAVE HAD SUFFICIENT TIME TO READ THIS ENTIRE AGREEMENT. I HAVE CAREFULLY READ AND UNDERSTAND ALL OF IT AND l AGREE TO BE BOUND BY ITS TERMS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY, A WAIVER OF MY LEGAL RIGHT TO COLLECT DAMAGES IN THE EVENT OF INJURY, DEATH, OR PROPERTY DAMAGES, AND AN AGREEMENT NOT TO SUE Flying Fish Air LLC AND SIGN IT OF MY OWN FREE WILL.

PHOTO RELEASE

I grant to Flying Fish Air LLC, its representatives, and its employees the right to take photographs of myself and my property in connection with the above-identified subject. I authorize Flying Fish Air LLC, its assigns, and transferees to copyright. use and publish the same in print and/or electronically. I agree that Flying Fish Air LLC may use such photographs of me with or without my name and for any lawful purpose, including for example such purposes as publicity. illustration. advertising, and Web content.

l HAVE READ AND UNDERSTAND THE ABOVE PHOTO RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE. OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENTS/GUARDIANS AS EVIDENCED BY THEIR SIGNATURES BELOW.
