Le Paddle - Comprehensive Liability Waiver

RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT

By signing this document, you will waive certain legal rights, including the right to sue. Please read carefully!

TO: Le Paddle Shediac, its owners, directors, officers, employees, volunteers, representatives, and agents (hereinafter referred to as 'the Operator')

ASSUMPTION OF RISKS:

I acknowledge that participation in water sports and rental activities such as stand-up paddle boarding (SUP), kayaking, canoe and dinghy usage involves inherent risks, dangers, and hazards. These may include but are not limited to: physical exertion, dehydration, equipment failure, collisions, capsize, exposure to elements, wildlife encounters, drowning, and negligence on the part of myself, other participants, or the operator.

I freely accept and fully assume all such risks, dangers, and hazards and the possibility of personal injury, death, property damage or loss resulting therefrom.

RELEASE OF LIABILITY AND WAIVER OF CLAIMS:

In consideration of being allowed to participate in the activities and use of the services and equipment provided by the Operator, I hereby agree:

  • To waive any and all claims that I have or may have in the future against the Operator.
  • To release the Operator from any and all liability for any loss, damage, injury, or expense I may suffer as a result of participation.
  • To hold harmless and indemnify the Operator from any liability resulting from my actions.

ACKNOWLEDGMENT:

I confirm that I:

  1. Have received and understand the safety briefing
  2. will wear a personal floatation device (PFD) at all times
  3. Am medically fit for this activity

JURISDICTION:

This agreement shall be governed by and interpreted in accordance with the laws of the Province of New Brunswick.

I HAVE READ AND UNDERSTOOD THIS AGREEMENT AND I AM AWARE THAT I AM WAIVING CERTAIN LEGAL RIGHTS.
