KAYAK and/or PADDLE BOARD RENTAL WAIVER |

Each person in a group must submit a signed waiver & pay the per day rental charge (if applies to specific property). Kayaks and/or Paddle Boards are available between the times of 9:00AM - 8:00PM May 1 through November 1st  (subject to availability).

In consideration of the kayak rental provided by Mitten Housing LLC, I, the renter ("Renter"), acknowledge and agree to the following terms and conditions:

  1. ACKNOWLEDGMENT OF RISKS: Renter acknowledges that kayaking involves certain inherent risks, including but not limited to risks of injury, illness, or death due to drowning, hypothermia, collisions with other watercraft or objects, and other hazards associated with outdoor activities.
  2. ASSUMPTION OF RISK: Renter voluntarily assumes all risks associated with the rental of the kayak and/or paddle board, including but not limited to the risks described above, and accepts full responsibility for any injuries or damages that may occur as a result of Renter's participation in kayaking and/or paddle boarding.
  3. RELEASE OF LIABILITY: Renter agrees to release, indemnify, and hold harmless Mitten Housing LLC, its owners, officers, directors, employees, agents, and assigns (collectively, "Releasees"), from any and all claims, damages, or injuries arising out of or in connection with the kayak and/or paddle board rental, including but not limited to claims for personal injury, wrongful death, property damage, or breach of contract.
  4. MEDICAL TREATMENT: In the event of a medical emergency, Renter authorizes Mitten Housing LLC and its representatives to secure medical treatment for Renter and to make necessary decisions related to Renter's medical care.
  5. EQUIPMENT RENTAL: Renter acknowledges that the kayak and/or paddle board and any related equipment provided by Mitten Housing LLC are rented "as is" and that Renter is responsible for inspecting and testing the equipment prior to use. Renter agrees to use the equipment in a safe and responsible manner, and to return the equipment in the same condition as it was at the time of rental, reasonable wear and tear excepted.
  6. AUTHORIZATION TO CHARGE: Renter authorizes Mitten Housing LLC to charge Renter's credit card for any damages to the kayak and/or paddle board or related equipment, or for any other charges incurred as a result of Renter's use of the equipment.
  7. GOVERNING LAW: This Waiver shall be governed by and construed in accordance with the laws of the state of Michigan.
  8. PROPER USE: Renter agrees to use a properly secured USCG approved floatation device, of type 3 or better, at all times. 

I, the Renter, have read and understand this Waiver, and agree to be bound by its terms and conditions.
