Reef Discovery Center Visitor and Workshop Release of Liability

I, (“Visitor” or “Participant”), acknowledge and understand that entering, remaining in, or moving through the Reef Discovery Center facility in Fort Lauderdale, Florida (the “Center”), or participating in any Center program, may include general admission, tours, viewing aquariums and exhibits, educational workshops, demonstrations, lectures, classes, laboratory observation, volunteer or citizen-science activities, coral aquaculture or restoration training, authorized handling of coral or marine organisms, use of tools, equipment, materials, or protective gear, special events, and related setup or cleanup (collectively, the “Activities”). This Agreement applies whether I am visiting the Center generally or participating in an organized Activity.

I understand that the Center is an active public education space, aquarium facility, and working coral laboratory. The Center may contain wet or slippery floors, water spills or leaks, uneven surfaces, thresholds, stairs, cords, hoses, pumps, plumbing, electrical systems, lighting, glass aquarium tanks, pressurized systems, moving or fragile equipment, tools, adhesives, epoxies, cleaning products, laboratory materials, live coral and other marine organisms, saltwater, aerosols, bacteria or microorganisms, allergens, sharp surfaces, crowded areas, and restricted workspaces.

I understand that the Activities may involve known and unknown risks, including slips, trips, falls, cuts, punctures, pinches, burns, strains, lifting injuries, allergic reactions, skin or eye irritation, infection, coral stings, bites or scratches, electrical injury, falling or broken objects, equipment malfunction, property damage, emotional distress, illness, serious injury, permanent disability, or death. Emergency care or treatment may be delayed or unavailable.

I knowingly and voluntarily accept and assume all risks arising from my presence at the Center or participation in the Activities, including risks caused by site conditions, other visitors or participants, and the ordinary negligence of a Released Party, to the fullest extent permitted by law.

Release of Liability and Covenant Not to Sue

TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Ocean Rescue Alliance International (“ORAI”), Reef Discovery Center (“RDC”), any person or entity owning, leasing, managing, or operating the Center, and their respective affiliates, directors, officers, members, employees, staff, volunteers, agents, contractors, instructors, presenters, researchers, program partners, sponsors, equipment providers, successors, and assigns (collectively, the “Released Parties”), for any claim, demand, action, damage, loss, cost, or liability arising out of or related to my presence at the Center or participation in the Activities, including personal injury, illness, death, property damage, medical expenses, and wrongful-death or survival claims, even if caused in whole or in part by the ordinary negligence of a Released Party.

This release expressly includes claims alleging negligent maintenance of the premises; negligent failure to inspect, warn, instruct, supervise, control access, provide protective equipment, maintain aquarium or laboratory systems, render first aid, or obtain emergency assistance; and negligent selection or use of tools, equipment, materials, instructors, contractors, or program activities. It applies to claims brought by me or through me, including by my heirs, estate, personal representatives, and assigns. It does not release claims based on gross negligence, reckless or intentional misconduct, or any claim that applicable law does not permit to be waived.

Visitor and Participant Safety Responsibilities

I will follow all posted signs, barriers, safety rules, instructions, and directions from Center personnel. I will remain in authorized public or program areas and will not enter restricted aquarium, laboratory, animal-care, storage, mechanical, staff, or research areas unless expressly authorized and supervised.

I will not touch, feed, handle, remove, or disturb coral, marine organisms, aquarium tanks, plumbing, electrical systems, laboratory materials, tools, equipment, exhibits, or research specimens unless Center personnel expressly authorize me to do so. When participating in a hands-on Activity, I will use required protective equipment, handle tools and materials only as instructed, immediately report spills, damage, injuries, unsafe conditions, or equipment problems, and stop participating if I feel unsafe or unable to continue.

I am responsible for determining whether I can safely participate in an optional hands-on Activity and for informing Center personnel of any allergy, medical condition, accessibility need, or other concern that may require reasonable assistance or affect safe participation. I will not participate while impaired by alcohol, drugs, medication, illness, fatigue, or any condition that could make participation unsafe.

If I accompany a minor or another person requiring supervision, I will maintain appropriate supervision and ensure that person follows all Center rules and instructions. I understand that Center personnel are not providing childcare or continuous personal supervision unless expressly agreed in writing.

Personal Property

I am responsible for safeguarding my personal property. The Released Parties are not responsible for lost, stolen, misplaced, or damaged belongings except to the extent caused by conduct that cannot legally be waived.

Medical Authorization

If I become injured or ill, I authorize Center personnel to contact emergency services and arrange or provide first aid, emergency care, transportation, and medical treatment reasonably believed necessary. I understand that the Released Parties do not promise that medical care or emergency assistance will be available or successful. I accept responsibility for medical, rescue, transportation, and related costs not covered by insurance, except to the extent those costs arise from conduct that cannot legally be waived.

Responsibility for My Conduct

To the fullest extent permitted by law, I agree to indemnify and hold the Released Parties harmless from third-party claims, losses, or reasonable costs arising from my own negligent or intentional conduct, my violation of Center rules or law, my unauthorized entry into restricted areas, or my misuse of tools, equipment, materials, exhibits, aquarium systems, or living organisms. This does not require me to indemnify a Released Party for that party's gross negligence, reckless or intentional misconduct, or liability that cannot legally be shifted.

Florida Law and General Terms

This Agreement is governed by Florida law. Any action concerning this Agreement shall be brought in a state court located in Broward County, Florida, or, if federal jurisdiction exists, in the federal court serving Broward County, to the extent enforceable. If any provision is held invalid or unenforceable, it shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain effective.

Electronic signatures, typed names, click-through acceptance, and electronically stored records are intended to have the same force as original signatures to the extent permitted by law. This Agreement is the entire agreement concerning the matters it covers and may be modified only in a written agreement signed by ORAI and the Visitor or Participant.

Acknowledgment of Understanding

I HAVE CAREFULLY READ AND UNDERSTAND THIS DOCUMENT. I understand that it is a release of liability and a legally binding contract, that I am giving up substantial legal rights, and that I sign or electronically accept it freely and voluntarily without relying on any oral promise or statement.

Reef Discovery Center Media Release

I grant ORAI, RDC, and their identified program partners, licensees, designees, successors, and assigns permission to photograph, film, livestream, or otherwise record my image, likeness, appearance, voice, and statements voluntarily made while I am at the Center or participating in an Activity (the “Recordings”). This permission is royalty-free, worldwide, perpetual, and irrevocable to the extent permitted by law.

I authorize the Recordings to be edited, reproduced, displayed, published, distributed, and used in any media for educational, conservation, scientific-outreach, fundraising, promotional, public-relations, documentary, website, social-media, advertising, and archival purposes, without compensation. ORAI and RDC own Recordings created by or for them and the resulting edited materials. This permission does not transfer ownership of materials I created independently before visiting the Center.

I waive any right to inspect or approve authorized uses and release ORAI, RDC, and the other media-release parties from claims arising from an authorized use, including claims based on privacy, publicity, or portrayal, except for uses that are unlawful or intentionally defamatory. I understand that safety and security monitoring may occur independently of this promotional Media Release and may be used or retained as permitted by law.

Additional Terms for a Minor Visitor or Participant

If the Visitor or Participant is under 18, the signer represents that he or she is the minor's natural guardian and has legal authority to provide consent and execute this Agreement. The natural guardian consents to the minor's presence at the Center and participation in the Activities, agrees to the assumption-of-risk and release provisions on the minor's behalf to the fullest extent permitted by Florida law, separately releases the natural guardian's own claims arising from the minor's visit or participation, and grants the Media Release on the minor's behalf.

READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF OCEAN RESCUE ALLIANCE INTERNATIONAL, AS OPERATOR OF THE REEF DISCOVERY CENTER, USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM OCEAN RESCUE ALLIANCE INTERNATIONAL, AS OPERATOR OF THE REEF DISCOVERY CENTER, IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND OCEAN RESCUE ALLIANCE INTERNATIONAL, AS OPERATOR OF THE REEF DISCOVERY CENTER, HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
