Acknowledgment of Risk & Release of Liability
(To be completed once per year by each client; applies to all services performed within that year without needing repeated signatures) I, the undersigned, acknowledge that I have read, understood, and agree to the following terms regarding services provided by RockPilot Rigging. I represent that all information I have provided about my equipment and flight experience is truthful and complete. In this agreement, the terms "I" or "me" refer to the client—the person signing this waiver and agreeing to the terms herein. Scope of ServicesRockPilot Rigging provides inspection, maintenance, repair, and modification services for paragliding wings, harnesses, reserve parachutes, and related equipment. Right to Refuse ServiceRockPilot Rigging reserves the right to refuse service, in whole or in part, at its sole discretion for reasons including safety concerns, improper equipment condition, incomplete or inaccurate information, equipment abuse or misuse, client conduct, or any other reason deemed appropriate. Acceptance of equipment for evaluation does not obligate RockPilot Rigging to perform service. Assumption of RiskI understand and accept that use of paragliding equipment involves inherent risks, including serious injury or death, which cannot be entirely eliminated even after professional service, inspection, or repair. Qualifications and LimitationsRockPilot Rigging employs master technicians certified by APPI, with additional training from USPA and CSPA Elite Master Rigger Examiners, and collaborates with professional trimmers and riggers worldwide. Despite this expertise, RockPilot Rigging does not guarantee continued airworthiness or safety of equipment, which may be compromised by wear, aging, misuse, or environmental factors beyond RockPilot’s control. Client Responsibilities• Client will perform a thorough pre-flight inspection of all equipment before each use. • Client understands that any modifications, repairs, or installations performed by yourself or a third party after service by RockPilot Rigging void any implied assurances. • Client will follow all manufacturer guidelines, safety bulletins, and recommended maintenance schedules. Limitations of ServiceI acknowledge that not all damage or defects are visible during inspections, full wing inspections must be explicitly requested to detect certain issues, and RockPilot Rigging is not liable for problems outside the agreed scope of service. Rush ServiceRush Service is expedited work accepted at RockPilot Rigging’s discretion, subject to operational limitations, and charged at double (2x) the standard rate. Rush Service shall never compromise safety or professional standards. Activities Not CoveredI acknowledge that services such as: -self-installation of parts purchased from RockPilot Rigging -reserve parachute packing without professional training, and -unauthorized modifications are undertaken entirely at my own risk. Equipment Pickup & TransportI accept sole responsibility for transport, handling, and storage of equipment before and after service. RockPilot Rigging is not liable for loss, damage, or delays during shipping or third-party collection unless otherwise agreed in writing. Declining additional shipping insurance transfers all transit-related risks to me. Once equipment leaves our facility, its condition and security are the sole responsibility of the client. Manufacturer Recalls & BulletinsI am responsible for monitoring all relevant manufacturer recalls and safety updates. RockPilot Rigging will notify me of known issues at service time but does not guarantee ongoing updates. Refunds, Returns, and ExchangesRefunds, returns, and exchanges are not available after repair work or manufacturing of custom items begins or the item is delivered. Special-order and custom-manufactured items are final sale. Manufactured items sold separately, including paraglider lines, may be returned only if defective or damaged upon delivery, with issues reported within 30 days. Reserve repacks and maintenance services are final once completed, except for workmanship defects reported within 30 days. Confirmed defects will be corrected at no labor cost; shipping to Cochrane is my responsibility, while RockPilot Rigging will cover return shipping. This policy complies with Alberta law. Limitation of Liability for Consequential DamagesTo the fullest extent permitted by law, RockPilot Rigging shall not be liable for any indirect, special, incidental, consequential, punitive, or exemplary damages, including but not limited to loss of profits, revenue, business opportunities, or reputation, arising from or related to the use of serviced, repaired, manufactured, or modified equipment, even if advised of the possibility of such damages. This limitation applies regardless of the legal theory asserted, including negligence or breach of contract, except for liability arising from gross negligence or willful misconduct. Data PrivacyRockPilot Rigging collects and uses personal information provided by clients solely for the purpose of delivering repair and service operations and maintaining necessary records. All personal data is stored securely and handled in compliance with applicable Alberta privacy laws. Personal information will not be shared with third parties without client consent, except as required by law. Clients may request access to their personal information or inquire about its use by contacting RockPilot Rigging. Dispute ResolutionIn the event of any dispute arising out of or relating to this agreement, the parties agree first to attempt to resolve the matter amicably through good faith negotiation. If negotiation fails, the parties agree to proceed to mediation with a mutually agreed mediator prior to initiating any litigation. This clause does not prevent either party from seeking urgent injunctive relief in a court of competent jurisdiction if necessary. JurisdictionAny disputes, claims, or legal proceedings relating to this agreement shall be subject exclusively to the courts of the Province of Alberta. Release of LiabilityI hereby release, indemnify, and hold harmless RockPilot Rigging, its owners, employees, agents, and affiliates from all claims, damages, injuries, or losses related to the use of serviced, repaired, manufactured, or modified equipment, including those arising from negligence except where gross negligence or willful misconduct is proven. By signing below, I confirm that I have read, understood, and agree to all terms outlined above and accept full responsibility for the use, installation, and continued operation of any equipment serviced or supplied by RockPilot Rigging.
