BOAT AND WAVERUNNER RENTAL AGREEMENT

**ALL RENTERS MUST BE AT LEAST 18 YEARS OF AGE AND PROVIDE PROOF OF AGE** 

**ALL LESSEES WHO WILL DRIVE THE VESSEL BORN AFTER JANUARY 1, 1988 MUST HAVE A FLORIDA BOATERS SAFETY CERTIFICATE**

Deposit: Reservations require a deposit of the rental amount for the time reserved.

**LESSEE TO READ ALL PAGES OF THIS AGREEMENT AND INITIAL EACH CLAUSE BEFORE SIGNING THIS DOCUMENT**

In consideration of the agreement herein, Crab Island Water Sports, LLC (herein after referred to as the LESSOR) agrees to relinquish command, control and possession lease to the undersigned (herein after referred to as the LESSEE) the Rental Craft and equipment described herein. The LESSEE shall utilize the Rental Craft under the terms of this agreement and all applicable maritime rules, policies and laws as regulated by the United States Coast Guard, Florida Fish and Wildlife Conservation Commission or any other regulatory body.

The United States Coast Guard is responsible for regulating and enforcing standards on Bareboat Chartered vessels. No more than 12 people are allowed onboard our boats (including a captain if LESSEE chooses to hire one per the below and crew). Our double decker pontoon boats can carry up to 14 people provided one of such persons serves as the Captain of such boat and another passenger serves as the crew. If LESSEE is renting a double decker pontoon boat, LESSEE hereby agrees to designate one person on board to serve as the Captain of such boat and another passenger to serve as the Crew. Such Captain and Crew will advise the Coast Guard, FWC, or other law enforcement agency of their positions if asked. The LESSEE is responsible for all food, fuel and mores. No person under 18 years of age may sign a contract for rental of, or charter, Rental Craft. The Charter must take place during daylight hours only. Lessee agrees that only the passengers listed on the Passenger List attached to the Vessel Safety Check and Boarding Pass may be on the Rental Craft and no person who is not listed may be on the Rental Craft at any time.

It is understood that at all times LESSEE remains responsible for the operation and management of the vessel. LESSEE may select and hire a Captain or Crew to operate the Rental Craft and shall pay such captain and crew directly. In order to ensure a minimum level of competency, any hired Captain must have completed an annual competency training that includes proper vessel operation, safety, training and area familiarization. As a courtesy, Crab Island Watersports provides training that meets these requirements and will provide you a list of at least three Captains who are competent to operate a vessel. It is important to understand that any Captain listed is not associated or employed by LESSOR at time of Charter. It is recognized that at any time, for cause, the LESSEE may discharge the Captain and any crew member.

24 Hr. Cancellation Policy: Customers will receive a full refund or credit with 24 hours' notice of cancellation. Customers will also receive a full refund or credit in case of operator cancellation due to weather or other unforeseen circumstances. **Contact us by phone** to cancel or inquire about a cancellation. No cancellations will be accepted via text message or email. No-shows will be charged the full price. Trip Protection is available for purchase to allow cancellation up to 30 minutes before your reservation.

Lessee certifies that he/she will examine the Rental Craft and equipment and advise an employee of lessor if the Rental Craft and/or equipment is not acceptable and suitable for the purpose for which it is leased. Lessee has read and will operate the Rental Craft in accordance with all safety rules and regulations posted at Lessor’s location, which Lessee fully understands.

Lessee agrees to report any accident, malfunction or breakdown of Rental Craft to Lessor immediately by calling lessor at 850-243-2722, which number is located on Lessee’s website and on the Rental Craft. Continued use of it shall entirely at the LESSEE’S risk and thus LESSEE assumes all liability of injury and damage to all persons and property that may become involved by its continued use. LESSEE agrees to pay for all damage to persons and property as well as 20% of damage price to the dockhand crew if the customer does not report damages to persons and property. LESSEE agrees to an automatic 15% gratuity to be included if LESSEE does report damages.

Lessee agrees that prior to signing this agreement that he or she, and all passengers who will travel on the Rental Craft, have read, fully understand, and have signed the Waiver and Unconditional General Release from Liability and agree to be bound by all of the terms of such Waiver and Unconditional General Release from Liability.

This certifies that Lessee or a designated operator is experienced and capable in all aspects of the handling and operation of the Rental Craft such as the one rented above. Lessee is aware of the NO WAKE areas and agrees to be responsible for any damages caused by Lessee’s wake. Lessee hereby certifies that he or she has familiarized themself with a chart of the area.

Water Skiing and Towing anything behind a Rental Craft is strictly prohibited.

I authorize and allow CRAB ISLAND WATER SPORTS, LLC to charge my credit card for any damages to the Rental Craft or equipment or loss of equipment. The rental price does not include tax. First tank of fuel is included in the rental price.

A major credit card authorization (VISA, MasterCard, Discover, American Express or Debit) or CASH in the amount of five hundred dollars ($500.00) for boats and $300 for Waverunners/Jet Skis shall be retained by the LESSOR as partial compensation for failing to return said Rental Craft on time and in as good condition, ordinary wear and tear excluded, as when received; and for reimbursement of articles damaged, missing or broken.

LESSEE agrees not to use, nor permit the use:

a. of the Rental Craft for any unlawful purpose;

b. of the Rental Craft in a careless or negligent manner;

c. of the Rental Craft while under the influence of liquor or narcotics; or any other drugs

d. of the Rental Craft by any other person not listed on the passenger list.

LESSEE acknowledges his/her responsibility for the safe and proper operation of the Rental Craft; and for the safety and welfare of other boaters, persons, and passengers. It is AGREED AND UNDERSTOOD BY LESSEE that the LESSOR shall not be held liable for damages, inconvenience or time lost caused by accident, breakdown or malfunction of the Rental Craft. LESSEE FUTHER AGREES to indemnify and hold harmless the LESSOR and its agents, affiliates and personnel from, and against any and all claims for loss of or damage to property or injury to persons (including death) resulting through the use, operation or possession of said Rental Craft. LESSEE further agrees to hold the LESSOR harmless should loss or damages occur to any LESSEE’S personal property while carried in, or on, the Rental Craft, including loss or damage by fire, water, theft or any other causes whatsoever.

LESSEE expressly agrees to indemnify and hold LESSOR and its agents, affiliates and personnel, harmless of, from and against any and all loss, cost, damages, attorney fee and/or liability in connection with the enforcing of the forgoing rental contract by LESSOR, including expense incurred in connection with attempting to collect delinquent rent and in the event of suit by LESSOR, to recover possession of said rental property and/or to enforce any terms, conditions and/or provisions hereof. It is understood and agreed that Venue and any action hereunder shall be in the county of LESSOR.

LESSOR’S ability to provide a Rental Craft if reserved, is contingent upon and subject to the return of the unit by the previous lessee, or any other cause beyond LESSOR’S control.

LESSOR reserves the right to cancel this rental agreement due to inclement or impending bad weather.

LESSOR hereby certifies and agrees that all passengers who will travel on the Rental Craft can swim well or will wear a lifejacket at all times.

The rules and regulations contained herein and as posted in the office, on the Rental Craft and /or the grounds by the LESSOR are for the safety and welfare of all who use the facilities. The LESSEE certifies that he/she has read and understands said rules and regulations and further assumes the responsibility that his/her family and or guest(s) will obey the rules.

LESSEE agrees to pay $75.00 dollars for every 30 minutes LESSEE is late in returning a Jet Ski and $100 for every 30 minutes LESSEE is late returning a boat.

Should any term or condition of Rental Agreement be held void or unenforceable, then that term shall be deemed severed from this Agreement and the unenforceable, then that term shall be deemed severed from this Agreement and the enforceability and the remainder shall not be affected and will remain in full force and effect.

THE TERMS AND CONDITIONS OF THIS AGREEMENT AND THE WAIVER AND THE UNCONDITIONAL GENERAL RELEASE FROM LIABILITY I HAVE SIGNED, AS WELL AS THE PONTOON BOAT DAMAGE SCHEDULE AND JET SKI AND WAVERUNNER DAMAGE SCHEDULE INCORPORATED HEREIN BY REFERENCE, CONTAIN THE ENTIRE UNDERSTANDING BETWEEN LESSEE AND LESSOR AND NO OTHER REPRESENTATION OR INDUCEMENT, ORAL OR WRITTEN, HAS BEEN MADE WHICH IS NOT INCLUDED IN THIS RENTAL AGREEMENT OR THE WAIVER. IF IT IS NECESSARY FOR LESSOR TO HIRE AN ATTORNEY TO ENFORCE ANY PROVISION OF THIS DOCUMENT OR THE WAIVER, LESSOR SHALL BE ENTITLED TO REIMBURSEMENT FROM LESSEE FOR ALL LEGAL FEES AND COSTS INCURRED IN ENFORCING THIS AGREEMENT OR THE WAIVER INCLUDING, BUT NOT LIMITED TO, ANY ATTORNEY’S FEES AND COSTS INCURRED IN LITIGATION IF LESSOR IS THE PREVAILING PARTY IN SUCH LITIGATION.
