Rental Agreement, Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement.

 

 

 

 

1. The Rental Agreement. These Rental Terms and Conditions, together with any additional agreement(s) signed by the Renter, as well as any documents or agreements (or links to online documents and agreements) sent to the Renter electronically in connection with their rental, constitute this Agreement between the Renter and 1000112576 Ontario Inc O/A RAW Watersports (“RAW”).

2. The Renter. “The Renter ” is the person who will be renting the Watercraft under their legal name and signing and accepting this Agreement.

3. The Rental. The Renter is renting from RAW, Watercraft and/ or Equipment (the “Watercraft”) for short-term personal use. The rental is solely a transfer of possession and not of ownership of the Watercraft. The Renter understands and accepts that that they are not an agent of RAW in any way or for any purpose; and that they cannot assign, delegate, or transfer any of their obligations under this Agreement.

4. Changes. Any change to this Agreement must be in writing and signed by an authorized RAW representative. The Renter further agrees that RAW has the sole right to change these Terms and Conditions from time to time either upon written notice to the Renter, in paper or electronic form, or upon posting such changes on RAW’s website. Such changes will apply to rentals that the Renter reserves after such notice has been given, as indicated by the date of the notice, if sent in written form, or the date the changes are posted on RAW’s website, without any requirement by the Renter to sign the changed Terms and Conditions.

5. Renter Requirements. The Renter represents to RAW that they are at least 21 years old, are a competent and validly licensed operator, and will remain a competent and validly licensed operator throughout the term of their rental. The Renter agrees that RAW has the right to verify that their license has been validly issued and is in good standing as a condition precedent to each rental. RAW, in its sole discretion, may refuse to rent the Watercraft to the Renter if RAW determines that the Renter or additional operator is not competent to operate the Watercraft. RAW may also refuse to rent the Watercraft to the Renter if their license is not in good standing and reserve the right to deny rentals based upon;

- information about the Renter’s license status, or

- authenticity of the Renter ’s Watercraft license or other credentials, or

- the inability to verify the Renter’s identity or payment methods, or

- any other information received from any other source in the business of validating an identity or the Renter ’s credentials that RAW believes to be reliable.

Renter represents that;

- Renter is in good physical condition, and

- knows how to swim, and

- knows of no reason why he or she should not participate in the chosen Activities.

Renter acknowledges that;

- only Renters 21 years old or over may operate Watercraft, and

- children may not drive Watercraft, and

- the Renter must provide a valid Drivers License (and a proof of current motor vehicle insurance when renting the unit along with the trailer), and

- any other participants driving the motor craft must be a minimum of 21 years of age and must be listed on the Rental Agreement and complete a Waiver, and

 

- Transport Canada requires that all pleasure craft operators carry a valid PLEASURE CRAFT OPERATOR CARD or have completed the Safety Checklist as proof of competency.

 

We recommend that you obtain one prior to renting. Otherwise, a Rental Watercraft Safety Checklist will be filled out together with RAW staff and will serve as a Temporary Operator Card approved by Transport Canada and must be carried with you while operating the Watercraft.  

6. Additional Operators. Any person other than the Renter that operates the Watercraft will be required by RAW to complete and sign the additional operator form. RAW charges an additional daily fee for each additional operator authorized to operate the Watercraft. All additional operators may be required to appear at the rental counter with the Renter and present proof of their ability to operate the Watercraft to the satisfaction of RAW. All additional operators may be required to present a major credit card in their name at the time of the rental. The Renter acknowledges that they will remain financially responsible under this Agreement at all times, even if the Watercraft is operated by someone other than the Renter.

7. Safety of Passengers. The Renter is responsible for ensuring the safety of all passengers on board the Watercraft. RAW will not be responsible for injuries or death of passengers resulting from the use of the Watercraft, Trailer and/or any associated equipment.

8. Fuel. The Renter agrees to return the Watercraft fuel of fuel or additional charges for refuelling will be applied.

9. Rental Charges for Watercraft. Unless otherwise agreed upon between Renter and RAW, the Renter agrees to pay RAW for both the length of time the Watercraft is rented, as well as for fuel. The Renter further agrees to pay all charges that apply to the rental for miscellaneous services that may arise by the Renter during the rental period. Miscellaneous fees include but are not limited to; refuelling, late return, damages, cleaning fees, fines, missing keys, remotes, accessories or safety equipment or any other expenses caused by the Renter.

10. Taxes. The Renter acknowledges that all pricing and fees will be subject to all applicable taxes.

11. Error in Rental Charges. The Renter acknowledges and understands that the amounts charged to the Renter immediately upon the return of the Watercraft are not final and are subject to review. The Renter agrees to pay any undercharges that may later be discovered by RAW with respect to the Watercraft and this Agreement.

12. Watercraft Return. The Renter agrees to return the Watercraft to RAW in the same condition as received, on the date, at the time and to the location specified in the Reservation confirmation. If the Watercraft is returned on a later date than that stated on this Agreement, the Renter may be charged a late return fee. The Watercraft may not be returned outside of the return location's operating hours, unless specifically allowed by that location. If the Renter returns a Watercraft outside of return location’s operating hours, the Renter agrees to bear responsibility for damage to or loss of the Watercraft. The Renter further agrees to bear any and all additional charges for the late return of the Watercraft, as the periodic rate will continue to accrue until the return location reopens and processes the return of the Watercraft. If the Renter fails to return the Watercraft to the location specified in this Agreement, as and when required under this Agreement, the Renter may be subject to criminal penalties. The Renter agrees to return the Watercraft in a clean condition, full of fuel and with all accessories and safety equipment intact to avoid additional charges referred to in paragraph 8.

13. Repossession of the Watercraft. The Renter acknowledges that RAW, in its sole discretion, has the right to repossess the Watercraft at any time, including if the Watercraft is found to be illegally or improperly docked, abandoned, or being used in a manner that violates the law or the terms of this Agreement. The Renter acknowledges that RAW’s reasons for repossession provided in this Agreement are not exhaustive, and that RAW is not required to notify the Renter before taking action to repossess the Watercraft. The Renter further acknowledges that RAW may take reasonably necessary steps towards the repossession of the Watercraft, including but not limited to, remotely disabling the Watercraft’s engine, and tracking the Watercraft using GPS devices. The Renter agrees to pay or reimburse RAW for the actual and reasonable costs incurred by RAW to repossess the Watercraft, and that such costs will be charged to the credit card provided to RAW by the Renter .

14. Damage Deposit. Damage to, or Loss of Watercraft.

Every unit will undergo an inspection prior and after your rental.

The Renter must be present at the time of inspection.

Renter is responsible for any and all damages sustained to rental equipment, persons, or property as well as loss or damage of accessories onboard during rental period.

A pre-authorized credit card deposit is required as a damage deposit. The amount varies from $750 to $3000 based upon the selected watercraft which is acknowledged by Renter during the reservation process.

The cardholder must be present to sign for the damage deposit and the Rental Agreement and Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement.

If the Watercraft is lost or damaged, the Renter acknowledges that the Renter will be liable for any loss or damage incurred to the Watercraft, regardless of the cause or who was operating the Watercraft. In the event that the Watercraft is damaged, the Renter agrees to pay RAW’s reasonable estimated repair cost plus Loss of Use. Renter agrees to pay a sum equal to the regular daily (if less than 7 days) or weekly rental rate (if greater than 7 days) of the watercraft for the period that the watercraft is unavailable for rent, regardless of fault, while any damage and/or mechanical repairs are made. Alternatively, if, in its sole discretion, RAW reasonably determines it best to sell the Watercraft in its damaged condition, the Renter will pay the difference between the Watercraft's retail fair market value and the sale proceeds. In the event of theft, the Renter will pay the greater of the Watercraft’s retail fair market value or the depreciated book value. The Renter acknowledges that the depreciated book value may be higher than the retail fair market value. If the Watercraft is damaged, stolen, or lost and is not recovered, the Renter agrees to pay RAW for additional incidental charges, including but not limited to the loss of use of the Watercraft, an administrative fee, towing, and storage charges. The Renter understands and agrees that damages and losses will be the responsibility of the Renter to pay.

 

15. Repairs to the Watercraft. The Renter acknowledges and agrees that they are not authorized to repair or have the Watercraft repaired without RAW’s express prior written consent. Should the Renter repair or have the Watercraft repaired without the express consent of RAW, the Renter will pay the estimated cost to restore the Watercraft to the condition it was in prior to rental by the Renter.

16. Prohibited Uses of Watercraft. The following actions, taken or failed to be taken, by the Renter or any other operators of the Watercraft will violate this Agreement: A. Renter uses or permits the Watercraft to be operated: 1) by anyone other than an authorized operator as defined in paragraph 5; 2) to carry passengers or property for hire or more passengers than the Watercraft is meant to carry; 3) to tow or push anything, including but not limited to waterskiing, kiting, riding inflatable toys, wake boarding, and jet ski fly boarding;; 4) to be operated in a test, race or contest; 5) while the operator is under the influence of alcohol, drugs, any controlled substance, including without limitation, any federally controlled substance listed under the Controlled Drugs and Substances Act S.C. 1996, c. 19 (a "Controlled Substance"), or medications that affect Watercraft operation and/or constitute operating a Watercraft while impaired under applicable law; 6) for conduct that could be charged as a crime, including the transportation of a Controlled Substance or contraband, stolen goods, illegal devices, or persons protected by prohibitions against human trafficking; or 7) recklessly or while overloaded. B. The Renter or an additional operator, whether authorized or not: 1) fail to promptly report to RAW any damage to or loss of the Watercraft when it occurs or when the Renter learns of it and provides RAW with a written accident or incident report or fails to cooperate with RAW’s investigation; 2) Where required by law, failed to report an accident to law enforcement; 3) obtained the Watercraft through fraud or misrepresentation; 4) leave the Watercraft and fail to remove the keys or Watercraft remote and the Watercraft is stolen or vandalized; or 5) intentionally or with willful disregard cause or allow damage to the Watercraft. C. The Renter or an additional operator, whether authorized or not return the Watercraft after hours and the Watercraft is damaged, stolen or vandalized or the Renter otherwise fails to take reasonable steps to secure the Watercraft. D. The Renter fails to securely moor or trailer and lock the Watercraft and trailer when not in use and the Watercraft is damaged or vandalized. E. The Renter or an additional operator operate the Watercraft while using a hand-held wireless communication device or other device that can receive or transmit telephonic communications, electronic data, mail or text messages shall be deemed a breach of this Agreement. THE RENTER ACKNOWLEDGES THAT A VIOLATION OF PARAGRAPH 15, WILL AUTOMATICALLY TERMINATE THIS AGREEMENT AND IS AN EXCLUSION TO AND VOIDS ALL LIABILITY PROTECTION AND ANY OPTIONAL SERVICES THAT THE Renter MAY HAVE ACCEPTED. A VIOLATION OF PARAGRAPH 15 ALSO RESULTS IN THE Renter BEING LIABLE TO RAW FOR ALL PENALTIES, FINES, FORFEITURES, LIENS AND RECOVERY AND STORAGE COSTS, INCLUDING ALL RELATED ACTUAL LEGAL FEES, DISBURSEMENTS, AND COSTS THAT RAW MAY INCUR AS A RESULT OF THE RENTER’S BREACH.

17. Permitted Destinations. The Renter is not permitted to operate the Watercraft outside of Ontario without the express written permission of RAW and agrees to only operate the Watercraft on permissible inland waterways and lakes within Ontario. At no time shall the Renter navigate into American Waters.

18. All Expenses, Costs, Fines and Administrative Fees. The Renter is responsible for reimbursing RAW for all fines, penalties, interest, and court costs incurred by the Renter during the Rental of the Watercraft. Reimbursements include, but are not limited to, marine infractions, storage liens, and any other charges incurred as a result of the Watercraft rental by the Renter. The Renter further agrees to pay a reasonable administrative fee for any violation of this Agreement, such as for RAW’s repossession or recovery of the Watercraft for any reason. The Renter authorizes RAW, at its sole discretion, to pay all infractions, fines, penalties and interest on the Renter’s behalf directly to the appropriate authority and agrees to compensate RAW for the full amounts paid, plus a reasonable administrative fee, and actual legal fees and expenses, if applicable, which will be charged to the Renter ’s credit card on file with RAW. The Renter understands and acknowledges that RAW may be required to cooperate with federal, provincial, municipal, and local officials with enforcing infractions committed by the Renter or another operator of the Watercraft, and permits RAW to provide any information in its possession, concerning the Renter, that these officials may deem necessary.

19. Collection Proceedings. In the event that the Renter fails to pay all amounts owed to RAW under this Agreement upon demand, RAW may take the following actions against the Renter : 1) demand an interest rate of 24% per annum, or the highest rate permitted by applicable law, on all past due amounts owning; 2) the Renter agrees to pay any and all costs incurred by RAW in seeking to collect such outstanding amounts, including but not limited to, actual legal fees, administrative fees, cost of recovery, insufficient funds fees and collection fees; 3) the Renter permits RAW, and its collection agents, to access any and all personal information provided by the Renter to RAW in an effort to collect any amounts owing under paragraph 17; and 4) RAW may report any deficiencies owed by the Renter to an appropriate credit reporting agency.

20. Indemnification. The Renter agrees to defend, indemnify, and hold the manufacturer and distributor of the Watercraft, as well as RAW, including all principles, directors, officers, employees, agents, representatives, servants, assigns, successors, insurers and subsidiaries of RAW, harmless from all losses, liabilities, damages, injuries, claims, demands, awards, costs, actual legal fees, and other expenses incurred by RAW in any manner from this rental transaction or from the use of the Watercraft by the Renter or any person, including claims of, or liabilities to, third parties. THE RENTER WAIVES ANY AND ALL CLAIMS AGAINST RAW FOR INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH THE RENTAL, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS’ LIABILITY ACT ON PART OF THE RAW, AND ALSO INCLUDING THE FAILURE ON PART OF RAW TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT THE Renter FROM RISKS, DANGERS, AND HAZARDS, INCLUDING ANY WARRANTY ON PART OF RAW in respect of the design, manufacture, selection installation, maintenance or adjustment of the Watercraft, or in respect of the provisions or failure to provide any warnings, directions, instructions, or guidance as to the use of the Watercraft.

 

21. WAIVER AND RELEASE OF LIABILITY. THE RENTER FREELY ACCEPTS AND FULLY ASSUMES ALL RISK, DANGERS AND HAZARDS, AS WELL AS THE POSSIBILITY OF PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE AND LOSS THAT MAY RESULT FROM THE RENTER’S USE OF THE WATERCRAFT. There are many risks and dangers associated with Boating and/or, PWC operation and activities around and in the water. There are risks of collisions, falls, injuries to spine, arms and legs, pinching, drowning, and death that can arise from the negligence of others, your own negligence, weather conditions, acts of God, water conditions and your own experience and abilities. For your own safety and the safety of your friends and family who may be participating in your rental activity, it is important that you understand the risks and explain and manage them to every member of your party.

ACKNOWLEDGEMENT OF RISKS I/We acknowledge that the following lists of hazards describe some but not all of the potential risks or injuries while operating a PWC/ Boating. Changing water depth, currents, wave height and direction, Watercraft wake, changing weather, wind, lightning, motion sickness, collision with objects in water, other watercraft, docks & shore walls. Injuries from falls, strain on joints, neck or spine from pounding of waves or collisions. Injuries from capsizing, hypothermia, exposure to water and sun or falling in or from Watercraft. Risks can be reduced or influenced by operator’s condition, experience, tiredness, coordination, balance, disability, focus and group size. If an operator at any time feels that conditions of the environment have become a hazard to the safe operation, they will return to port immediately and call RAW Watersports.

 

ASSUMPTION OF RISK AND RESPONSIBILITY I/We agree to assume responsibility for all risks including those listed and others not identified. My participation in the activity is voluntary. All participants in my party have been made aware of the risks and I will be responsible for them. I am not impaired by alcohol or drugs and I do not have any disability or condition that may impair my safe operation of the watercraft. We elect to participate in the rental use in spite of the risks and potential dangers of operation on and around the water. We understand that at the total discretion of RAW this rental agreement can be terminated when and if there is a question as to the competency or condition of the operator or when weather conditions prevent the safe operation of the watercraft. I/We understand that any film, video, photo or image of me/us while operating the rental watercraft may be used for promotional or social media purposes.

 

RELEASE OF LIABILITY In consideration for the services provided by RAW in the rental of a PWC/Watercraft and/or trailer, I/We for myself and any minor children for which I am a parent or guardian and any Guests that I may be entertaining, or any representative or heir agree that RAW shall have no liability for any injury, death, or damage however caused by operation of the watercraft and I/We release and discharge RAW and its insurer for any damages or injuries however caused. I/We have read the warnings, acknowledgement of risks, assumption of risks and release of liability. I understand that by signing this document I/We may be waiving our legal rights.

 

22. Representations and Warranties. RAW represents and warrants that to its knowledge, the Watercraft is in good condition and is safe for ordinary recreational operation. The Renter represents and warrants that the Renter is legally entitled to operate the Watercraft under the laws of Ontario and will not operate it in violation of any laws, or in any negligent or illegal manner. The Renter also represents and warrants that the Renter can safely tow and trailer the Watercraft to a designated destination, as well as safely launch and recover the Watercraft.

23. Seaworthiness of Watercraft. The Renter agrees to bring to the RAW’s immediate attention if it is determined that the Watercraft is not seaworthy. Failure to inform the RAW in a timely manner may result in liability to the Renter for the damage or loss of the Watercraft.

24. Cancellation. The Renter understands that if they cancel the rental less than 7 days before the Reservation Date, the Renter will be subject to a cancellation fee equivalent to the full value of the rental period selected by the Renter. Only RAW reserves the right to cancel this rental agreement due to inclement or impending bad weather that would prevent the safe operation of the watercraft. Rental fees will be prorated based on time used.

25. Jurisdiction and Severability. In the event of any dispute over this Agreement, this Agreement will be interpreted by the laws of the Province of Ontario. If any portion of this agreement is found to be unenforceable by a court of competent jurisdiction, the remainder of the agreement would still have full force and effect.

26. Entire Agreement. This Agreement constitutes the entire agreement between the Renter and RAW and shall not include any other representation, promise, or warranty other than those set out in this Agreement.

27. Miscellaneous. The Renter acknowledges that, in the event of death or incapacity, this Agreement is binding upon the Renter ’s heirs, next of kin, executors, administrators, assigns, and representatives. RAW reserves the right to transfer its rights and obligations under this Agreement to another party. This will not affect the Renter’s rights or the obligations of the provider under this Agreement. The Renter may only transfer their rights or obligations under this Agreement to another person if RAW agrees in writing. Should RAW fail to insist that the Renter perform any of its obligations under the Rental Agreement, or if RAW does not enforce its rights against the Renter, or delays in doing so, that will not mean that RAW has waived its rights against the Renter and will not mean that the Renter does not have to comply with those obligations. If RAW does waive a default by the Renter, RAW will only do so in writing, and that will not mean that RAW will automatically waive any later default by the Renter.

28. Rules and Regulations. The Renter is expected to abide by all local, Provincial and Federal boating laws including marina and landowner posted NO WAKE signs. The rules and regulations contained herein and as on the watercraft and/or the Company website published by RAW Watersports are for safety and welfare of all who use public waterways. The RENTER certifies that he/she has read and understands said rules and regulations and further assumes the responsibility that his/her family and or guest(s) will obey the rules. The Renter acknowledges that a further Rental Safety Checklist and Safety Briefing will be conducted on the day of rental and that those documents form part of this agreement.

29. Loss or Damage to Trailer. (Is only Applicable when rented with Watercraft) Renter shall pay 1000112576 Ontario Inc. O/A RAW Watersports for all loss, damage and/or mechanical repairs to trailer and accessories, regardless of fault, resulting from abuse and/or misuse and/or negligence. You accept full responsibility for reimbursing RAW Watersports for any lost keys, locks, or tires; or damage or excess wear caused during your use and possession of the trailer.

Insurance. Renter must be 21 years of age, have a valid driver’s license, and must provide RAW Watersports with adequate proof of insurance for the vehicle that will be towing the trailer. The insurance for such vehicle is the direct and primary insurance coverage over any other collectible insurance or agreement. Only the individual signing this agreement may operate the vehicle towing the trailer and the vehicle must be covered by the signer’s insurance coverage. 

Prohibited Use. The trailer of this contract shall not be used: 

a) By anyone not specifically named in this agreement. 

b) By anyone whose ability to operate the tow vehicle is impaired by alcohol, drugs or fatigue. 

c) Outside of Ontario without written consent. 

d) In any contest. e) In violation of any law. 

Loss of Use. Renter agrees to pay a sum equal to the regular daily rental rate of the trailer for each day the trailer is unavailable for rent, regardless of fault, while any damage and/or mechanical repairs are made. 

Reporting of Accidents and Theft. Renter shall report any accident or theft involving the trailer to the police and shall complete a written report as soon as possible and in any event within 24 hours. 

Payment. Renter shall pay all charges incurred in connection with the rental. Renter agrees that if the person or company indicated by renter to be responsible for payment fails to make payment, renter on demand agrees to pay all charges. 

Tickets or Fines. Renter shall pay all fines plus 10% administration fee for all fines or fees associated with traffic and parking violations issued during the rental period. The renter is responsible for any charges from the 407 or any toll road costs while in possession of the trailer. 

Repossession. RAW Watersports may terminate this agreement and repossess the trailer at any time or place. 

Loads. Renter agrees to pay for any and all damage and/or mechanical repairs resulting from the vehicle being overloaded or improperly loaded or resulting from an insecure load. 

Tow Vehicle. Tow vehicles are not covered by RAW Watersports insurance. If trailer referred to on to of this contract is damaged, renter shall pay for all damage, loss of use and towing. All tow vehicles MUST HAVE the proper hitch and wiring required to tow the trailer safely. This may include an electric brake controller if the trailer is equipped with brakes. We can arrange to have proper hitching and wiring installed if you wish. (Subject to availability) Please inquire for details. If you already have hitching and wiring they MUST be in good working order. Any problems or adjustments must be repaired and the cost is the responsibility of the renter Repossession. RAW Watersports may terminate this agreement and repossess the trailer at any time or place. 

Delays and Breakdowns. RAW Watersports is not responsible for loss of time, wages, inconvenience, loss of use of the vehicle or other consequential damage or experience. The trailer has been equipped with a spare tire. RAW Watersports is not responsible for any costs associated with changing the tire in case of a roadside flat. 

Licenses and Permits. Any additional licenses or permits required by provincial authorities are the responsibility of the renter. This includes annual safety inspections on the renters tow vehicle ( yellow sticker ) that is required to tow a trailer with brakes or combination of trailer and tow vehicle exceeding 9920 lbs. 

Security. The trailer comes with a lock which is to remain on the trailer and locked at all times. The trailer should be stored in a secure yard and/or blocked by vehicles and locked when not in use. 

Deposit. A booking and security deposit shall be required from the renter at the time of pickup/ delivery of the trailer. At the commencement and completion of the rental an inspection will be completed and the security deposit will be refunded providing the trailer is returned by the time specified on this contract, clean and in good condition. 

Indemnification. You agree to indemnify and hold harmless RAW Watersports from any and all claims arising out of the use and possession of the trailer. 

Waiver and Release. I hereby (A) waive, release, and discharge from any and all liability for the death, disability, personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me or my family and friends (B) hold harmless RAW Watersports for any and all liabilities and claims made by other individuals or entities as a result of any of my actions or the actions of any associates, employees or reps. You agree to indemnify and hold harmless RAW Watersports from any and all claims arising out of the use and possession of the trailer

UNEXPIRED COPY OF DRIVER’S LICENSE AND PROOF OF INSURANCE MUST BE PROVIDED ON PICKUP.

30. WETSUIT WAIVER FOR SEA DOO RENTALS. (Does not apply to boats)

We recommend the use of a wetsuit. FOR HYGIENE REASONS WE DO NOT PROVIDE THEM. They can be purchased online or a local Canadian Tire and boating supply stores. If you choose not to wear one you must acknowledge below.

I, for myself and/or on behalf of my child or legal ward, have been fully warned and advised by RAW Watersports (hereinafter collectively referred to as ‘RAW’), that we should wear a properly fitted wetsuit bottom, or clothing that provides equivalent protection, while riding or being around Personal Watercraft in order to protect against injuries and/or death caused by water from the jet thrust nozzle being forced into the rectum or vagina. I understand that by not wearing a properly fitted wetsuit bottom, or clothing that provides equivalent protection, I will be going against manufacturers’ requirements and putting myself at an increased risk for injuries, and against the advice of RAW and numerous court cases I am refusing this critical safety precaution. I/we the undersigned have read the foregoing statement carefully before signing and do understand its warnings.

31. Final Charges. ALL CHARGES SUBJECT TO CHANGE PENDING FINAL WATERCRAFT INSPECTION. I authorize and allow RAW to charge my credit card for any cancellation, damages or loss of equipment. Boat rental price does not include refuelling.
