Release And Waiver Of Liability, Assumption Of Risk, And Indemnity And Parental Consent Agreement ("Agreement")

IN CONSIDERATION of being permitted to participate in any way in any gymnastics activity, harness swing or bungee experience ("Activity or Activities") at Monmouth Gymnastics Elite, Inc. any time during the current calendar year I, for myself, my personal representatives, assigns, heirs, and next of kin:

ACKNOWLEDGE, UNDERSTAND & RELEASE

ACKNOWLEDGE, agree and represent that I understand the nature of gymnastics Activities and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe the conditions to be unsafe, I will immediately discontinue further participation in the Activity. FULLY UNDERSTAND that: (a) GYMNASTICS ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("Risks"); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE MONMOUTH GYMNASTICS ELITE, Inc.​, its administrators, directors, agents, officers, members, volunteers, team members, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the RELEASEES herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS; AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may be incurred as the result of such claim. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.



Below section must be completed by Parent/Guardian for any participant under the age of 18.

MINOR & MEDICAL EMERGENCY RELEASE & BUNGEE EXPERIENCE AUTHORIZATION

AND I, THE MINOR'S PARENT AND/OR LEGAL GUARDIAN, UNDERSTAND THE NATURE OF GYMNASTICS ACTIVITIES AND THE MINOR'S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE'S FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR'S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR'S BEHALF MAKES A CLAIMS AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR ANY COST THAT MAY OCCUR AS A RESULT OF ANY SUCH CLAIM. In the event of an accident or emergency I hereby authorize my child to be transported to a hospital for medical treatment, and I hold Monmouth Gymnastics Elite, Inc. and its representatives harmless in the execution of such. I have read and understood this assumption of risk and waiver of liabilty and medical authorization. I have read, understand and agree to all policies on this form.



COVID-19 Notice & Release Agreement & COVID-19 Acknowledgement:

I acknowledge the existence of the COVID-19 Virus, the dangers of the virus and the potential exposure to the virus that could occur as a result of participation. I represent on behalf of myself & my child/children, and any member of my household, to the best of my knowledge, that no one has tested Covid-19 positive within the last 14 days, or is awaiting test results, and has not come in contact with anyone Covid-19 positive in the last 14 days or has been in contact with someone who has traveled abroad in the last 30 days. I hereby certify that I & my participating household members/family do not currently have any of the following symptoms fever, cough, or loss of smell and/or taste, headache, or body aches. I hereby certify that if I & my participating household members/family have recently tested positive for Covid-19 I will notify Monmouth Gymnastics Elite, Inc. immediately and will provide my results and the date of my testing. Finally, I hereby certify that if I & my participating household members/family have tested positive for Covid-19 anti-bodies I will notify Monmouth Gymnastics Elite, Inc. and we will not participate until we are medically cleared to do so.

HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE MONMOUTH GYMNASTICS ELITE, INC, its administrators, directors, agents, officers, members, volunteers, team members, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises for ANY EXPOSURE TO COVID-19 OR LAWSUIT OR CLAIM BY ANYONE AS A RESULT OF THE COVID-19 VIRUS CAUSING INJURY, ILLNESS OR OTHER DAMAGES ARISING FROM PARTICIPATION AT MONMOUTH GYMNASTICS ELITE, INC. AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the RELEASEES, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may be incurred as the result of such claim.




PHOTO & VIDEO AUTHORIZATION

Photos and videos may occassionally be taken of students or participants which includes class, practice, clinic, summer camp, all special events and birthday parties. I agree Monmouth Gymnastics Elite, Inc. is free to use these in marketing publications without notifying or compensating me.
