RELEASE, WAIVER, INDEMNIFICATION, HOLD HARMLESS AND

ASSUMPTION OF THE RISK AGREEMENT

WHEREAS, in consideration of the use of the shooting range and facilities operated by 10mm below LLC dba Alaska Ammo (hereinafter “Alaska Ammo”), and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Undersigned agrees to the following:

The Undersigned hereby acknowledges and agrees to have voluntarily applied to use the shooting range and facilities operated by Alaska Ammo. It is understood and acknowledged that the use of a shooting range in which others, as well as the Undersigned, are engaged in shooting activities involves inherent hazards, dangers, and risks, including, but are not limited to, the negligence, gross negligence, recklessness or inexperience of other shooters, visitors, or participants on the Range and my own negligence, gross negligence, recklessness and inexperience, as well as ricochet bullets or fragments, unintentional or negligent discharges of firearms and loud noises that can cause permanent hearing loss, with or without the use of hearing protection. The Undersigned represents that he/she is physically able, emotionally stable, and fully competent to participate in training and shooting activities and that he/she freely, knowingly, and voluntarily assumes the risks of participating in such activities, including the risks of property damage, bodily harm, injury and death.


I hereby voluntarily RELEASE, FOREVER DISCHARGE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS ALASKA AMMO, its owners, employees and contractors from any and all claims, demands, or causes of action arising out of the inherent hazards, dangers and risks referenced above, or which are in any way connected with my participation in these activities or my use of Alaska Ammo's equipment, rentals or facilities, including any such claims which allege negligent acts or omissions or other culpable conduct of Alaska Ammo, its owners, employees and contractors.


 

I AM ULTIMATELY RESPONSIBLE for my own safety during my use of or participation in Alaska Ammo's facilities, equipment, rentals, or activities.


The Undersigned acknowledges, understands, and agrees to follow all shooting range and facilities rules and directives.


The Undersigned affirms that he/she is not and will refrain from being under the influence of alcoholic beverages, drugs or medications that might impair judgment prior to, and during, shooting sports activities. Further, the Undersigned affirms that he/she understands the possession of and being under the influence of unlawful drugs, as defined under state and federal law, is expressly prohibited on Alaska Ammo property.


The Undersigned affirms, under penalty of law and perjury, that he/she can legally possess or rent a firearm and that he/she has no criminal convictions, criminal indictments, orders of protection or mental illness history that restricts the Undersigned from possession of a firearms under state or federal law.


The Undersigned acknowledges that certain ammunition is restricted on this range and that he/she may not use steel or aluminum case, armor piercing, steel core, incendiary, tracer, or reloaded ammunition outside of manufacturers’ specifications. If restricted ammunition is used, any damages to Alaska Ammo’s facilities resulting from such use may be billed directly to the Undersigned, and the Undersigned agrees to pay for the repair or replacement of such related damaged property.


The Undersigned understands that eye protection and hearing protection are required to be used while using Alaska Ammo’s shooting range, and failure to use proper eye and ear protection is the sole responsibility of the Undersigned. Alaska Ammo recommends that all persons entering the Range wear eye protection which, at a minimum, provides impact protection with side panels and meet ANSI standard Z87.1. Unprotected eyes can be injured by fragments expelled from firearms, ejected cartridge cases, ruptured cartridge cases, splash back from targets, target frames, or backstops. Alaska Ammo also recommends that all person entering the Range wear both ear plugs and over-the-ear hearing protection (double protection). The Undersigned expressly agrees to RELEASE, FOREVER DISCHARGE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS ALASKA AMMO, its owners, employees and contractors from any and all claims, demands, or causes of action arising out the Undersigned’s failure to follow these eye and ear protection recommendations.


 

In addition, the Undersigned does for himself/herself, and on behalf of his/her heirs, executors, administrators, officers, directors, owners, partners, agents, brokers, employees, insurers, and assigns, hereby releases, acquits, indemnifies, and holds harmless Alaska Ammo and its heirs, executors, administrators, trustees, officers, directors, owners, partners, agents, brokers, employees, insurers, assigns, and all other related persons, entities, affiliates, predecessors, and successors, from any and all claims, actions in law or equity, causes of actions, demands, rights, damages, costs, loss of services, expenses, and compensation whatsoever arising from any damage to property, injury to person, or death, (whether predicated upon negligence or otherwise) in connection with use of Alaska Ammo’s shooting range and facilities or participation in any activities therein. The Undersigned takes full legal and financial responsibility for any damage or harm to himself/herself, including property damage, physical injuries or death, and any such damages to his/her minor guests, and for such damages or harm to other individuals on the premises, rental equipment, or other range equipment. The Undersigned understands and agrees that Alaska Ammo’s instructors, employees, agents or contractors are not infallible, and they may give inadequate warnings or instructions.


By signing this document, I acknowledge that if anyone is hurt or killed or property is damaged during my participation in or use of Alaska Ammo's activities or premises or facilities or rental equipment, I may be found by a court of law to have waived my right to maintain a lawsuit against Alaska Ammo on the basis of any claim from which I have released them herein.


By signing this instrument, the Undersigned affirms that he/she has read, understands, and will comply with the requirements as set for the herein, and does hereby agree to defend, indemnify, and hold Alaska Ammo, its shareholders, officers, managers, assigns, heirs, or employees harmless from any act or omission for which the Undersigned and/or his/her minor guests is/are directly or indirectly responsible. This instrument binds the Undersigned and his/her executors, administrators, assignees or heirs.


I HAVE READ AND UNDERSTOOD THE RELEASE AND I AGREE TO BE BOUND BY ITS TERMS. I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I HAVE READ AND UNDERSTOOD IT, AND I AGREE TO BE BOUND BY ITS TERMS.
