CHAOS FACTORY NORMAN, LLC ASSUMPTION OF RISK, RELEASE AND INDEMNIFICATION

In consideration of the user and services, equipment and facilities of Chaos Factory Norman, LLC., their agents, owners, officers, managers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as Chaos Factory Norman), I hereby acknowledge and agree to release, indemnify and discharge Chaos Factory Norman, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate. The Assumption of Risk, Release and Indemnification shall be effective and binding upon my signature.


ASSUMPTION OF RISK

I hereby acknowledge, accept and agree that the use of or participation in a rage room, related activities offered, and the use of Chaos Factory Norman’s services, equipment and facilities is inherently dangerous. Participation in a rage session, including all other related activities offered, may place unusual stresses on the body and is not recommended for persons suffering from asthma, epilepsy, cardiac disorders, hypertension, respiratory disorders, skeletal, joint or ligament conditions or problems and certain mental illnesses. Women who are suspect to be or are pregnant should not use the Rage Rooms. Those that are suspect to be or are intoxicated, will not be permitted to engage in any activity at Chaos Factory Norman.

I have been advised to consult with my medical practitioner if I have any concern about my medical condition or fitness to engage in a rage room or splatter room session. I acknowledge, agree and represent that I am in good health, and in proper physical condition to participate in all activities offered by Chaos Factory Norman.  


I have received full information regarding Chaos Factory Norman’s services, equipment and facilities. I understand that I will be required to listen to and participate in a mandatory Safety Briefing where all rules and regulations will be outlined pertaining to use of all areas of the facility, weapons, equipment, supplies, and any other items available to me while using the facilities of Chaos Factory Norman. I understand that I will have the opportunity to ask any questions regarding the same. Safety rules are as follows:

·        All participants must have a signed waiver prior to entering any room inside of the facility.

·        Anyone under the age of 12 is not permitted in the Rage Rooms at any time. Participants ages 12-17 must be accompanied by a parent or responsible adult, over the age of 18. Adults do not have to participate or be inside of the room, but must be present.

·        All participants are required to wear all provided safety equipment to enter.

·        All participants must wear either the provided coveralls or arrive wearing long sleeve shirts and pants in order to participate in Rage Room activity.

·        All participants of the Splatter Paint Room will be offered optional disposable protective clothing covers, but are allowed to wear their own clothes. (paint is washable, water-based tempura)

·        No open-toed footwear allowed. Hard-soled tennis shoes or boots are required.

·        Do not swing weapons, throw breakables or other items in the room toward other participants.

·        Do not smash items with your feet and be mindful when swinging tools to avoid accidental contact.

·        Items should be thrown on the concrete, not the wall, as it could bounce back off of the plywood.

·        Do not hang or swing from the chain inside of the room. This could cause damage to our ceilings.

·        Do not deliberately hit walls, doors, lights, cameras, clocks, speakers, cinder blocks, windows or other prohibited items in rage rooms. Do not deliberately paint lights, cameras, clocks, speakers, fans or other prohibited items in splatter rooms.

·        You authorize Chaos Factory Norman to charge your credit card for any damages caused by you or anyone in your party. Value of items are listed at the end of this waiver.  


VIOLATION of any of these rules could result in an immediate stop of your session and you may be asked to leave. NO REFUNDS for session suspensions!

I have full knowledge of the nature and extent of all inherent risks associated with Chaos Factory Norman’s services, equipment and facilities. I fully understand that these activities involve risks and dangers of serious bodily injury, including permanent disability, paralysis and even death.  


I fully understand that these risks and dangers may be caused by my own actions or inaction, the actions or inaction of others participating, the condition in which the activity takes place, or the negligence of the “Releasees” defined below.  


I fully accept and assume all such risks and responsibility for any losses, costs and damages I incur as a result of my participation, or that of the minor I am representing, at Chaos Factory Norman.  


I further acknowledge that the below list is not inclusive of all possible inherent risks associated with the use of Chaos Factory Norman’s services, equipment and facilities, and I agree that such list in no way limits the extent or reach of this Assumption of Risk, Release and Indemnification. 

·        Any and all manner of injury, including without limitation: slipping or tripping on debris, paint, wet surfaces, all flooring, equipment or weapons. Failure to wear protective gear, flying debris or any other consequence whatsoever of utilizing Chaos Factory Norman’s services, equipment and facilities;

·        Injuries resulting from the actions or omissions of others, including but not limited to slips, trips and falls of other participants and flying debris;

·        Cuts and abrasions resulting from skin contact with damaged items, glass, debris or any other surface, person or equipment;

·        Injuries resulting from shock, stress or other injury;

·        The aggravation or worsening of any existing medical condition;

·        Failure or misuse of safety gear, weapons or any other items or equipment;

·        Failure to follow safety instructions or failure to ask for information or assistance;



RELEASE

In consideration of my use of Chaos Factory Norman’s services, equipment, facilities, and/or participation in any program, special event, group or party offered by and/or held at Chaos Factory Norman, I hereby release and discharge Chaos Factory Norman, as well as its members, managers, directors, owners, employees, agents and contractors, from all liabilities, suit, claims, causes of action, demands, libel, defamation of character, damages (including attorneys’ fees and expenses), loss or costs of any nature incurred by me or related to or arising out of the use of Chaos Factory Norman’s services, equipment and facilities, whether supervised or not, including without limitation all claims for property damage, personal injuries or wrongful, whether or not with allegations or charges of negligent acts or omissions on the party of any other parties, including Chaos Factory Norman.


INDEMNIFICATION

By signing this agreement, I hereby agree to indemnify Chaos Factory Norman, as well as its members, managers, directors, owners, employees, agents and contractors, from any and all liabilities, suits, claims, causes of action, demands, damages, loss or costs of any nature arising out of, or in any way relating to, my use of or movement throughout Chaos Factory Norman, including services, equipment and facilities, whether or not there are any allegations, charges or negligent acts or omissions on the party of any other parties, including Chaos Factory Norman.

I agree to pay for any and all reasonable attorneys’ fees and expenses incurred by Chaos Factory Norman, as a result of any claims made by me, against me or on my behalf in contravention of this Agreement.

I understand and agree that Chaos Factory Norman and its personnel or staff reserves the right to deny access to its facilities to any individual, permanently or for a specified period of time, for any breach of Chaos Factory Norman’s policies, rules and regulations, for any conduct that is viewed as unsafe or inappropriate, or for any other reason whatsoever, whether disclosed or not.

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or I will otherwise agree to bear the costs of such injury or damage. I further certify that I am willing to assume and bear the costs of all risks that may be created, directly or indirectly by conditions that I do not disclose that could interfere with my ability to participate safely with Chaos Factory Norman’s equipment and facilities.

I agree that the validity and enforceability of this Assumption of Risk, Release, and Indemnification will be governed by the laws of the State of Oklahoma, without regard to its conflict of law rules. I agree to submit any claims and disputes relating to or arising under this Agreement to binding arbitration.

DELIBERATE DAMAGE TO THE FOLLOWING ROOM ITEMS WILL BE CHARGED AS SUCH:

Camera - $125, Speaker - $50, Shelf - $30, Clock Timer - $100,  Door - $300, Concrete Repair - $300,

Window - $400,  Ceiling Lights/Ducts - $200,  Disco Lights - $60, Spool or Table - $40,  Cinder Block - $10,

Wall - $100,  Fan - $30,  Garage Door - $750,  Plastic Crates - $20, Drum Heads - $30,

Chain Hanging/Destruction - $100, Silly String Use - $100



EXCESSIVE CLEAN UP POLICY: PARTY ROOM

If you use the party room, staff will clean up after your event. However, cleanup beyond our normal routine, may be considered “damage” to our space and you will be charged a $100 cleaning fee. Confetti, smears of cake/food or silly string on the floor, walls and chairs are considered excessive.

I agree that if any portion of this Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

I agree that I will not use silly string, as it stains walls and floors. I agree that I will be financially responsible for damage from excessive party room mess, using striking instruments to deliberately destroy or paint on the items listed in the designated box here:

I further consent to Chaos Factory Norman capturing any form of media containing my image, photo or video, and agree that any such media may be used for advertising purposes only. Please inform us upon arrival if you would not like your photos/videos used and we will honor your request. Chaos Factory Norman may add my email address to their mailing list.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Chaos Factory Norman, as well as its members, managers, officers, directors, owners, employees, agents and contractors, on the basis of any claim from which I have released from herein.

By signing this document, I certify that I am at least 18 years of age and legally competent to sign this agreement and that my participation is voluntary, in spite of the risks described herein.

To be read and signed by parent, legally appointed guardian or responsible adult of minor(s)

In consideration of the minor(s), the minor’s name listed as below, being permitted by Chaos Factory Norman to participate in its activities and to use its services, equipment, and facilities, I hereby release Chaos Factory Norman from any and all claims resulting from the aforementioned minor’s participation in or use of Chaos Factory Norman’s services, equipment, and facilities and have described the risks and dangers of these activities to the minor, who chooses to participate in spite of those risks. I am familiar with, consent and agree to the terms and provisions set forth in this Assumption or Risk, Release and Indemnification and I am signing on behalf of myself, and the minor(s) mentioned below.
