Exodus Performance Liability Waiver


I am aware of the potential consequences of having my vehicle modified. I acknowledge that I take 100% responsibility for those consequences. Timothy E. Moore, or Exodus Performance (hereafter EXODUS PERFORMANCE) will take no responsibility, financial or legal, for any undesirable results incurred from modifying my vehicle.


I attest that I am modifying my vehicle with the intention of using it for Racing Competition / Off-Road Use Only. I understand that the vehicle modification may not comply with Federal, State, and/or Local laws, ordinances, or regulations. I take full responsibility to ensure that any modifications done to my vehicle conform to all applicable laws and regulations for road use, especially pertaining to safety and emissions (e.g., Clean Air Act 203 [a][3], 42 USC, 7522[a][3]). I absolve EXODUS PERFORMANCE from any burden of responsibility in ensuring my car satisfies regulations set forth by federal, state, and/or local governing agencies.


Vehicles will undergo a brief pre-service inspection, but I agree that the car is otherwise ready to be tuned/modified. I am responsible for all maintenance on the vehicle. Any time that is spent with repairs and/or modifications of the vehicle to appropriately complete the service may be subject to extra fees that are under the discretion of EXODUS PERFORMANCE. If the tuning or other service cannot be completed due to mechanical or part compatibility issues, the tuning process will be halted, and the cost for cancellation of the tune or service is at the discretion of EXODUS PERFORMANCE. Furthermore, I agree to pay EXODUS PERFORMANCE the full amount I was quoted at the time service is rendered to my vehicle.


Any damage to the vehicle or the vehicle’s transmission, transfer assembly, engine, tires, clutch, brakes, etc., is my responsibility as the vehicle owner. Any voiding of the warranty on the vehicle that may occur from having the vehicle tuned or modified is in no way the fault of EXODUS PERFORMANCE. Situations that are beyond the control of EXODUS PERFORMANCE can arise. I am aware of the potential risks involved with Dyno or street testing/tuning, as well as other vehicle modification, and I waive any and all claims against EXODUS PERFORMANCE.


I understand there are potential risks and dangers involved with engine management tuning and vehicle modification. Tuning is a test of the mechanical limits of my vehicle and can cause failure to components. EXODUS PERFORMANCE cannot be held responsible for any damage incurred before, during, or after the vehicle is tuned or serviced.


Due to the inherent dangers surrounding the operation of the dynamometer (Dyno), there is serious risk of personal injury. Understanding this risk, I agree to assume all liability of accidental injury or bodily harm to myself and others, and hereby release EXODUS PERFORMANCE, its owners, agents, and employees from liability.

  • All sales, including tuning services, are final. Once an order has been shipped or a service has been rendered, it cannot be returned or exchanged.
  • Exodus Performance is not responsible for issuing refunds once an order has been shipped or a service has been completed. We encourage customers to review their orders and service requests carefully before making a purchase.
