ACKNOWLEDGEMENT OF RISK AND WAIVER OF LIABILITY Valid for the 2023-2024 Waterfowl Season In consideration of the services of High Plains Wingshooters, their officers, agents, employees, and stockholders, and al] other persons or entities associated with those businesses (hereinafter collectively referred to as "HPW"), I agree as follows: Although HPW has taken reasonable steps to provide you with appropriate equipment and skilled guides so you can enjoy an activity for which you may not be skilled, we wish to remind you this activity is not without certain inherent risk. Certain inherent risks cannot be eliminated without destroying the unique character of this activity. The same elements that contribute to the unique character of this activity can be causes of loss or damage to your equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. We do not want to frighten you or reduce your enthusiasm for this activity, but we do think it is important for you to know in advance what to expect and to be informed of the inherent risks. The following describes some, but not all, of those inherent risks: 1. Water hazards in boating and wading in the rivers including drowning: 2- Accidental shooting by self or other participants; 3. Hiking in rugged terrain; 4. Injuries from equipment failure, flat tires, brake failure, rope breakage; 5. Encounters with wildlife, animals, hunting dogs, livestock and insects; 6- Temperature extremes; 7. Inclement weather conditions and unavailability of immediate medical attention in the wilderness in case of injury. I am aware that the activities I am participation in at HPW entail risks of injury or death to myself. I understand the above-referenced description of these risks is not complete and that other unknown or unanticipated risks may result in injury or death. I agree to assume responsibility for the risks identified herein and those risks not specifically identified. I understand that these activities may require good physical conditioning and a degree of skill and knowledge. I believe I have that good physical conditioning and the degree of skill and knowledge necessary for me to engage in these activities safely. I understand that I have responsibilities. My participation in these activities is purely voluntary. No one is forcing me to participate and I elect to participate in spite of the inherent risks associated with these activities. I certify that I am fully capable of participating in these activities. Therefore, I assume full responsibility for myself, including my minor children, for bodily injury, death, and loss of personal property and expenses thereof as a result of those inherent risks and dangers and of my negligence in participating in the activity. I have read, understood and accepted the terms and conditions stated herein and in addition to the limitations of liability contained in Wyoming State Statutes, including but not limited to, W.S. 1-1-121 et.seq., I knowingly and intentionally waive and release, indemnify and hold harmless HPW against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys' fees) which are related to , arise out of, or are in any way connected with my participation in this activity, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my engaging in these activities or the use of these services, animals or equipment. I, for myself, my heirs, my successors, executors, and subrogees, further agree not to sue the lodge as a result of nay injury, paralysis, or death suffered in connection with my use and participation in the activities of HPW. I acknowledge that this agreement shall be effective and binding upon myself, my heirs, assigns, personal representative and estate and for all members of my family, including any minors accompanying me. I understand that it is my responsibility to obtain all state and federal licensing needed and will follow all Wyoming Game and Fish Department rules and regulations. Today's Date: October 8, 2024 |
