Waiver of Liability

Farm Overview

Johnson Farms Plants and Pumpkins is a genuine working family farm, managed by three generations of Johnsons, dedicated to providing a delightful fall experience. Offerings include a U-Pick apple orchard, a U-Cut sunflower and fall flower field, a pumpkin patch, a fall veggie field, and Kansas City’s largest Garden Mum crop. Our season and crop availability depend on weather conditions and our commitment to responsible land stewardship. This is a working farm, not just a carnival or amusement park.

Assumption of Risk

I understand that visiting and participating in activities at a working farm involves inherent risks, including but not limited to slipping or falling on uneven terrain, weather-related hazards, injury from farm equipment or farm animals, illness from allergens, and other natural or man-made conditions existing on the FARM premises. I acknowledge that I have been made aware of these risks and voluntarily assume responsibility for any and all risks of injury, illness (including communicable diseases such as COVID-19), loss, or damage to myself, my children, or my property in the event they occur as a result of my participation in any activity on the FARM or due to being present on FARM property. Subsequently, I release the FARM from all liability in the event any of these risks occur and result in any injury to my person, property, or any affiliated member of my party.

Release and Waiver of Liability

In consideration of being permitted to enter and participate in activities at Johnson Farms Plants and Pumpkins (“FARM”), I, on behalf of myself, my heirs, executors, administrators, family members, and assigns, do hereby RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS AND COVENANT NOT TO SUE Johnson Farms, its owners, family members, employees, volunteers, vendors, affiliates, successors, assigns and agents from any and all liability, claims, demands, actions, or causes of action, either in law or in equity, arising out of or related to any loss, damage, injury, illness, or death occurring on the FARM premises, whether caused by the negligence or other tortious actions of the FARM, its employees, volunteers, vendors, affiliates, customers or any other claim that may result from the activities and services provided on the premises to my person, property, or any affiliated member of my party.

Indemnification

I agree to INDEMNIFY and HOLD HARMLESS the FARM from any claims, damages, or expenses related to any injuries to person or property, including attorney’s fees, brought by or on behalf of myself, my minor children, or any third party arising out of my actions, presence and participation in any activity on FARM property. I further agree to INDEMNIFY and HOLD HARMLESS the FARM from any and all claims against the Farm due to any falsification ornegligent disregard for the health and safety of others under the COVID-19 Health Acknowledgment attested below by my signature, including reasonable attorney’s fees and court costs associated with any such claim.

COVID-19 and Health Acknowledgment

By entering the FARM, I confirm that:

• Neither I nor anyone in my household has experienced COVID-19 symptoms (including fever, sore throat, cough, shortness of breath, loss of taste or smell, chills, or unexplained body aches) in the past 14 days.

• Neither I nor anyone in my household has tested positive for COVID-19 or knowingly been exposed to someone who has tested positive within the past 14 days. 

• I am following current CDC guidelines to limit my exposure to COVID-19. I understand that despite precautions, exposure to COVID-19 is possible and accept full responsibility for my own health and safety.

Farm Entry Policy

All individuals 13 years old and under MUST be accompanied by a parent or guardian to enter the FARM. Violation of this policy may result in removal without refund.

Inclement Weather & Closure Policy

Johnson Farms is an outdoor venue and operates rain-or-shine. In rare cases of severe weather or unsafe conditions, the FARM may close. If the FARM closes for the day, a refund or credit equal to the face value of your ticket will be issued (service fees are non-refundable). Notifications of weather-related closures will be posted on the FARM’s official website and social media. Tickets are otherwise non-refundable.

Refund Policy

All ticket and product sales are final. Failure to redeem tickets or complete a visit as scheduled is considered a no-show, with no refund or credit provided. Purchase Protection, if available and selected, may allow refunds under qualifying circumstances.

Photo Release

By entering the FARM, I grant Johnson Farms and its representatives the right to photograph, film, or otherwise capture my likeness and voice for promotional, advertising, and marketing purposes, without additional compensation.

Severability and Acknowledgment

If any provision of this waiver is found unenforceable, the remaining terms shall remain in effect. By signing or purchasing a ticket, I acknowledge that I have read, understood, and voluntarily agreed to this Waiver of Liability and Assumption of Risk.

Applicable Law; Choice of Law; Forum Selection

I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Missouri and that this Release shall be governed by and interpreted in and accordance with the laws of the State of Missouri. I further agree to the exclusive jurisdiction for deciding any dispute shall be in Jackson County, Missouri, and all claims shall be filed in a court of competent jurisdiction in Jackson County, Missouri.

Waiver of Jury Trial

The Parties agree not to elect a jury trial. The Parties waive any current or future right to a jury trial (without regard to any claim, counterclaim, or other action arising under this Agreement).

This waiver of right to jury trial is given knowingly and voluntarily by each party and is intended to encompass any instance under which that right might accrue. Each party is authorized to file a copy of this paragraph in any proceeding as conclusive evidence of this waiver by the other. This provision shall survive the termination of this Agreement.

BY SIGNING THIS AGREEMENT, I ACKNOWLEDGE, REPRESENT, AND AGREE I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL OF THE PROVISIONS OF THIS AGREEMENT INCLUDING SPECIFICALLY AND WITHOUT LIMITATION THE WAIVER, RELEASE AND INDEMNIFICATION OF THESE POTENTIAL CLAIMS AND VOLUNTARILY AGREE TO THESE PROVISIONS.
