Inherent Risks/assumption of the risks

I UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH boarding and riding aboard a boat/water vessel, including but not limited to equipment failure, perils of the sea, acts of other participants, and adverse sea and weather conditions, and I HEREBY ASSUME SUCH RISKS. I UNDERSTAND THAT I HAVE A DUTY TO EXERCISE REASONABLE CARE FOR MY OWN SAFETY AND I AGREE TO DO SO. I assert that I am physically fit to ride on a boat and I will not hold Big Tiki Tours INC or their employees, captain, crew or other associated personnel responsible if I am injured as a result of ANY problems (medical, accidental or otherwise) which may occur while chartering the boat or otherwise participating in the tour.

Medical attention

I fully understand that Big Tiki Tours Inc has limited medical facilities and that in the event of illness or injury, appropriate care must be summoned by radio and treatment will be delayed until I can be transported to a proper medical facility. I agree in advance to these conditions and will not hold Big Tiki Tours Inc or any of their employees responsible for their actings in attempting the performance or rescue or first aid. 

Swimming

I understand that swimming is at my own risk. "Big Tiki" does not have a lifeguard on board.  There may be sea life present while in the water. I understand that I am responsible for my own safety and I agree to do so. 

Alcohol

It is understood that clients may serve beverages containing alcohol(including but not limited to beer, wine, champagne, mixed drinks with liquor)herein after call "alcohol" upon the following conditions.

Under NO circumstances shall Client(s) sell or attempt to sell any Alcohol to anyone.

Client hereby agrees to use their best efforts to ensure that Alcohol will not be served to anyone who is intoxicated or appears to be intoxicated.

Client hereby expressly grants BIG TIKI TOURS Inc. sole discretion and option, to instruct the Captain and/or crew to remove any person(s) from the vessel, if in the opinion of the BIG TIKI TOURS Captain, the person(s) is intoxicated, unruly or could present a danger to themselves or others, and/or the Vessel

I acknowledge BIG TIKI TOURS, Inc. does not sell food and/or alcoholic beverages for events held aboard the BIG TIKI TOURS INC BOATS. BIG TIKI TOURS, Inc., its owners, operators, and employees, are not responsible or liable for any damages to myself or third parties that result from the consumption of alcohol by myself or others, to include, but not limited to, property damage, personal injury, death, disfigurement, or loss of consortium. That should I consume alcohol or food products on the property owned by BIG TIKI TOURS, Inc, I acknowledge that I am solely responsible for any and all damages suffered by myself or that I may cause to third parties as a result of said consumption to include, but not limited to, property damage, personal injury, death, disfigurement, or loss of consortium. That should I provide alcohol and/or serve food to family, friends, guests, or third parties on property owned by BIG TIKI TOURS, Inc, I acknowledge that I am solely responsible for any and all damages suffered by myself or third parties as a result to include, but not limited to, property damage, personal injury, death, disfigurement, or loss of consortium.

Client hereby agrees to be liable and responsible for all act(s) and actions of every kind and nature for each and every person in attendance at Client’s event. That I acknowledge it is against the law to serve, provide, or make available alcohol to anyone under the age of twenty-one (21). I swear and affirm not to provide anyone under the age of twenty-one (21) with alcohol. I further acknowledge that should anyone under the age of twenty-one (21) consume alcohol on the property owned by BIG TIKI TOURS, INC.  BIG TIKI TOURS, INC, will strictly enforce State and Federal Laws and maintain zero tolerance compliance and local authorities will be notified.

Lost items

I acknowledge that while taking the boat tour any loose items I bring on the trip may fall into the water or be blown off the boat by the wind. I agree to assume all responsibility for any items that I bring on the trip and will not hold “Big Tiki Tours Inc” or the employees, captain or crew liable for any damage or loss that may occur to personal property. These items may include, but are not limited to, cameras, camcorders, cell phones, hats, glasses, binoculars, wallets, purses and jewelry.

Life jacket warning and offering

I, myself and/or on behalf of my child, have been fully warned and advised by “Big Tiki Tours Inc” and its captain that a lifejacket should be worn while riding in a vessel from which the tour is given. I acknowledge that “Big Tiki Tours, Inc” and its captain has offered the use of a proper lifejacket. If I choose to forego wearing a lifejacket, I assume all liability that may result from my failure to wear a lifejacket. I also understand and will enforce with minor participants that it is mandatory THAT ALL CHILDREN AGE 12 AND UNDER MUST WEAR A LIFEJACKET AT ALL TIMES while on the vessel Big Tiki.

Release of liability

I agree to forever discharge and release Big Tiki Tours, Inc”,respective officers, directors, employees, owners, members, managers, affiliates, agents, representatives, attorneys, heirs, personal representatives, successors and assigns, all individuals associated with Big Tiki Tours, LLC and all individuals and entities having an interest in the boat being used for Tiki Tours from any and all responsibility or liability, claims, demands, equitable relief, damages, costs, expenses, and causes of action of any kind or character, of any type or nature whatsoever (including negligence), arising for any and all injuries and damages. I agree NOT to make a claim against or sue any of the above parties for injuries or damages whether they arise or result from any NEGLIGENCE, EVEN IN CASES OF GROSS NEGLIGENCE or other liability. I further specifically agree, on behalf of myself, my heirs and assigns, to indemnify and hold harmless the released parties from any and all causes of action arising as a consequence of any incidents which might occur as a consequence of my participation in any boating activities involving the released parties.

I authorize Big Tiki Tours Inc to use Andy photographs, personal narrative, interviews, or audio and/or video recordings of my participation in the boat ride for any and all purposes.
