IN CONSIDERATION OF FAMILY MEMBERSHIP IN RIDERS MOTORCYCLE CLUB INC, herein referred to as “RMC”, and use of the RMC CLUB GROUNDS located at 5535 W100N Ligonier, In, or while attending any EVENT(S) promoted by RMC, its members, sponsors, or associates, the UNDERSIGNED acknowledges and agrees for themselves, personal representatives, heirs, and next of kin: 

1.    Has received a copy of the RMC Member Handbook, and agrees to abide by all documents, policies and procedures specified within. I understand that this handbook may be revised at anytime as is determined necessary by RMC, and updates will be provided to me in order to maintain the accuracy.

2.    HEREBY acknowledges that MOTORCYCLING IS A VERY DANGEROUS SPORT that can result in serious injury or death. The undersigned ASSUMES FULL RESPONSIBILITY FOR ANY RISK OF BODILY INJURY OR DEATH to myself and my family, or damage to my equipment or personal property while acting as a member of RMC, whether caused by the NEGLIGENCE OF RELEASEES or otherwise. The UNDERSIGNED also expressly acknowledges that INJURIES RECEIVED MAY BE COMPOUNDED OR INCREASED BY NEGLIGENT RESCUE OPERATIONS OR PROCEDURES OF THE RELEASEES. I further agree that while upon club property or attending event(s), I will rely on my own inspections of the property, event or activity, and will leave or refuse to participate if I feel anything is unsafe.

3.    HEREBY releases, waives, discharges and covenants not to sue RMC, its officers, members, owners, riders, participants, and lessees of premises used by RMC to conduct the EVENT(S), employees, sponsors, advertisers, officials, rescue personnel, sanctioning organizations, herein referred to as the releasees, ALL LIABILITY TO THE UNDERSIGNED, their personal representatives, assigns, heirs, and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF INJURY TO THE PERSON OR PROPERTY OR RESULTING IN DEATH OF THE UNDERSIGNED, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE while the undersigned is upon the properties, or acting as a member of RMC.

4.    HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the Releasees and each of them FROM ANY LOSS, LIABILITY, DAMAGE, OR COST they may incur arising out of or related to the UNDERSIGNED'S INJURY OR DEATH, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

5.    HEREBY agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the laws of the State or Province in which the Event(s) is/are conducted and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
