PURA PADEL LA — LIABILITY WAIVER AND RELEASE AGREEMENT

PURE PADEL LA LLC dba Pura Padel (“Pura Padel,” “we,” or “us”) operates a private padel club located at Westfield Fashion Square, Sherman Oaks, CA (“Club”).

To access the Club facilities, courts, and amenities, all guests, players, and event participants (“Participants”) are required to read and sign this Liability Waiver and Release Agreement (“Agreement”).

By signing below or agreeing electronically, I (“Participant”) acknowledge, understand, and voluntarily agree to the following terms:

1. ASSUMPTION OF RISK

I understand that participation in padel, fitness, wellness, and related activities involves inherent risks, including but not limited to:

  • Slips, trips, falls, collisions, or injuries from contact with other players, balls, racquets, or equipment.
  • Weather exposure, dehydration, muscle strains, sprains, or other physical injuries.
  • Risks associated with the use of fitness, wellness, and recovery equipment (e.g., cold plunge, stretch areas, or similar).
  • Risks of exposure to communicable diseases, including but not limited to COVID-19.

I fully accept and assume all risks of injury, illness, disability, death, or property damage arising from my participation in Club activities or my presence on the premises, whether caused by my own actions, the actions of others, or the ordinary negligence of Pura Padel or the Released Parties.

2. RELEASE AND WAIVER OF LIABILITY

To the maximum extent permitted by California law, I hereby waive, release, and discharge Pura Padel and its owners, officers, partners, employees, contractors, coaches, agents, event hosts, and affiliates (collectively, “Released Parties”) from any and all liability, claims, demands, or causes of action for injury, loss, or damage of any kind arising out of or related to:

  • My participation in any activity at the Club;
  • My use of equipment, facilities, or amenities;
  • My presence during Club events or programs.

This release expressly includes claims resulting from the ordinary negligence of any Released Party, and I agree not to sue the Released Parties for such claims.

3. CLUB RULES AND CONDUCT

I agree to comply with all Club rules, staff instructions, and safety protocols.

Pura Padel reserves the right to revoke access or remove any person who fails to follow staff directions, engages in unsafe conduct, or disrupts other guests.

Examples of prohibited conduct include but are not limited to:

  • Entering courts without a booking or staff permission.
  • Bringing glass bottles or outside alcohol.
  • Misusing equipment or facilities.
  • Engaging in disorderly, disruptive, or disrespectful behavior toward staff or other guests.

4. MEDICAL CONSENT AND INSURANCE ACKNOWLEDGMENT

In the event of an injury or emergency, I authorize Pura Padel staff, employees, or medical personnel to obtain or provide medical treatment deemed necessary.

I understand and agree that:

  • I am solely responsible for any resulting medical costs;
  • Pura Padel does not provide medical or accident insurance for Participants; and
  • Pura Padel assumes no obligation to secure or pay for medical care on my behalf.

5. PHOTO & MEDIA RELEASE

I grant Pura Padel the irrevocable right to photograph, film, record, or otherwise capture my likeness during my participation or presence at the Club.

I authorize Pura Padel to use such images, videos, or recordings for promotional, marketing, or social media purposes, in any format, without further permission or compensation.

6. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising out of my conduct, participation, or presence at the Club.

7. GOVERNING LAW; VENUE; WAIVER OF JURY TRIAL

This Agreement shall be governed by and construed in accordance with the laws of the State of California.

Any dispute arising from or relating to this Agreement shall be brought exclusively in a court of competent jurisdiction in Los Angeles County, California.

I waive any right to a trial by jury to the fullest extent permitted by law.

(Optionally, if Pura Padel elects to include arbitration in the future, this section can be amended accordingly.)

8. ELECTRONIC SIGNATURE VALIDITY

I agree that an electronic signature, checkbox, or acceptance of this Agreement shall be deemed to have the same legal effect as a manual signature.

9. ACKNOWLEDGMENT AND UNDERSTANDING

By signing below (or submitting electronically), I affirm that:

  • I have carefully read and fully understand this Agreement.
  • I understand that this is a release of liability, including for ordinary negligence.
  • I am voluntarily signing this document.
  • I am at least 18 years old and legally competent to sign.

If signing on behalf of a minor, I represent and warrant that:

  • I am the parent or legal guardian of the minor;
  • I voluntarily consent to the minor’s participation; and
  • I agree to release, indemnify, and hold harmless the Released Parties for any claims brought by or on behalf of the minor.

Parent(s) or Court-Appointed Legal Guardian(s) must sign for any participating minor (those under 18 years of age) and agree that they and the minor are subject to all the terms of this document, as set forth above.
