Rental agreement and waiver

Read the following sections fully and carefully prior to signing. This is a legally valid and binding obligation to release Shaker's Rentals Inc. from all know and unknown obligations, and to indemnify Shaker's Rentals Inc. against claims brought against it based on your use of the Powered Motorcraft. This instrument affects important legal rights.

RELEASE AND WAIVER OF CLAIMS:

For valuable consideration The Renter does release and discharge Shaker's Rentals Inc. from all manner of actions, causes of action, law suits, proceedings, debts, dues, contracts, judgment, damages, claims and demands whatsoever in law or equity, which the renter ever had, now has, or which the renters heirs, executors, administrator or personnel representatives hereafter can, shall, or may have or by reason of any matter, cause anything whatsoever arising out of this agreement out of the use of the Powered Motorcraft, or in any way arising out of the rental relationship between the renter and Shaker's Rentals Inc.

INDEMNIFICATION:

The Renter agrees to defend, indemnify, and hold Shaker's Rentals Inc. harmless from all losses, liabilities, damages, injuries, claims, demands, awards, costs, actual legal fees, and other expenses incurred by Shaker's Rentals Inc. in any manner from this rental transaction or from the use of the Powered Motorcraft by The Renter or any person, including claims of, or liabilities to third parties. The Renter waives any and all claims against Shaker's Rentals Inc. for incidental, special, or consequential damages in connection with the rental including negligence, breach of contract, or breach of any statutory or other duty of care, including any duty of care owed under the Occupiers' liability act on part of Shaker's Rentals Inc, and also including the failure on part of Shaker's Rentals Inc. to take reasonable steps to safeguard or protect The Renter from risks, dangers, and hazards.

TERMS AND CONDITIONS:

1)These terms and conditions constitute the full Agreement between The Renter and Shaker's Rentals Inc.

2)"The Renter" is the person who will be renting the Powered Motorcraft/Boat under their legal name and signing and accepting this agreement.

3) The "Powered Motorcraft" refers to the jetski being rented from Shaker's Rentals Inc. The "Boat" refers to the multiple passenger vessel with 1 driver.

4) The Renter is renting from Shaker's Rentals Inc. for short-term personal use. The rental is solely a transfer of possession and not ownership of the Powered Motorcraft/Boat.

5) Assumption of risk:

The Renter acknowledges that the activities being requested include inherent dangers including the risk of bodily injury and or death. Renter assumes and accepts all risks associated with use of the Powered Motorcraft/Boat.

ACCEPTABLE USE 

The Renter acknowledges they will be the sole operator of the Powered Motorcraft/Boat and will use the Powered Motorcraft/Boat in a careful, safe and conscientious manner. The Renter shall at all times observe and adhere to any rules and guidelines posted by Shaker's Rentals Inc , and any applicable laws or regulations. The Renter shall be responsible at all times for the safety of any and all passengers in the Powered Motorcraft/Boat.


PROHIBITED ACTIVITIES 

The Renter shall not violate any of the following rules or regulations during the rental of the Powered Motorcraft/Boat.

a) No driving while under the influence of alcohol, drugs or any controlled substance.

b) No pets on board unless otherwise authorized.

c)Powered Motorcraft passengers must wear lifejackets at all times. Onboard Boat all passengers 12 and under must wear lifejackets at all times.

d) Condition of the Powered Motorcraft/Boat upon return:

The Renter shall return the Powered Motorcraft/Boat to the designated docking area clean, free of garbage and debris, and in the same condition as it was in when given to the renter, except for ordinary wear and tear. The Renter shall be responsible for any damages caused to the Powered Motorcraft/Boat during the rental period. Shaker's Rentals Inc. shall retain any portion or all of the renters security deposit as necessary to cover repairs for said damages. To the extent that damages to the Powered Motorcraft/Boat exceed the amount of the security deposit renter shall be billed by Shaker's Rentals Inc. for the amount of damages caused by The Renter, including legal fees. A Daily loss of use fee of $300 may be charged.

I, the renter confirms that there are the appropriate number and sizes of life jackets and that they must fit and be worn.


I, the renter will only allow people who have signed their name on the waiver to be a passenger on the Powered Motorcraft/Boat


I, the renter understand that while operating the powered motorcraft I must keep clear of non-powered personal craft. I also understand that I am responsible for my own wake and wash and the effects that it can have on the other lake vessels, wildlife and environment.


I, the renter once involved in an accident must stop, offer assistance and give my identity.


I, the renter agree to never beach the Boat as this will result in hull and prop damage and will forfeit my damage deposit .


I, the renter have been shown the proper procedure for starting and shutting off the engine and understand to never have the Boat engine running while people are in the water. 


I, the renter agree to at all times keep a lookout for other boats, navigational hazards and changing weather conditions.


I, the renter agree to have a cell phone on the powered motorcraft in case of an emergency.



I, the renter agree to never start the motor of the Powered Motorcraft in less than 3 feet of water.


I, the renter understand all of these procedures.

POLICIES:

- driver's must hold a valid driver's license.

- drug and alcohol are strictly prohibited while operating.

- damage deposit of between $500 and $1500 is required of all renters at the time of rental. Renter is responsible for any damages that occur to the boat or powered motorcraft. All boats will be checked for damages to determine if he deposit will be returned.

- any renter who needs to be picked up or rescued due to fault of your own will be subject to a $500 rescue fee.

- Shakers Rentals Inc. reserves the right to cancel reservations without penalty due to mechanical fault or unsafe boating conditions including high winds.

-No footwear worn on the Boat. 

-No red or colored liquids brought on Boat such as red wine.

-Pay attention to fuel gauge and fuel usage. Stay close to fuel dock if out for extended periods.

- Booking time is the time to meet at the boat launch AFTER finding parking. Please arrive at the designated boat launch on time. Take into account the time it may take to find parking. Every 15 minutes that pass from scheduled arrival time will incur a $50 non-refundable charge. This includes arrival of all passengers at the designated boat launch location at the start of the rental, as well as arrival back at the designated boat launch at the conclusion of the rental. 

- Fuel is not included in rental rate and will either be filled up by renter on lake, or off lake by Shaker's Rentals Inc. In the case that the powered motorcraft is filled up off lake the renter is responsible for transferring the fuel cost to Shaker's Rentals Inc.


AVOIDING IMPELLER DAMAGE:

The driver understands that the Powered Motorcraft Jet Ski has an impeller propulsion system in which water is filtered through and debris can easily be sucked into. Damage to the impeller can cost between $500 and $1000. The driver understands that to avoid damaging the impeller he/she must;

-never start the jet ski in less than 3 feet of water.

-avoid driving in shallow areas or over rocky or grassy areas. Driving over seaweed and lake debris such as sticks can be sucked into the impeller and damage it.

-If attempting to beach the Powered Motorcraft the driver must be aware of all hazards so as not to damage the bottom of the hull or suck up debris into the intake.
