Notwithstanding any explicit or implied status as a social invitee, given my membership to the Greenwood Club (Greenwood) located at 261 Mossman Road, Sudbury, MA 01776, I understand and specifically acknowledge that there are risks inherent with social activities occurring at Greenwood, including, but not only limited to swimming, use of the propane gas grills, tennis courts, ping pong tables, bathrooms, showers, and other facilities and equipment contained and commonly found within Greenwood. This general release is not only limited to the aforementioned categories, but also includes injuries that may potentially arise from any occurrence within the context of the Greenwood property, including, but again not limited to, noxious insects, animals, wildlife, wet surfaces, consumption of food and alcohol. I, voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my family, myself, or guests including, but not limited to any type of: personal injury; disability; death; illness; damage; loss; claim; liability; or expense, of any kind, that myself or my family may experience or incur in connection with our attendance at Greenwood or participation in any Greenwood programming (“Claims”). On my behalf, and on behalf of my family and all of our guests, I hereby release, covenant not to sue, discharge, indemnify, and hold harmless Greenwood, its employees, agents, and representatives, of and from the Claims, including all liabilities, other claims (known or unknown), actions, damages, costs or expenses of any kind arising out of or relating thereto. Furthermore, the Coronavirus disease, (COVID-19), caused by a coronavirus called SARS-CoV-2, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly through airborne particles. It has been linked to the deaths of more than one million people living within the United States since its inception. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing have previously and currently, in various locations, prohibited the congregation of groups of people. Greenwood has put in place preventive measures to reduce the spread of COVID-19, however, Greenwood can not guarantee that you, your family, or guests will not become infected with COVID-19. Further, I hereby understand that my attending Greenwood in any capacity could increase the risk of contracting COVID-19. By signing this agreement, I specifically acknowledge the ongoing contagious nature of COVID-19 and voluntarily assume the increased risk that myself in addition to my family and guests could potentially be exposed to or even infected with COVID-19 by attending Greenwood and that such exposure or infection may result in personal injury, illness, temporary disability, permanent disability, lost wages, other related monetary loss, and even death. I understand that the risk of becoming exposed to or infected by COVID-19 at Greenwood may result from the actions, omissions, or negligence of myself and others, including, but not limited to those of any and all Greenwood employees, volunteers, agents, other representatives, and program participants and their guests. I hereby grant the Greenwood Club permission to use my likeness in any photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I the undersigned hereby voluntarily and without reservation acknowledge that my electronic acceptance and signature on this form is my own free act and deed and shall constitute a valid acceptance of all terms and understanding of any representations contained therein as if it was an original signature with ‘fresh ink’ on a ‘hardcopy’.
