WAIVER AND RELEASE OF LIABILITY

 

I ACKNOWLEGE there is risk of injury while participating in Personal Exercise and Fitness Training Activities, including the use of various equipment and;

I ACKNOWLEGE my voluntarily choice to participate in said Activities; and

I HEREBY, for my self and any representatives knowingly and voluntarily agree to the terms of this WAIVER AND RELEASE OF LIABILITY, and hereby waive any and all rights, claims or cause of action of any nature that arise from my participation in the said Activities; and

RELEASE and discharge Everyday FitNthis, located at Various, Elk Grove, Ca 95624, its affiliates, members, and any representatives (collectively releasing), from any physical or psychological injury that I may suffer as direct result of my participation in the aforementioned Activities.

MY VOLUNTARY PARTICIPATION in the Activities IS AT MY OWN RISK; and I AM RESPONSIBLE FOR MY PERON (Body) and POSSESSIONS. I am aware of ASSOCIATED RISKS with my participation, which may include but are not limited to: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, STRESS (Physical and Emotional), ILLNESS, PARALYSIS, MY OWN OR NEGLIGENCE OF OTHERS relating to my participation in Personal Training and Fitness Activities at any Location and; THEREFORE AFTER.

I AGREE to defend and hold harmless Everyday FitNthis against any and all claims, suits or otherwise legal action of any kind for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including legal and attorney’s fees or costs.

I AUTHORIZE Everyday FitNthis and its affiliates to provide any emergency care necessary in event of any emergency, including but not limited to the use of First Aid, CPR, AEDs, transport and sharing of medical information with only medical personnel and; agree to any costs associated with these circumstances. I understand it is my responsibility to carry my own health insurance.

THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT FOR THE DURATION OF MY PARTICIPATION IN THE ACTIVITIES, AND ANY SUBSEQUENT PARTICIPATION.
