1. Acknowledgment and Assumption of Risk

I understand that activities at Woodland Play Café may involve risks of injury, illness, property damage, or other dangers, including but not limited to  cuts,  bruises, slips, trip, falls, sprains, strains, allergic reactions, or potentially more serious injuries. By signing this Release of Liability, Assumption of Risk, and Waiver Agreement (“Agreement”), I hereby voluntarily assume full responsibility for any and all risks, whether known or unknown, foreseeable or unforeseeable, on behalf of myself and any children in my care, even if arising from the negligence of the business or its staff.

2. Release of Liability

I hereby waive, release, and forever discharge Woodland Play Café LLC, its owners, employees, agents, contractors, and affiliates, whether past or present, from any and all liability, claims, or demands resulting from participation in activities at the facility, including those caused by negligence.

3. Indemnification

I agree to indemnify and hold harmless Woodland Play Café LLC, its owners, employees, agents, contractors, and affiliates, whether past or present, from any claims, suits, demands, liabilities, judgments, costs and expenses for any property damages, personal injury, illness, death, loss or theft, or other loss brought by me, my children, or any third party arising from our actions or participation, including attorney’s fees or costs.

4. Health, Sobriety, and Safety Compliance

I affirm that no one in my party is ill, under the influence of any substances that would impair judgment or physical ability, or has any medical conditions that would make participation unsafe. I agree to follow all posted safety rules and instructions provided by staff. I understand that failure to comply may result in removal from the premises.

5. Emergency Medical Treatment

In the event of an emergency, I authorize Woodland Play Café staff to seek emergency medical treatment for myself or my child(ren). I understand and accept sole responsibility for any associated medical, health, or personal injury costs.

6. Supervision Requirement

I understand that Woodland Play Café is not a drop-off facility and that parents and caregivers are expected to actively supervise their children at all times while on the premises. Woodland Play Café staff shall not be responsible for direct or indirect supervision of any child.

7. Payment for Damages

I agree to pay for any and all damages to any property or equipment as a result of my children and/or participants’ actions, neglect, or recklessness and agree to be held liable for all such costs associated with said damages. 

8. Media Release

I give permission for Woodland Play Café to photograph or film me and/or my child(ren) for promotional use in print, online, or social media platforms.

9. Jurisdiction and Severability

This agreement shall be governed by the laws of the State of Tennessee. If any portion of this waiver is found invalid, the remainder shall remain in full effect.

10. Parent/Guardian Acknowledgment

I affirm that I am the legal parent or guardian of the minor(s) named above and have the authority to sign this waiver on their behalf. I FURTHER ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND WAIVER AGREEMENT" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE WOODLAND PLAY CAFÉ AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION.
