• Medical information voluntarily provided by parents

TEXT AND EMAIL COMMUNICATIONS

By enrolling with MKC Dance Studio, parents and guardians consent to receive communications via:

• Studio Pro notifications

• Phone calls

• Social media announcements

• Other electronic communication methods utilized by the studio

Families may opt out of marketing communications; however, they remain responsible for receiving essential studio information regarding schedules, payments, performances, competitions, conventions, and studio operations.

CHILDREN'S PRIVACY

Personal information regarding minor children is collected only through a parent or legal guardian and is used solely for legitimate studio operations.

PRIVACY POLICY CHANGES

MKC Dance Studio reserves the right to update this Privacy Policy at any time. Updated policies will be communicated through official studio communication channels.

MKC DANCE STUDIO, LLC

SEASON 11 PARTICIPATION AGREEMENT, LIABILITY WAIVER, RELEASE OF CLAIMS, MEDIA RELEASE, AND STUDIO POLICIES

Season 11: June 1, 2026 – June 30, 2027

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

In consideration for participation in classes, rehearsals, camps, competitions, conventions, performances, fundraisers, special events, travel activities, playground activities, and all other activities offered by MKC Dance Studio, LLC ("MKC"), located at 6150 State Highway 16 South, Pipe Creek, Texas 78063, I agree to the following on behalf of myself and/or my minor child.

  1. ASSUMPTION OF RISK

I understand that participation in dance, acrobatics, tumbling, stretching, strength and conditioning, rehearsals, performances, competitions, conventions, camps, playground activities, and related events involves inherent risks.

These risks include, but are not limited to:

• Falls

• Sprains and strains

• Broken bones

• Concussions

• Physical injury

• Illness

• Permanent disability

• Property damage

• Death

I voluntarily assume all risks associated with participation in MKC activities.

2. RELEASE OF LIABILITY

I release, waive, discharge, and hold harmless MKC Dance Studio, LLC, its owners, officers, members, instructors, employees, contractors, volunteers, representatives, and affiliates from any and all claims, liabilities, demands, causes of action, damages, losses, expenses, or injuries arising out of participation in any MKC activity, whether caused by negligence or otherwise, to the fullest extent permitted by Texas law.

3. PLAYGROUND AND OUTDOOR AREA USE

I understand that use of the playground and outdoor recreational equipment located on the premises of MKC Dance Studio, LLC and/or Fire & Glory Fitness carries additional risks, including falls, collisions, equipment malfunction, and other injuries.

I voluntarily assume all risks associated with the use of these facilities.

4. MEDICAL AUTHORIZATION

In the event of an emergency, I authorize MKC staff, instructors, or representatives to obtain emergency medical treatment for myself or my child if I cannot be reached.

I understand that I am solely responsible for any medical expenses incurred.

5. INDEMNIFICATION

I agree to indemnify and hold harmless MKC Dance Studio, LLC, its owners, officers, members, employees, contractors, volunteers, and representatives from any claims, damages, judgments, costs, attorney fees, or expenses arising from my participation or my child's participation in studio activities.

6. PHOTO, VIDEO, AND MEDIA RELEASE

I grant permission to MKC Dance Studio, LLC to photograph, videotape, record, and use images, videos, audio recordings, and likenesses of myself and/or my child for promotional, educational, advertising, website, social media, recital, competition, convention, and marketing purposes without compensation.

I understand these materials may be used indefinitely by MKC.

7. PERSONAL PROPERTY

MKC is not responsible for lost, stolen, or damaged personal property, including but not limited to:

• Dancewear

• Costumes

• Electronics

• Jewelry

• Competition items

• Personal belongings

8. STUDIO RULES

I agree to follow all posted rules and policies and comply with instructions provided by MKC staff.

Failure to follow studio policies may result in suspension or dismissal without refund.

9. TUITION AND PAYMENT POLICIES

I understand and agree that:

• Tuition is due on the 1st of each month.

• Tuition is processed through Auto-Pay.

• A valid payment method must remain on file.

• Late fees may be assessed on overdue balances.

• Declined payments remain the responsibility of the account holder.

• Accounts with outstanding balances may be restricted from classes, performances, competitions, conventions, camps, recital participation, costume distribution, and special events.

10. WITHDRAWAL POLICY

Written notice of withdrawal must be submitted by email, text message, or written communication before the 20th day of the month preceding the next billing cycle.

Failure to provide timely notice may result in the next month's tuition being charged.

Withdrawal from classes does not entitle participants to refunds of previously paid fees.

11. NO REFUND POLICY

All payments made to MKC are non-refundable and non-transferable, including but not limited to:

• Registration fees

• Tuition

• Costume fees

• Recital fees

• Competition fees

• Convention fees

• Camp fees

• Choreography fees

• Private lesson fees

• Merchandise purchases

Exceptions may only be made at the sole discretion of MKC or as required by law.

12. ATTENDANCE POLICY

Regular attendance is expected.

Students missing excessive classes may be required to schedule private lessons at the parent's expense to remain eligible for performances, recital participation, competitions, conventions, or team activities.

13. WEATHER, HOLIDAYS, AND STUDIO CLOSURES

MKC follows an annual studio calendar.

Tuition is based on yearly enrollment and is not prorated due to:

• Holidays

• Weather closures

• Illness

• Family vacations

• School activities

• Other missed classes

Makeup classes may be offered at the sole discretion of MKC.

14. COMPETITION TEAM COMMITMENT

Participation on a competition team is a season-long commitment.

Once choreography, registrations, costumes, conventions, competitions, travel arrangements, or related expenses have been committed on behalf of a dancer, all associated fees remain the responsibility of the family regardless of withdrawal.

15. FORCE MAJEURE

MKC shall not be liable for delays, interruptions, schedule changes, closures, cancellations, or inability to provide services due to circumstances beyond its reasonable control, including but not limited to:

• Severe weather

• Natural disasters

• Utility outages

• Government orders

• Public health emergencies

• Facility damage

• Acts of God

15A. TRAVEL, COMPETITION, CONVENTION, AND OFF-SITE EVENT PARTICIPATION

I understand that participation in competitions, conventions, performances, parades, fundraisers, camps, community events, and other off-site activities may require travel away from MKC Dance Studio, LLC.

16. GOVERNING LAW

This Agreement shall be governed by and interpreted under the laws of the State of Texas.

Any legal action arising from this Agreement shall be brought exclusively in the appropriate court located within Texas.

17. SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. ELECTRONIC SIGNATURES

I agree that electronic signatures shall be considered legally binding and equivalent to original handwritten signatures.

19. PARENT & STUDENT CODE OF CONDUCT

MKC is committed to maintaining a positive, supportive, safe, and encouraging environment for all dancers, families, instructors, staff, and guests.

20. COMMUNICATION POLICY

21. RIGHT TO REFUSE OR TERMINATE ENROLLMENT

MKC Dance Studio, LLC reserves the right to refuse enrollment, discontinue services, remove a student from class, team, performance, competition, convention, camp, or any studio activity, or terminate a family's enrollment at any time if MKC determines that continued participation is not in the best interest of the student, other students, staff, or the studio community.

In such circumstances, tuition, fees, competition expenses, costume fees, convention fees, camp fees, choreography fees, merchandise purchases, and other charges shall remain non-refundable.

I acknowledge that travel and participation in off-site events involve additional risks, including but not limited to:

• Transportation accidents

• Slips, trips, and falls

• Injuries occurring at third-party facilities

• Illness or medical emergencies

• Acts of other participants, spectators, vendors, or third parties

• Weather-related incidents

• Property loss, theft, or damage

I voluntarily assume all risks associated with travel to and participation in any off-site activity, whether transportation is provided by the parent/guardian, participant, another family, a third-party transportation provider, or any other source.

I understand that MKC Dance Studio, LLC does not own, operate, control, or maintain competition venues, convention facilities, hotels, event centers, theaters, schools, transportation providers, or other third-party locations used for studio activities.

I release, waive, and hold harmless MKC Dance Studio, LLC, its owners, officers, members, employees, contractors, volunteers, and representatives from any claims, liabilities, damages, losses, injuries, costs, or expenses arising from travel to, attendance at, or participation in any off-site activity.

Parents and guardians remain responsible for supervising their minor children at all competitions, conventions, performances, hotels, and off-site events unless specific supervision arrangements have been expressly provided in writing by MKC Dance Studio, LLC.

ACKNOWLEDGEMENT

I certify that I have carefully read this Agreement, fully understand its contents, understand that I am waiving certain legal rights, and voluntarily agree to all terms and conditions contained herein.

If signing on behalf of a minor child, I certify that I am the child's parent or legal guardian and have the legal authority to enter into this Agreement on the child's behalf.
