HIT TOPIA LIABILITY WAIVER AND RELEASE FORM

In exchange for the use and participation of Hit Topia HitTrax, organized by Hit Topia and or use of the property, facilities, and services of Hit Topia, I agree for myself, and/ or my minor child to the following:

 

1. AGREE TO FOLLOW DIRECTIONS I agree to follow and abide by all posted rules and warnings and further agree to follow all oral instructions given by the operators of Hit Topia, the employees, representatives, or agents therein.

2. ACKNOWLEDGMENT AND ASSUMPTION OF RISK I, the undersigned, acknowledge that participation in Hit Topia activities, including but not limited to the use of mobile sports simulators, inflatable batting cages, and any related athletic or recreational activities, involves inherent risks. These risks may include, but are not limited to: physical injury, equipment malfunction, falls, collisions, and other unforeseen hazards. I certify that I am physically fit and able to participate in such activities. I agree to abide by all safety rules and instructions provided by Hit Topia staff.

3. RELEASE OF LIABILITY In consideration of being allowed to participate in any and all activities provided by Hit Topia, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless Hit Topia, its owners, employees, agents, representatives, sponsors, and affiliates from any and all liability, claims, demands, or causes of action for personal injury, illness, property damage, or wrongful death that may arise from participation in these activities. I understand and voluntarily assume full responsibility for any risks, injuries, or damages, known or unknown, which might occur as a result of my participation in these activities.

4. MEDICAL TREATMENT I give permission for Hit Topia staff to administer basic first aid and/or seek emergency medical treatment on my behalf in the event of an injury or medical emergency. I understand that I am responsible for any resulting medical expenses.

5. MEDIA RELEASE I hereby grant Hit Topia permission to use photographs, videos, and other media taken during the event for promotional and marketing purposes, without compensation.

6. FEES. I agree to pay for all damages to the facility of Hit Topia caused by any negligent, reckless, or willful actions by me or my family.

7. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Oregon law.

8. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this agreement and that I have been given the reasonable opportunity to review it before signing. I acknowledge that I am free to have my own legal counsel review this agreement if I so desire.

9. ENFORCEABILITY. The invalidity or unenforceability of any provisions of this agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this agreement or any of the other applications of such provision, as the case may be. Such invalid or unenforceable provision shall be deemed not to be a part of this agreement.

10. MINORS. If the participant is under the age of 18, this waiver must be signed by a parent or legal guardian. The parent/guardian also agrees to the terms above on behalf of the minor.
