For minors, we collect the name and age of the minor as provided by the parent or legal guardian.

2. Tour Recording and Video Collection

AJ’S Adventures LLC records all tours, guided and unguided. These recordings are used for two purposes. First, recordings are used to improve safety, training, and operational quality. Second, recordings may be made available for customers to purchase as optional media content. By booking a service, clients acknowledge and consent to being recorded during the activity.

3. How We Use Your Information

We use the information you provide to manage bookings, communicate with clients, ensure safety during activities, verify waiver acceptance, and deliver the services you have requested. Information may also be used for internal record keeping, operational improvements, and customer support.

4. Electronic Signature and Legal Acceptance

When you check the acceptance box for our waiver or terms and conditions, this action serves as your legal signature. This electronic acceptance applies to yourself and any minor under your care. It carries the same legal force and effect as a handwritten signature.

5. Protection of Your Information

AJ’S Adventures LLC takes reasonable measures to protect your information from unauthorized access, disclosure, or misuse. We use secure booking systems and limit access to personal information to authorized personnel only.

6. Sharing of Information

We do not sell or rent your personal information. We may share information only when necessary to operate our services, such as with our booking platform provider, or when required by law, safety protocols, or emergency response personnel.

7. Minors and Guardian Responsibility

PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK

In consideration of the services of AJ's Adventures LLC, their agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "AJ’S"), I hereby agree to release, indemnify, and discharge AJ’S, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1.    I acknowledge that my participation in UTV, and day hiking activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity. 

The risks include, among other things: the possibility of rough terrain; passengers can be jolted, jarred, bounced around, thrown about and otherwise shaken during rides; it is possible that riders could be injured if they come into contact with other passengers or equipment; injuries can be sustained from the trail, equipment or from items on the trail such as holes, bumps, ruts, obstacles, tree limbs and branches or rocks; riding on uneven snow covered terrain, changing snow conditions and variations in elevations; loss of control of the equipment; major injuries are a risk as are sprains, strains, scratches, bruises, abrasions, cuts, lacerations, broken bones, fractures, musculoskeletal injuries including head, neck, and back injuries; injuries to internal organs; loss of fingers or other appendages; exposure to the elements of the outdoors and natural surroundings which could cause hypothermia, hyperthermia (heat related illnesses), heat exhaustion, heat stroke, sunburn, frostbite, frost nip, dehydration; and exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; the negligence of participants, or other persons who may be present; travel in remote areas; steepness of slopes; further, passengers can be thrown off the vehicle which can result in any of the above events occurring; collision with fixed or movable objects; collisions, and flipping over; transmissible pathogen or disease; accidents or illness can occur in remote places without medical facilities and emergency treatment or other services rendered; the machine itself may fail; and accidents can occur getting in, out, on or off; traveling to and from activity locations raises the possibility of any manner of transportation accidents; additionally, fatigue, chill and/or dizziness may diminish my/our reaction time and increase the risk of an accident.

2.    I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. I agree to wear a properly fitted and secured DOT or SNELL certified helmet while participating in this activity.

3.    I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless AJ’S from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of AJ’S’s equipment or facilities, including any such claims which allege negligent acts or omissions ofAJ’S.

4.    Should AJ’S or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

5.    I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

6.    In the event that I file a lawsuit against AJ’S, I agree to do so solely in the state of Maryland, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against AJ’S on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
